Five Miami Beach officers charged after police swarm, attack suspect and bystander who recorded it
multiple officers were caught brutally slamming a man into the ground.
A bystander who was filming the incident became a target when the officers tackled and punched him repeatedly. What did the two men who were attached have in common?
Both victims were Black.
While all five officers involved in the incident were suspended last week,

To do this, officers dig into their databases and dredge up every arrest, citation, and documented interaction with law enforcement to make it appear as though the officers have (permanently) removed a threat from the streets, rather than simply applied excessive force until the person was dead.
The NYPD is no different than other agencies. It did this following the killing of Eric Garner (https://www.techdirt.com/articles/20140810/20475228171/nypd-officer-chokes-man-to-death-cops-blame-cellphone-recordings-people-feeling-they-have-more-rights.shtml), leaking arrest records to press outlets in hopes of portraying the dead man as a persistent threat to public safety and police officers.
But the NYPD breaks the law when it does this. State law is supposed to prevent access to sealed arrest records -- records that aren't tied to convictions.
This law is in place to protect people from discrimination and harassment by making these unavailable to be used against them when being interviewed for jobs or seeking places to live, just to name a couple of examples.

This isn't the first time the NYPD's unlawful access has been challenged.
It has not only been told by legislators it can't do this,
it has been told by a judge.
In court, lawyers from the New York City Law Department, which represents the city and the NYPD, don’t deny that they’re accessing the records the law says should be sealed.
Instead, they’ve argued that the law actually allows police to access sealed records without a court order.

Police Video Shows Officers Fire Nine Shots at Bijan Ghaisar's Car in Deadly Chase
An expert witness 322-page report has indicated that the police officers knew Ghaisar wasn't the "striking vehicle" suspected in the accident.
dashcam footage of U.S. Park Police officers chasing a driver on a motorway, before walking towards his vehicle and shooting him dead,
The video shows Park Police officers driving in pursuit of Ghaisar's Jeep Grand Cherokee and as he slows down on two occasions,

Both times, Ghaisar drives off.
The video ends when the driver slows at a stop sign, at which point one of the Park Police vehicles pulls up in front of his car to box him in.
Officers once again emerge from their vehicles with firearms at the ready.
The Jeep attempts to slowly drive towards the right side of the obstruction and away from the officers when five gunshots are heard.

That's why it's allowed its so-called predictive policing program to infiltrate local schools, subjecting minors (and their families) to the same harassment previously limited to adults with criminal records. When footage is recorded, the agency routinely refuses to release it. And a recently retired supervisor who oversaw a particularly violent clique of troopers told internal investigators this year that it was his “common practice” to rubber-stamp officers’ use-of-force reports without reviewing body-camera video.
In some cases, troopers omitted uses of force such as blows to the head from official reports, and in others troopers sought to justify their actions by claiming suspects were violent, resisting or escaping, all of which were contradicted by video footage.
“Hyper-aggressiveness is winked upon and nodded and allowed to go on,” said Andrew Scott, a former Boca Raton, Florida, police chief and use-of-force expert who reviewed videos obtained by AP. “It’s very clear that the agency accepts that type of behavior.”

That Hasn’t Stopped Some From Jeopardizing Cases.
In each of the cases, the officers’ testimony was supposed to help prosecutors secure convictions against people charged with illegal gun possession.
Instead, the cases fell apart, done in by the officers’ own dubious statements.
Yet prosecutors had pursued trials knowing there was reason not to put these cops on the stand.
That’s because they were among hundreds of officers placed on the Bronx district attorney’s “No Fly List,” a secret roster of officers whose cases are supposed to get an extra level of scrutiny by prosecutors.
The list was created a decade ago amid a sprawling investigation into the
city’s biggest police union and its role in helping officers “fix” tickets issued to family and friends for speeding, illegal parking and other traffic offenses.
It grew to 664 names and was intended to help prosecutors vet cases that might rest too heavily on
officers whose ties to the scandal could raise questions about their conduct and credibility.
Ten years after it was first created, the No Fly List itself remains secret by judicial seal.

JABBAR COLLINS LANGUISHED in jail for over 16 years for a murder he apparently never committed. He was only freed a few years ago when it was revealed at a post-conviction hearing that
the main witness at his trial had told the prosecutor that he was pressured by police to lie about Collins’ involvement in the murder.
The prosecutor, representing the Brooklyn District Attorney’s office, never shared that information with Collins’ lawyer—
an egregious violation of the law,
which requires the government to inform the defense of any exculpatory evidence.
At the hearing, the judge who tossed out Collins’ conviction called the conduct of the prosecutor and the DA’s office “shameful” and a “tragedy.”
The Collins case turned out to be the tip of the iceberg.
Soon many other wrongful convictions, orchestrated by other Brooklyn prosecutors, began to surface.

RALEIGH (WTVD) -- A Raleigh police detective who attorneys say planted fake heroin on Black men, resulting in their arrests, is out of a job.

Back in September, attorneys for a group of men who said they were wrongfully arrested for heroin trafficking announced a $2 million settlement with the City of Raleigh (https://abc11.com/raleigh-police-fake-drug-arrests-lorrin-freeman-lawsuit/11064779/) as part of a federal civil rights lawsuit associated with Abdullah.
"I think for advocates, we've always wanted this," police reform advocate Kimberly Muktarian told ABC11 on Monday. "This is something we dreamt of. So for them, I still believe that -- this is not a reality that they commonly see."
Abdullah was paying a confidential informant (https://abc11.com/omar-abdullah-kimberly-muktarian-raleigh-police-department/6416588/) who promised to tip-off officers to Raleigh heroin dealers. Instead, the district attorney said the informant returned with videos and audio recordings of drug buys with critical clips missing and a substance that lab tests revealed months later wasn't drugs at all.
The civil rights lawsuit said fake heroin was also planted by detective Abdullah with the knowledge of other officers.
The attorneys said wrongful prosecutions caused those who were arrested to spend roughly a combined 2.5 years in jail before the charges were dismissed.
Robin Mills' son, Marcus Van Irvin, was arrested by Abdullah for bogus heroin and initially put in jail on a $450,000 bond.
Mills is frustrated with the lack of transparent answers about how this happened and wants to know why more officers haven't been held accountable.
She said Abdullah's firing and the civil settlement aren't enough.
"They did what they needed to do from a civil perspective. But now we're talking about criminal," she said. "And there's no way the kidnapping of over a dozen black men is not criminal."
Abdullah was placed on leave from Raleigh Police Department last year but Wake County District Attorney Lorrin Freeman has declined to prosecute him.
As for where the case currently stands, in a statement to ABC11 on Monday she said, "The matter remains open with our office."

A South Carolina city is paying $650,000 to a Black man who was stomped in the head by a white police officer upset that the man could not quickly lie flat on his stomach because of rods and pins in his leg.
Gailyard was walking with a stick wrapped in shiny tape on July 26 when someone mistook the reflective object for a gun and called 911, investigators said.
Orangeburg Public Safety Officer David Lance Dukes ordered Gailyard to the ground and when the 58-year-old didn't immediately drop, the officer stomped on his head and neck, causing his forehead to hit the concrete of the parking lot, according to police body camera video.
Gailyard said he moved slowly and often walks with a cane because of pins and rods in his leg from being hit by a vehicle while riding a bicycle. He also said he was carrying the stick to protect himself from potential dog attacks.

FBI document shows what data can be obtained from encrypted messaging apps
A recently discovered FBI training document shows that US law enforcement can
gain limited access to the content of encrypted messages from secure messaging services like iMessage, Line, and WhatsApp,
but not to messages sent via Signal, Telegram, Threema, Viber, WeChat, or Wickr.

training advice for what kind of data agents can obtain from the operators of encrypted messaging services and the legal processes they have to go through.
Dated to January 7, 2021, the document doesn’t include any new information but does a good job at providing an up-to-date summary of what type of information the FBI can currently obtain from each of the listed services.

A judge told a 72-year-old man who has cancer that he 'should be ashamed' of himself after he said he was too weak to keep up with his lawn.
A Michigan judge berated a 72-year-old man on Monday after he told her he had failed to keep up with the maintenance of his yard because his cancer treatments made him very weak.
In a video of the exchange, Burhan Chowdhury, of Hamtramck, Michigan, can be heard struggling to breathe as he explained his situation to 31st District Judge Alexis G. Krot.
"You should be ashamed of yourself," Krot could be heard saying in the video. "If I could give you jail time on this, I would."
She then issued him a $100 fine, adding: "You've got to get that cleaned up. That is totally inappropriate."
The man's son, Shibbir Chowdhury, 33, who appeared with his father for the Zoom hearing, spoke up to clarify that his father was sick and that the property had already been cleaned up.
"Do you see that photo?" Krot asked. "That is shameful. Shameful. The neighbors should not have to look at that."
Krot was appointed by then-Michigan Gov. Rick Snyder in August 2016 and elected in November 2018. As a judge, she is unable to comment on the case, WDIV reported.

The "suspect" did not live at the address, nor was he named in the warrant. He had a valid concealed carry permit when the no-knock raid commenced.
He wasn't in fact a suspect. He didn't even have time to sit up. What about his 2nd and 4th Amendment rights?
I'm not posting it here, but the body cam footage has been released. Looks like MPD fucked up and lied about it.
