Judge frees teen imprisoned for consensual oral sex

A judge today ordered that Genarlow Wilson be freed from prison, where he has spent more than two years for receiving consensual oral sex from a 15-year-old girl when he was 17.

Monroe County Superior Court Judge Thomas Wilson also amended Wilson's felony conviction to a misdemeanor without the requirement that he register as a sex offender.

Wilson's lawyer, B.J. Bernstein, appealed to a judge Wednesday to free him from prison, arguing that his 10-year prison sentence and inclusion on the state's sex offender registry is grossly disproportionate and violates the Cons ution.

Bernstein also pointed to how the Legislature changed the law since Wilson's conviction to make similar acts a misdemeanor punishable by a maximum of one year in prison. Wilson, now 21, has been locked up for more than two years.

"It is extremely, extremely disturbing that the attorney general would take this action now," Bernstein said, adding that she did not know what message "he's trying to send" or "who he's representing."

In a written statement, Georgia Attorney General Thurbert Baker said he filed the appeal to resolve "clearly erroneous legal issues," saying that while the judge did have the authority to grant habeas relief, he did not have the authority "to reduce or modify the judgment of the trial court."

IF this the kid that had the college scholarship and was going to be a big football star, that got videotaped getting that BJ ?

I'm so glad they let this poor kid out. Even better they wiped the felony. What a freaking travesty of justice. This judge needs to be applauded for turning over that lousy ruling and case of jury manipulation.


Man what made it even rougher was this kid beating himself up like he was some kind of s bag over it...when he was getting screwed on all sides.

This case should have never made it to court, but that's what happens when the laws are placed in black and white, without the foresight of their implications. I have always been an advocate that all laws should have a purpose and scope, and if a case is brought up outside these qualifiers, the law should not apply. I believe this case was tried under a law designed to put sexual predators away. Not to put kids in jail.

At least the case was looked at again, the 10 year sentence nullified, and the misdemeanor completed with time served.

Awesome. This was a long time coming.

One of the few good things ESPN has done in the last ten years was their in-depth OTL on this case a few months ago, and I wouldn't be surprised if the public outrage generated by that story had a lot to do with getting this kid out.

I'm too lazy to look it up but, if my memory serves me correctly, this is the guy that was dropped from a separate criminal prosecution arising from the same incident in which there were two underage girls; one apparently enjoying herself and another that was not.

I understand that both sets of parents (of the girls) are incensed this guy is getting off light.

There is much more to the incident that is being portrayed in the story. This guy just got a good lawyer.

At some point, we have to call our children adults and hold them responsible for their actions. 17 is the age of emancipation, 15 is not. He was 17, she (and the other girl) were not.

Wilson was also charged with raping a 17-year-old girl at the party -- who prosecutors maintained was too intoxicated to consent -- but jurors acquitted him on that charge.

You are way way off on this one Yoni...this kid got royally screwed, including by those girls...

The reason he got sent to prison was because a guilty verdict carried a mandatory sentence and was an automatic felony...the jury was not notified of that when reaching the guilty verdict. They were asked and I believe everyone of them said they wouldn't have voted guilty if they had known that was the penalty he was going to recieve.


He was a 17 year old kid who got a BJ(and he wasn't the only one) from a 15 year old girl who lied about her age.

And the girl who claimed she was raped was proven on the video to be full of it IIRC. SHe was ready and willing...she just didn't remember being so the next day.

And he did not have sex with her anyway IIRC...he just got the BJ....it was on tape, that was what got him busted.

It was stupid for a scholarship-bound athlete with everything going for him to go to such a party and engage in such acts. He'll only grow up to be another college or pro athlete criminal with that kind of at ude and moral compass. Putting his ass in jail and ruining his stellar athletic career is probably saving some one else down the road.

There is video tape of him screwing the 17 year-old girl while she was barely conscious. The girl had earlier been videotaped unconscious on the bathroom floor and later videotaped being drug unconscious off the bed.

As for the 15 year old girl. Maybe she was "star-struck" or "trying to go along to get along." Every 15 year old girl wants to be the girl bedding the football star. That's why at 15 we don't hold her responsible for her acts -- even if they were committed voluntarily. At 17, he's supposed to be the one who resists engaging in her corruption.
