The DA also said that for early voting, as long as people are showing up the polls can stay open until the last person arrives even if they're not there by 8:00. Different rules on election night.
This is one of thousands of decisions Trump has lost or dropped.
Nothing new for the guy who keeps lawyers employed.
I'd argue, too, that Trump waived this complaint by waiting until very late in the day on Monday to pursue it.
Assume for a moment that the judge had ruled that all of those who voted after closing time did so improperly (which sounds factually incorrect, but regardless). All of those people would still have a right to cast a ballot in this election because their prior votes would be disregarded as if they had never been cast. As such, those people would be able to legally vote on election day. By waiting until election day to have this issue heard (and decided), though, the Trump campaign essentially sought to not just disregard those ballots, but to fundamentally impede the rights of those people to vote in an election without any legal justification for denying them the vote. If the judge had ruled for Trump, all of those who voted late would have to realize that their votes had been disregarded and then get to a polling place today to re-cast their ballots.
If Trump really thought the polling places were illegally kept open, his burden was to challenge those votes before election day. By waiting to election day, his argument is less of an argument than a ploy to implicitly disenfranchise, which should be rejected out of hand.
In any event, the claimed violation is really de minimis in any real sense. The ballots were all cast before the final closing of polls on Election Day; at bottom, it's absurd that we hold elections when we do and that so many people are willing to take actions that make casting a ballot harder rather than easier. They claim to want everyone to vote, but then do little to facilitate that actually happening.
