AUSTIN

- A federal judge hearing a ballot dispute Monday involving former U.S. Rep. Tom DeLay said he thinks that DeLay withdrew from the November election, indicating potential trouble for Republicans who want to name a replacement candidate.

"He is not going to participate in the election and he withdrew," said U.S. District Judge Sam Sparks, who did not issue an official ruling after a daylong trial regarding DeLay's status as the GOP nominee for the 22nd Congressional District.

Jim Bopp, a lawyer for the Republican Party of Texas, disagreed, telling Sparks "there's been no withdrawal." Bopp said that instead, DeLay moved to Virginia, making him ineligible and triggering a state law that allows the party to select a new nominee.

Sparks also said that if political parties are allowed to replace primary election winners with more popular candidates, "the abuse would be incredible."

Not that a little thing like handing a Congressional seat to Democrats matters to Tom Delay, I mean, he took the money that Republicans donated for his re-election bid and threw it into his defense coffeer..

WASHINGTON (CNN) -- Embattled Rep. Tom DeLay said Tuesday he's dropping his bid for re-election, while insisting he's never acted improperly.

"I've never done anything while I've been in elective office for my personal gain," he told CNN's "The Situation Room."



Dropping out of the race allows Delay to use his left over campaign contributions to help bankroll his legal defense, said Ken Gross, a Washington lawyer who specializes in campaign finance. DeLay had $1.3 million in his coffers in mid-February, according to federal campaign-finance records.

AUSTIN — A federal judge ruled today that Republicans cannot replace former U.S. Rep. Tom DeLay on the ballot for the 22nd Congressional District race.

U.S. District Judge Sam Sparks, a Republican appointee, ruled that DeLay must appear on the Nov. 7 ballot as the GOP nominee for the congressional seat that DeLay abandoned last month. Sparks ruling was confirmed by Texas Democratic Party spokeswoman Amber Moon.

If the Republicans lose on appeal, DeLay will have to decide whether to campaign for an office from which he already has resigned.

When he announced his resignation, DeLay said he believed he could win re-election but thought he would be a drag on other Republican candidates for office because Democrats would use him as a lightening rod to raise money and attack the GOP in general. So he resigned and dropped his re-election bid.

Indicted former House Majority Leader Tom DeLay plans to run for his old seat

Could Tom DeLay be headed back to the House?

A source close to the ex-Congressman tells TIME that DeLay is planning an aggressive campaign to retake the House seat he quit in June if an appeals court lets stand a ruling by a federal judge last week that his name must stay on November's ballot—even though he has moved to Virginia.

"If it isn't overturned, Katy bar the door!" says a G.O.P. official. "Guess he'll have to fire up the engines on the campaign and let 'er rip."

DeLay, awaiting trial for money laundering, never intended to fade away. He plans to give paid speeches and has signed a deal to have his bio penned by best-selling author Stephen Mansfield. But to run, DeLay would have to raise money fast: his campaign fund has well under $1 million left. At least he knows his would-be opponent well: ex-Congressman Nick Lampson's original district was eliminated in a redistricting engineered by DeLay.

They are "bringing Delay back" because the courts have left them no other options. Nice spin, though. He had little chance before, which is why he resigned in the first place. I don't think that quitting on his district is going to help his campaign.

Actually, Gerrymandering GOP voters out of his dsitrict and into other less GOP friendly ones is what put his chances this year into peril even before he quit. Gerrymandering them back in would only put some other poor GOP schmo into electoral danger.
