The best political move for Dems seems to be to let Republicans do what they will with the new justice and just hammer the message home that the Senate is spending all of their time on an unpopular SCOTUS confirmation instead of a new stimulus package. Any impeachment carries more political risk than it's worth, IMO.What penalty, if any, did the Dems pay for last one?

I honestly wonder if Trump and Congress would have stacked the court in 2017 if this scenario happened.
Not that it's an argument against it.
That requires nixing the filibuster altogether, which I don't think McConnell would have done to stack the courts when he still had a SCOTUS majority (even if Ginsberg and Breyer step down in 2013, McConnell is blocking Garland in 2016 and keeping the conservative majority). The filibuster is always going to help the party that wants to keep the status quo over the party that wants reform/change, which conservatives aren't going to nuke it just to expand a SCOTUS majority. For all the MAGAtard talk about how John Roberts is :cry really a liberal :cry, he's the most conservative swing vote the court has had since pre great depression, not something McConnell would nix the filibuster to change.

it's been reported that Senate rules require impeachments to be taken up before nominations can go forward; if true, that's a tool in the box.
Honestly I didn't know that, might have been a detail worth noting :lol

It's just a guess, but Republicans have already seeded the message that Democrat impeachment hearings are a stalling tactic to progress, including progress towards stimulating the economy and helping small businesses survive the pandemic.
Another impeachment gifts the GOP that message again and gives them an out on delaying stimulus to hypocritically ram through a SCOTUS judge less than two months before an election. The GOP message now becomes "Dems doing another impeachment instead of helping the economy."

wouldnt they be able to vote to change the rules if they really wanted to?

you’re trying to semantic and anecdote this argument. I don’t know how old you are, but it shouldn’t require this explanation.
i don’t care about Hillary. This is a long standing issue. Folks complain about the shift to the right. It didn’t happen in a vacuum. It took a long time to get there.
too many god damned lefty’s have sat out for decades, and let this happen. The pubs figured out a long time ago they have no ability to govern. They don’t. Their mission was, is, and will continue to be, to destroy the apparatus.
too many liberals have sat back, and continued to observe norms that no longer exist, choosing to moralize and lament and false equivalence their way into absolving themselves of responsibility to take their country back.
it doesn’t pay at all to be the adults in the room any more. Hopefully, the people that fall under the giant umbrella that is the Democratic Party May finally comprehend that, even though it’s too late and you have fucked over all women poc’s and lgbtq persons for the next generation.
:lol you still keep lecturing me as if I'm personally responsible. I'd bet my life you're a boomer the way you get off on sanctimoniously yelling at random millennials about how they ruined everything.
Voter turnout is a two way street, you assume the horseshit premise the candidate and his/her party and has absolutely no duty to drive voter turnout and that voters should just be expected to turn out in high numbers. Most of the young progressives you're autistically screeching about couldn't even vote prior to 2008. Is it their fault Kerry and Gore lost?
I agree the shift to the right happened gradually over 40 years. During that time, the Democratic Party did nothing but cave on ideals, sell itself to the highest bidder and watch as Republicans outsmarted them at every turn. No grassroots movement at the local level. Liberals sitting out and not voting in elections wasn't the cause of the country's shift to the right, it was the effect. When the party ran good candidates who even pretended to be progressive, they got turnout. When the party ran shitty candidates who focused their entire campaign on trying to win moderate Republicans, progressives didn't turn out. Biden I actually think is running on a relatively progressive platform but he could be doing a better job advertising it.
Liberal progressives didn't choose to sit on the sidelines, the Democratic Party moved them to the sidelines. You seem to think they owe whoever the candidate with a D next to his/her name a vote but that's never going to happen and no amount of internet vote shaming is going to change that.

IMO they should make McConnell have to change as many rules as possible so red state senators like Manchin/Tester can more easily justify supporting the nuclear option. The goal should be to stop the seat from getting filled, and the consolation prize should be enough political capital to nix the filibuster if they can.
The other possibility is boycotting the hearings. Getting 51 senators for a roll call could be challenging with 47 senators boycotting and 20 more having to split time between DC and their home state in the last month of a campaign.

When McConnell releases a statement about moving forward with a nomination literally the same night RBG dies, it makes me think he's trying to bait the Democrats into something. McConnell is usually more sneaky and cunning, his press release on Friday had more of a direct "suck my dick, liberals" tone to it.
The fact Trump is waiting a week to announce his nominee makes me wonder more if they have a political agenda beyond just ramming a judge through as quickly as possible. There's a very short list of female federalist society SCOTUS candidates, it doesn't take a full week to pick one.

McConnell and Trump would love nothing more than another 2004 election where social wedge issues overshadowed stagnant wages and growing wealth inequality. SCOTUS ruled on gay marriage over 7 years ago, and even with another Trump appointee that ruling isn't going to be reversed. Outside of the really extreme ones like Tom Cotton, Republicans don't even talk about gay marriage anymore. Getting a confirmation vote done before election day is an omelette they won't be able to make without cracking a lot of eggs :lol. The Democrats will inevitably find some ways to slow down the vetting process, the speed with which Trump picked a nominee was something the Democrats have no control over. And they're not going to stop voting Democrat anytime soon. Sorry, I'm not going to get guilt tripped by the false premise woke, PC-obsessed liberals love that anyone who doesn't endorse constantly talking about and highlighting gay marriage as an important issue must hate gay people and doesn't care about LGBT rights.
Said woman's rights issue has also been settled by the courts at the federal level since the 70s. The best way to protect Roe v. Wade is winning in the senate and controlling court appointments, while also focusing on election reform. The only reason Republicans talk about abortion is the electoral college and a backwards 2 senators per state structure. If the presidency was a simple popular vote abortion would be a settled issue in this country - Republicans wouldn't be able to ignore the large population centers where a huge majority is pro choice.
Regarding "civil rights" I'm not sure what you're talking about but right now one of the biggest civil rights attacks going on is voter suppression and I said that should be a SCOTUS hearing topic.

Regarding "civil rights" I'm not sure what you're talking about but right now one of the biggest civil rights attacks going on is voter suppression and I said that should be a SCOTUS hearing topic.
of course they can do like progressive’s and not vote.
And they’ve already attacked choice, that hasn’t been settled. and they have definitely attacked civil rights

I wouldn't say I'm glad this happened but I see a lot of positives that could come from it. There's now more political pressure than ever before on the Senate Dems to nix the filibuster if they get the majority, and Schumer is more scared of political opponents to his left than his right.

Democrats will always have a handicap in the Senate. Just by how States are represented, which has nothing to do with actual population numbers. That, by extension, means they'll have a handicap when it comes to the SCOTUS.
Then again, Republicans have a major popularity problem. At some point, there's only so much gerrymandering and voter suppression you can pull off.

There's now a pretty solid explanation for what happened in the polls in 2016, and most of the highly rated pollsters corrected for it. Prior to 2016, white people generally voted Democrat/Republican at around same percentages regardless of education, so the fact that educated whites respond to polls with higher frequency than uneducated whites never mattered. The pollsters in 2016 weighted their sample by race instead of race & education, without realizing the Trump effect of college educated whites voting more Democrat and uneducated whites voting more Republican. There are still some lower quality pollsters not weighing for education but the top pollsters like Monmouth University are now weighing by education.
Pollsters still can't really account for what turnout levels will be and groups like hispanics are still really hard to poll so it's not like Trump can't win, but the polling issues from 2016 have largely been corrected.

RBG deserves blame because she ignored reality by risking her seat. Outside of when they unexpectedly die (i.e., Scalia), conservative judges make sure their replacement is picked by a conservative president. The Courts are now littered with hundreds of Federalist Society clones who are all of the belief that ensuring conservative politicians control the courts is important. There's not a chance Alito, Gorsuch, Kavanaugh, or even Roberts (all 4 being Federalist Society members since they were in law school) are going to ever retire with a Democrat in the White House or even risk that they're still on the bench and die with a Dem in the white house. If Ginsburg was so concerned with protecting reproductive rights, she would have made sure Obama picked her replacement knowing that the other side of the aisle had judges who put their ideals before themselves.

How many landslide polls did you see in 2016? Then they tighten them up at the end and cry about margin of error.
It's all done to control the enemy's momentum. They use the same script every time.

In this cycle, look at the polls from Fox and Reuters which always has democrats killing sh1t. They do not poll enough of these so called independents. Fox will poll 5% and Reuters like 10%. These are the same folks who decided the election in 2016 so it's a good idea to find them. But if they are 'shy' Trump voters they will never find them as they wont talk to pollsters, even at gunpoint.
Other pollsters do poll more independents and they are weighted overall as Will points out. But when you see somebody like Fox only polling 5% independents you can pretty much throw it in the trash. Since they over sample Dems in these polls(and rightfully so since they always come out in larger numbers) they basically talked to a bunch of democrats and determined Trump is down 20 points :lol

29 times in American history there was an open Supreme Court vacancy in a presidential election year.
All 29 times the President made a nomination

This election also has 1980 potential, when it looks like a winnable race for both candidates until the last 2 weeks when all the undecideds turn against an incumbent for handling a crisis horribly (and Carter's crisis killed A LOT less people than Trump's did). Things are more partisan now so it's not going to be identical to 1980 when Carter won <10 states, but if undecideds break from Trump there's potential for Biden to win the popular vote by 10+% and 375+ electoral colleges.
Same reason I think there's a broader universe of senate races in play - in 1980 there were a lot of longtime incumbents who wouldn't have been vulnerable any other year.

Obama won Iowa by 5+% each time despite being considered an "elitist" who'd have nothing in common with an Iowa farmer; I know he campaigned there aggressively and had a great ground game but it's not like that would make a difference in Mississippi :lol. Tom Harkin also survived there for 5 terms despite being pro-choice and pro-gay marriage. IMO it's not a state Democrats should abandon.

There are always going to be pockets of Dems there, particularly in the college towns and Des Moines.
Iowa used to be a place to live because of the quality of education, and decent areas to raise kids in. They’ve destroyed much of the Ed framework, and it’s as dying State.
too much of it is a lot like Texas. Purple to blue cities, and vast expanse of bible thumping racist women and gay hating rednecks.
the representation at the state level reflects far far more of that, than the pockets of urbanization.

Barrett met with Trump at the White House on Monday, said a person familiar with the discussion. She is a favorite of anti-abortion rights advocates, who are heavily lobbying the White House and Trump personally to nominate her. She’s preferred by Senate Majority Leader Mitch McConnell, according to people close to him.
And her supporters have pointed out to the White House that as a Midwestern Catholic, Barrett may help the president secure votes for his re-election in vital Rust Belt and Great Lakes states where he currently trails Democratic candidate Joe Biden.

I think if we get another 2009-2010 where the Democrats get nothing done beyond passing the same garbage 1990's GOP garbage legislation, you're going to see a civil war within the party.

Bare minimum should be Puerto Rico as a state and DC split into two states, all in time for the 2022 midterms should they get the house, senate, and presidency.

At a minimum, a 6-3 SCOTUS majority guarantees Obamacare is upended. At that point the Democrats will have no way to protect the tens of millions of uninsured Americans without nuking the filibuster and stacking the courts. I think even Old Joe knows that if he can't even keep Obamacare intact his presidency will be a failure.
IMO when Obama called the filibuster a Jim Crow relic during his rally in Selma, that was his not-so-subtle way of telling Biden and the other establishment Democrats times are quickly changing.

True. I guess I think of the court first because ACA is done. With a 6-3 advantage, it’s all but dead now.
Thete is a lot to be done after hopefully we get the senate and pres. Jesus just thinking about all of this depresses me.

Puerto Rico has 5-6x as many people as Wyoming. Make that 3 states and DC 2 states. 10 new senators. Still not as disproportionately represented as Wyoming is.

All of this is on top of cleaning up the COVID-19 mess Trump leaves the country in.
It feels like the cycle repeats itself. Trump and GWB both leave a heaping pile of shit for their Democrat replacement to clean up, which makes it impossible to get anything else done. Then by the time the Democrats finally has the economy turned around, they lose the white house and the new Republican takes credit for the good economy he inherited.
Diane Feinstein is at the top of the list in 2024. That rich whore does nothing but shit all over progressive legislation and she's in the bluest state in the country.
She disgusts me. Thankfully there is no way she runs again. Bitch is nearly 90 years old.
This is exactly the reason why Democrats will absolutely, no doubt in my mind have to do something about this. I know this is the party that likes to bend the fuck over but at some point you have to quit been bitches.

They finally have pressure from the left, which they didn't have at all in 2009 when everyone thought they were the left. AOC is going to be 100x more loud and obnoxious than she already is if Democrats take control and just continue with austerity for the poor and socialism for the rich. Schumer knows his ass is getting primaried in 2022 if he can't find a way around McConnell's obstructionism, which is why he's pushing to nuke the filibuster.

You can't kick a state out of the union or split it up without said state's consent. That would be unconstitutional.
For a party that calls itself purist/originalist you retards really don't understand how the constitution works.
