Little Falls Man Byron Smith Accused of Killing Two Teen Burglars, Not Reporting Shooting

Police have taken into custody a 64-year-old Minnesota man accused of killing two teens he said broke into his home and hiding their bodies in his basement.
Byron Smith was arrested after he told police officers of the shooting a day later, after they visited his home to investigate reports of su ious activities.
‘Smith immediately told the deputies that he had shot and killed two people breaking into his home the day prior,’ the sheriff's office said in a news release.
Police said that they recovered the body of an 18-year-old female and a 17-year-old male from Smith’s home, and ABC News affiliate KSTP-TV in Minnesota is reporting that the two are cousins Haley Kifer and Nicholas Brady.
Minnesota law stipulates that individuals are permitted to use deadly force when defending their homes, but authorities said that there was evidence to suggest that Smith may have gone beyond self defense.
‘A person has every right to defend themselves and their homes, even employing deadly force if necessary,’ Morrison County Sheriff Michel Wetzel said in a news release. ‘Cir stances of this case however, led deputies to believe that Smith went beyond that point.’
Smith, a former government employee who also worked in security, was arrested Friday and is being held on second degree murder charges. He will appear in court Monday where more details will likely emerge.
According to his friends, Smith said that he had didn’t go to police immediately after the shooting because he panicked.
‘He was very traumatized by what had occurred and didn’t know who to call or what to do and that is very sad that the whole even happened,’ Kathy Lange said of her friend to KSTP-TV.

John Lange said that Smith might have ‘snapped’ after having been burglarized at least twice before by other teens in the area, according to the Star Tribune. Smith said that he suspected that the two had been responsible for at least some of those past robberies.
Students who went to the same school as Brady, one of the victims, said that they weren’t surprised that he would be involved in a robbery.
‘He gets in trouble at school a lot and it’s something that could happen with his friend group,’ Forest Wonderlich told KSTP-TV.
Meanwhile, those who knew the two painted a starkly different picture.
Kifer was a senior at Little Falls High School who was heavily involved in diving and gymnastics, while principal Scott Doss of Pillager High School, where Brady had attended, said he had a ‘million-dollar smile.’
A Facebook tribute page has already been made for the two where commenters have posted notes like ‘Hope The Authorities Figure out How Everything Really Happened and Soon' and 'Absolutely deplorable! The truth will come out eventually.'

Very strange, but if they were two black guys, no one would think it was strange at all, just the fact he hid them. Certainly the fact they are lily white and nice looking young people causes people to think the old dude is hiding something.
Off the thread le I was ready to come in here full of bluster in this guy's favor, but you put down two burglars and toss their bodies in the basement instead of calling the cops? That's a whole lot of shady right there. Don't know what kind of security work the guy but that seems like the sort of thing where he might be a little more educated than the average citizen on the do's and don'ts of using deadly force. I also don't know how different the laws are up there vs here in Texas, where the law is most definitely on the homeowner's side in cases like this, but it sounds like it must be something pretty solid for the cops to jump straight to charging him with murder. Maybe the wounds were more execution style or it looked like he sat them down at gun point before blowing them away.

A Minnesota man authorities say shot and killed two teenagers who apparently broke into his home on Thanksgiving did not reap the benefit of the state's castle doctrine.
Despite that law, prosecutors have charged 64-year-old David Byron Smith with two counts of second degree murder. The details of the shootings suggest why Smith didn't deserve any benefit of the doubt.
As the Associated Press reports, Smith told authorities he was in his basement when he heard a window breaking upstairs. He saw someone coming down the stairs and shot Nicholas Schaeffel, 17, as he descended.
When Schaeffle's cousin, Haile Kifer, 18, then followed down the stairs, Smith shot her too, the APreported, citing the criminal complaint, which includes some chilling details.
Smith told investigators he shot Kifer several times with a rifle, but then again in the chest with handgun because she had laughed after the first shots.
"If you're trying to shoot somebody and they laugh at you, you go again," Smith told investigators, according to a criminal complaint filed Monday.
He dragged her body away from the foot of the stairs, and when he saw she was still gasping for air, Smith fired once more under her chin, which he described to investigators as "a good clean finishing shot."
Minnesota's governor earlier this year vetoed a bill that would have expanded the state's castle doctrine to places outside the home, and limited the duty to retreat from threatening situations before resorting to deadly force.
Current law allows a homeowner to use deadly force only if a reasonable person would believe they were in danger of harm. Smith told police he feared the intruders had weapons.
I can't find the original article I read about it, but they said he described it up under the chin toward the top of the head. Also, he shot her several times until his gun jammed up and he went to go grab another gun to finish shooting her then the kill shot.

Yes, because at this point he knows she isn't a threat. He could probably win if it was just him dead and she got shot, but he will catch at least one conviction for that right there.
