Gardner isnt acting like he knows he’s done. This is why I think McConnell waits until after Election Day. It’s an election carrot that’s dangling as long as the seat is open. If they get a replacement seated before Election Day a chunk of evangelicals think it’s mission accomplished no matter who wins.
Keep in mind, race probably won’t be decided until a few days after Election Day at the least. McConnell could easily hold a vote the day after Election Day before the race is decided but after all the ballots were cast.

Each side gets their eight-year window.

I'd be OK with that over what we have now (stacking the court I think requires the house and senate though, i know you just need the senate to fill vacancies but isn't adding judges actual legislation the house would need to pass?).
If the status quo gets blown up and each party starts doing things like stacking the court or admitting new states every time it gets power that makes it so we would need a large scale constitutional amendment to fix what would be unprecedented chaos in DC. The unwritten rules of decency both parties played by to ensure constitutional loopholes and flaws didn't bring the country to its knees went out the window in 2009 after black president was given a mandate by voters, so as you said this is a hand that's been forced for some time.

The problems they had in 2010 and 2014 midterms were 80% driven by bad voter turnout (minorities and millennials) which they wouldn’t have in 2024. They had the same bad senate map in 2012 but managed to somehow gain seats when everyone thought they’d lose the senate.
Regarding Arizona - by 2024 it will have 4 more years of Mexicans pumping out kids (and the Democrats finally have grassroots movements on ground getting Hispanics registered), more millennials/Gen Zers moving from California, and more old white conservatives dying off. There’s a legal marijuana initiative on the ballot in AZ this year that’s even likely to pass. Sinema isn’t a re-election lock or anything but it’s only a matter of when Arizona becomes the next Colorado/New Mexico.

The problems they had in 2010 and 2014 midterms were 80% driven by bad voter turnout (minorities and millennials) which they wouldn’t have in 2024. They had the same bad senate map in 2012 but managed to somehow gain seats when everyone thought they’d lose the senate.
Regarding Arizona - by 2024 it will have 4 more years of Mexicans pumping out kids (and the Democrats finally have grassroots movements on ground getting Hispanics registered), more millennials/Gen Zers moving from California, and more old white conservatives dying off. There’s a legal marijuana initiative on the ballot in AZ this year that’s even likely to pass. Sinema isn’t a re-election lock or anything but it’s only a matter of when Arizona becomes the next Colorado/New Mexico.

The three of them have all pledged to “never” nuke the filibuster, and those pledges all came after the 2018 election so they weren’t under political pressure or anything. Chances are 1 or 2 of them could flip flop if McConnell and Trump over play their hand here but would be surprised if all 3 of them did. This is why the less likely senate races in states like Iowa and Montana are important. I don’t think the Dems are able to nuke the filibuster with only 50-51 senators (even if Schumer wants to) but if they clean up and have 53-54 seats it’s a lot more likely.

Chuck Grassley and Mitt Romney are the wild cards IMO. Grassley has some semblance of integrity and this might be his last last term. Only hope with Romney is that he pulls a McCain and just wants to stick it to Trump.
I think Murkowski is a no vote either way, while Collins is a no vote before the election and a yes vote during a lame duck session.

Still think holding a vote as soon as possible after November 3rd is the best strategy for Trump/McConnell, but can't wait too long since McSally could lose her seat in November. This ensures the evangelicals are energized going into election day while Collins & Gardner become surefire yes votes as oppose to maybes.

romney definitely seems like the type who would keep his word but i dont know that he was ever on the record about this issue. im not even sure collins is a no vote. might be concerned but vote yes

Collins issued a statement today saying she "doesn't think" the senate should try to confirm someone prior to the election, but you're right she could just be concerned. She might even be concerned enough to write a sternly worded letter only to vote yes and then say she thinks Trump learned his lesson.
Romney has never spoken publicly on the issue, it's just assumed he's not a complete rubber stamp.
Grassley has said he "doesn't think it's a good idea" to appoint a SCOTUS judge in an election year but wasn't committal.
Dark horse candidate is Lamar Alexander. Retiring senator who doesn't like Trump. Don't think that has a chance at happening but it's possible.

Harry Reid's rule change was in 2013, three years before Graham announced he would never confirm a justice in an election year. So ultimately his change of heart is based on a SC nominee having a tough confirmation hearing.
Again, why don't these cowards just say, "Our majority, our rules" and quit trying to fabricate some weak moral justification?
