    "PRINCETON — A parent challenging Bible classes in Mercer County has filed an appeal before the United States Court of Appeals for the Fourth Circuit, the Freedom From Religion Foundation (FFRF) announced Tuesday.

    The Wisconsin-based group Freedom From Religion Foundation, Inc. filed a lawsuit against the Mercer County Board of Education in January 2017 seeking to end the Bible in the Schools program based on the claim it violated the First Amendment.

    Months later Mercer County Schools terminated the employment of all Bible in the Schools teachers and the Mercer County Board of Education later voted to suspend the program for at least a year to ensure thorough review and modification to the program.

    Elizabeth Deal, a parent challenging Bible classes in Mercer County, filed an appeal Monday before the Fourth U.S. Circuit Court of Appeals in Richmond, Va., according to an FFRF press release issued Tuesday. The appellate brief filed by attorney Marc Schneider and Freedom From Religion Foundation Senior Counsel Patrick Elliott argued that Deal and her daughter may continue to pursue claims against the school district even though her daughter is now attending a neighboring school system.

    Attorneys for the FFRF argued that Deal and her daughter, known as Jessica Roe in the court do ents, “suffered harm due to the Bible classes.” Roe attended Memorial Primary School from 2012 to 2016 (kindergarten to third grade) where she did not participate in the Bible in the Schools program.

    “Despite Elizabeth’s efforts to shield Jessica from the Christian teachings of (Bible in the Schools), Jessica had direct, unwelcome contact with the classes,” according to the brief. “Once Jessica was able to avoid the classes themselves, her peers began harassing her — going so far as to condemn her family to . To get away from (the program), Elizabeth removed Jessica from Mercer Schools and enrolled her in a different district. Through all of this, Elizabeth and Jessica have felt like outsiders in the community where they continue to reside.”

    In November 2017, Federal Court Judge David A. Faber dismissed the lawsuit based on the program’s suspension. The court ruling did leave the door open for an injunction if the program is reinstated in the future and found to violate cons utional law.

    Faber wrote in his November 2017 ruling, “There is no allegation in the Amended Complaint that Jessica Roe would return to school in Mercer County if the Bible in the Schools program was enjoined. For this reason, the court has no reason to believe that the prospective relief sought by Deal and Roe would redress their grievances. This is especially true where, as here, the Amended Complaint does not allege that the Bible in the Schools program was the only reason for sending Roe to the school outside of Mercer County.”

    The ruling also stated that standing did not exist for their claims for relief."
