Harry Reid's rule change was in 2013, three years before Graham announced he would never confirm a justice in an election year. So ultimately his change of heart is based on a SC nominee having a tough confirmation hearing.
Again, why don't these cowards just say, "Our majority, our rules" and quit trying to fabricate some weak moral justification?
Nobody cares about War Machine Graham's BS.
As it is, Dems and Repubs horse traded in 2016 and it is what it is. Dems got played like the bitches they are.

Graham also re-announced he would not vote to confirm a SCOTUS pick in an election year on October 3, 2018 (link below). Kavanaugh hearings were almost completely over by then, he was confirmed less than a week later. His tweet is completely incoherent, he re-committed to not confirming a SCOTUS pick in an election year after both of these events he claims to be so flamboyantly offended by :lol

Collins issued a statement today saying she "doesn't think" the senate should try to confirm someone prior to the election, but you're right she could just be concerned. She might even be concerned enough to write a sternly worded letter only to vote yes and then say she thinks Trump learned his lesson.
Romney has never spoken publicly on the issue, it's just assumed he's not a complete rubber stamp.
Grassley has said he "doesn't think it's a good idea" to appoint a SCOTUS judge in an election year but wasn't committal.
Dark horse candidate is Lamar Alexander. Retiring senator who doesn't like Trump. Don't think that has a chance at happening but it's possible.
considering graham walked back his very committal statement without issue, i think its a near certainty that grassley toes the line

I'm not sure why they're coming up with stupid rationalizations that make them look like hypocrites. If McConnell just kept saying all along "We're the majority so we're ramming our judges through when we can, we're also stopping the other side's judges. Sorry Dems but jokes on you for not showing up to vote in midterm elections" they wouldn't lose any supporters over it and swing voters who rarely pay attention to politics wouldn't either. All it does is put senators in blue/purple states in more precarious positions when they use shitty justifications.

Who is the one assuming in this post that the word Jamaican means "black"? Our motto is "Out of Many One People" - you guys could learn something about different people living together in relative peace - and yes, the black Jamaicans are poor and descendants of slaves too but they do not blame me or any other non-black for whatever went on hundreds of years ago. We do not see each other through the lens of race the way you do - my mother's brother is married to a woman as black as Lebron, and it's nothing that unusual in Jamaica.
And no - I am full Chinese and full Jamaican. I consider myself a Jamaican Chinese. Jamaican first - because I think like a Westerner (and believe me, I know the difference with a very old-fashioned, traditional father from China) and Chinese last because I only look (and eat) like one. I don't speak the language. I don't follow their traditions where children (sons being all important) are concerned. I've never even been to China.
Everyone is entitled to his own opinion, but you guys go on and on and bicker like crazy. And please don't tell me what I should be doing - I don't see you jumping to my defense when I get attacked for no reason.

The senate also voted 80-15 to confirm her for the COA. Barrett was confirmed with a 55-43 vote. Lagoa got wide bipartisan support.
Definitely the much savvier political move, a Florida Cuban who previously got wide bipartisan senate support, but you run the risk of her moving to the left once she's on the court. Barrett is a surefire Alito clone who's guaranteed to want to overturn Roe, but nominating Barrett is much easier for liberals to paint as extreme. Democrats would need to walk a tightrope in how they handle Lagoa.

FTR, the scenario of "what happens when the Republicans get control back and don't need 60 votes either!" is a risk Democrats should be willing to take. If Trump had 2 years to pass legislation with no filibuster 20% of the country would be living in Hoovervilles right now but Trump would have an approval rating in the 20s. All the filibuster does is make it so less Americans can see how the Republican Party is screwing them.

They're worried that Trump is up on election night in key rust belt states that don't start counting mail-in ballots until election day and finds a way to make it so mail-in ballots stop getting counted, so they want to make it so Biden is winning in Florida on election night. North Carolina is already rejecting 5% of black mail-in ballots (vs 1% of white mail-in ballots). I think we’re going to see record black turnout tho, the black people I know in DC are spitting mad about the voter suppression shit.

Do like people in Virginia and actually show up to vote. Record high early voting in person going on over there.
For one, the postal service cannot be trusted so you have to bite the bullet. I'm voting in person myself.
Not that my vote matters but I'm willing to COVID it up and vote than send it through the mail.

Your vote absolutely matters. If Trump tries to contest the election him having a big popular vote deficit definitely helps make him look ridiculous.

The Top Contender for RBG’s Seat Has a Fundamentally Cruel Vision of the Law
Here’s what we can expect if Trump fills the late justice’s seat.
The consensus (https://www.washingtonpost.com/politics/2020/09/19/who-trump-might-pick-ruth-bader-ginsburg-replacement/) among legal (https://www.usatoday.com/story/news/politics/2020/09/18/replacing-ruth-bader-ginsburg-list-starts-amy-coney-barrett/2669382002/) and political (https://www.bloomberg.com/news/articles/2020-09-19/amy-coney-barrett-emerges-as-frontrunner-for-trump-court-pick) analysts (https://www.reuters.com/article/us-usa-court-nomination-factbox/how-trump-could-replace-ruth-bader-ginsburg-on-supreme-court-even-before-election-idUSKBN26A071) is that Judge Amy Coney Barrett, whom Trump placed on a federal appeals court in 2017, is the leading candidate to fill Ginsburg’s seat.
During her three years on the 7th Circuit Court of Appeals, Barrett has either written or joined a remarkable number of opinions that harm unpopular and powerless individuals who rely on the judiciary to safeguard their rights.
Faced with two plausible readings of a law, fact, or precedent,
Barrett always seems to choose the harsher, stingier interpretation.
Can job applicants sue employers
whose policies have a disproportionately deleterious impact on older people? Barrett said no (http://hr.cch.com/ELD/KleberCareFusion012319.pdf).
Should courts halt the deportation of an immigrant who faced torture at home? Barrett said no (https://cases.justia.com/federal/appellate-courts/ca7/17-2920/17-2920-2018-08-28.pdf?ts=1535493617).
Should they protect refugees denied asylum on the basis of xenophobic prejudice? Barrett said no (https://cases.justia.com/federal/appellate-courts/ca7/17-2920/17-2920-2018-08-28.pdf?ts=1535493617).
Should they shield prisoners from unjustified violence by correctional officers? Barrett said no (http://media.ca7.uscourts.gov/cgi-bin/rssExec.pl?Submit=Display&Path=Y2019/D07-29/C:17-2295:J:Rovner:aut:T:fnOp:N:2375824:S:0).
Should minors be allowed to terminate a pregnancy without telling their parents if a judge has found that they’re mature enough to make the decision? Barrett said no (https://www.courthousenews.com/wp-content/uploads/2019/11/Abortion.pdf).
Should women be permitted to obtain an abortion upon discovering a severe fetal abnormality? Barrett said no (http://media.ca7.uscourts.gov/cgi-bin/rssExec.pl?Submit=Display&Path=Y2018/D06-25/C:17-3163:J:PerCuriam:aut:T:npDp:N:2176287:S:0).
Barrett would cast the fifth vote to either hollow out Roe v. Wade or overturn it altogether. Similarly, there is no doubt that
Barrett would dramatically expand the Second Amendment, invalidating gun control measures around the country.
It’s quite possible, perhaps even likely, that within a year of her confirmation,
Americans will be forbidden from terminating a pregnancy in 21 states (https://www.guttmacher.org/state-policy/explore/abortion-policy-absence-roe)—
but permitted to purchase assault weapons (https://giffords.org/lawcenter/gun-laws/policy-areas/hardware-ammunition/assault-weapons/#:~:text=Seven%20states%20and%20the%20District,of% 20Columbia%20prohibit%20assault%20weapons.) and carry firearms in public (https://www.mic.com/articles/130029/which-states-allow-concealed-carry-this-map-shows-who-can-legally-carry-a-gun-and-where#:~:text=%22May%20issue%22%20states%3A%20The, New%20York%20and%20Rhode%20Island.) in every state.
Abortion and guns, however, are just the beginning
the Supreme Court will eradicate the entire Affordable Care Act in 2021, stripping health insurance from more than 20 million people.
Barrett has criticized (https://civilrights.org/resource/oppose-confirmation-amy-barrett/#_ftn13) Roberts’ 2012 opinion (https://www.supremecourt.gov/opinions/11pdf/11-393c3a2.pdf) saving the law, suggesting she would join the other four conservatives to destroy it root and branch.
Barrett and her conservative colleagues would also take a machete to the thicket of laws that protect the health and safety of millions of Americans.

Experts:
Trump and McConnell have to jump through 4 hoops to seat a Supreme Court justice
in just 6 weeks
Step 1: The presidential pick
The first thing to know is that the Constitution of the United States gives the power of nomination to the president.
Article II, section 2 (https://constitutioncenter.org/interactive-constitution/article/article-ii) provides that the president “shall nominate, and by and with the advice and consent of the Senate, shall appoint … judges of the Supreme Court.”
Things can get tricky somewhere between nomination and confirmation. But changes made in the Senate – in particular, the rule change in 2017 that allows a Supreme Court Justice to be
confirmed with 51 votes (https://www.nytimes.com/2020/09/19/us/politics/mitch-mcconnell-trump-supreme-court.html?action=click&module=Spotlight&pgtype=Homepage)
, instead of 60 – are likely to smooth the way considerably.
Step 2: The Senate Judiciary Committee
The Judiciary Committee currently has 22 members (https://www.judiciary.senate.gov/about/members) – 12 Republicans and 10 Democrats – and has a three-step process (http://fpc.state.gov/documents/organization/50146.pdf) of its own.
First, it conducts an investigation into the nominee’s background.
Second, the committee holds a public hearing, in which the nominee is questioned and may give testimony about everything from her judicial philosophy to her stand on abortion.
Finally, the committee will report its recommendation to the full Senate as either favorable, negative, or no recommendation.
Step 3: The full Senate
the Senate is majority Republican (https://en.wikipedia.org/wiki/List_of_current_United_States_Senators), with 53 Republicans, 45 Democrats and two Independents, who both caucus with the Democrats.
closing debate on the motion so that the Senate could move on to a vote no longer requires a supermajority of 60 votes, just a bare 51-Senator majority.
the Democrats can insist on a minimum of 30 hours of debate, and then, they will be out of options to delay or stop a confirmation vote.
Step 4: The vote
The vote to confirm requires a simple majority (http://fpc.state.gov/documents/organization/50146.pdf) of the senators present and voting.
it will be a first. The only time there has been a Senate vote on a Supreme Court nominee in an election year was
in 1916, when Chief Justice Charles Evans Hughes resigned from the Court to run for president (https://www.nytimes.com/2020/09/19/us/politics/supreme-court-trump.html).
And that was 150 days before the election.

Maybe, but fortunately Arizona is a special election to serve out McCain's term, so Kelly would take Mcsally's seat in November. Hopefully Kelly & Collins would cancel each other out.
This might be overly optimistic but if we got to a point where McConnell is trying to ram a judge through even though it's clear Biden won, senators like Pat Toomey theoretically start thinking about 2022.

Mitt is pro life though. It's a question of whether another pro life judge or being able to fuck Trump is more important to him.
Wherever the hell he is Chuck Grassley might be too incapacitated to vote so Romney would give the Dems a 50-49 vote :lol
Him been pro life shouldn’t affect his delay of vote until after the election. If being pro life is all it takes for you to drop all pretenses of caring about norms, you’re just another shitheel worried about special interest.

I would not be getting anyone’s hopes up - banking on Republicans to grow a conscience-
Dems are fucking idiots if they legitimize this theft - as they did when Moscow Mitch stole the Merrick G seat
The SCOTUS is already illegitimate since that theft and playing along now and trying to appeal to other thieves is just idiotic.
Dems should just say- “the current SCOTUS is illegit and further thievery only makes it more illegitimate - we will not be a party to this and refuse to legitimize these SC thefts”
and then boycott any hearings and let the republicans do it all on their own.
The media is just as complicit by their breathless proclamations of “who will Trump choose?”
Instead of standing up when they see the GOP stealing our Democracy.

Theoretically there should be enough NOs to kill whatever chances a potential nominee has given that there are quite a few endangered republicans that a yes vote would potentially kill their chances at re-election.

In the case of Collins, it appears she is finished anyhow as I can't recall the last time she was ahead in any polls, which seem to be pretty accurate for senate races. And it still would have been a win for Republicans. They would have effectively replaced Scalia with a Federalist Society shill who rules the same way Scalia does, while the Democrats would have replaced the most liberal judge on the bench with a moderate. Swapping RBG & Scalia for Garland & Kavanaugh would have still been an overall shift to the right.

I’m worried about the impact it would have on the election. If Trump gets re-elected then by all means bury him under a mountain of impeachments.
Right now an impeachment distracts voters from the 200k Americans killed by Trump’s negligence and the little healthcare protections Americans have getting wiped away by Trump’s Supreme Court.

If the Dems prove unwilling to use the power they have to protect their consitutuents, what are they good for? Continuing to lose while complaining about mean Republicans is a losing strategy, imo.

Not sure if posted ITT yet but Trump said he's not announcing his pick until Friday or Saturday, which is really surprising. The vetting process then doesn't start until September 28th - it would be a really tall task to get fully through the confirmation process in the 36 days between when vetting would start and election day. It seems like they're either gunning for a lame duck session vote or they have a political agenda.
In addition to Graham, Ernst and Thillis are on the judiciary committee. Iowa and North Carolina are probably the two closest and most important senate races in terms of determining the majority, it's going to be a logistical challenge if both incumbents are busy in DC trying to ram a judge through congress instead of in their home state campaigning.

If they lose the election because they shift everyone's focus to an impeachment hearing, it goes from a possibility to a certainty bodily autonomy and voting rights get attacked for the next 4 years.
The last time they impeached Trump it did absolutely nothing to stop him, not sure what makes you think another impeachment would be different. By the time articles of impeachment even got ratified by the house the senate would be finished confirming Trump's nomination and we'd probably be past election day.

of course there’s a political agenda. The r’s are soulless valueless party that has nothing to offer in the way of legislation. They’ve managed to show no concern over killing 200000 people.
There’s a real bereft of energy in their base right now. Pissing off libs isn’t enough when you have no job, and are getting evicted. It matters to a lot of them, Not the pieces of shit here like ducks and spurtacular and rmt and the like, but slowly but surely people are figuring out what a pile of shit the party of trump is. That’s why races that shouldn’t be close are ones they’re spending money on.
this is about turning out their base. Then let the suppression do the rest.

Packing the court if they gain control of the Senate is simply the threat they have to use to get the GOP to hold off until after the election.
I would fully back such an effort. GOP wants bare knuckle bullshit when they have control of the Senate, then they need to live with the consequences of overriding the minority, when they are the minority.
Our schlorotic government will get worse, and less will be done in the future if the fascist party ever regains control of either part of the legislative.

You could be right but I have a hard time believing this energizes their base that much more. The GOP (to its credit) does a great job making sure its base is energized 24/7/365, the evangelicals were already of the mindset that they were going to crawl through shards of glass to vote for Trump. RBG was also never going to make it another 4 years, so her seat was already on the ballot this year before she died.
I know the conventional wisdom from 2018 is that the Kavanaugh confirmation energized the base and lost Democrats senate seats in Missouri, Florida & Indiana but those seats were going to be tough no matter what. You also need election carrots more in midterm elections when your party controls the white house.

I'm all for making that threat but if they get the white house and a senate majority, they need to nuke the filibuster no matter how this SCOTUS nomination plays out, and once that happens they should stack the court either way since you can bet your ass it's what the GOP would do in a situation where they had full control and no filibuster (McConnell effectively reduced SCOTUS from 9 to 8 for a full year, so I'm not sure how that's any different than stacking the court). I don't want to see Schumer get mindfucked by Mitch where he agrees to keep the filibuster in place n exchange for Mitch leaving the seat alone.

Trump said it's down to "four or five" candidates, but I've gotta think it's just Lagoa and that bible bitch. Not even Trump could get away with nominating a man after just saying it would be a woman.
Does anyone know Lagoa's track record on abortion? Biblebitch is clearly pro life, but don't know much about Lagoa.

It might be counterproductive to have an impeachment before the election, it might not. If Biden wins and Dems prevent Trump from appointing another SC justice, it will have been worth it. If he loses, get ready for another 25 years of Trumpist minority. rule
Using power is risky, but not using it is risky too.

They can always produce a raft of indictments against Barr, DeJoy, etc starting late November if the election goes their way. In that case they would have more of a popular mandate to carry through with it.
The reality is that Nancy doesn't have power to wield unless the Senate is under Democrat control too.

Democrats can throw a tantrum but they can't stop it. in the end, RBG herself is to blame for the shit storm that's about to hit them.
Here is RGB in 2016
Asked if the Senate had an obligation to assess Judge Garland’s qualifications, her answer was immediate.
“That’s their job,” she said. “There’s nothing in the Constitution that says the president stops being president in his last year.”

The simple reality is that if McConnell has the votes there is nothing the Democrats can do to stop him from replacing RBG. They need to work to find 4 votes. They already have 2 but I don't trust Collins. Schumer should do everything he can to court Romney, and they should figure out what other senators might budge (i.e., have Boomerberg call Toomey and say this is where you return the favor after I bankrolled your campaign).

2016 was too late but regardless, everyone knew how much of a bloodbath the 2014 midterms were going to be for Democrats so their window of replacing her was predictable. Both RBG and Breyer should have stepped down in 2013 (quite frankly they were already playing with fire and got lucky the Dems kept control of the senate in 2012). That would have given them 4 younger liberal judges with 3 older conservatives (Thomas, Kennedy & Scalia) that would need to be replaced over the next 10 years.
The narrative from people close to her was that RBG was excited about the prospect of Hillary Clinton being the first female president and replacing her. Celebrate RBG for being a "barrier breaker" all you want but it was beyond selfish of her to do what she did.

or, you know, if the “progressive” wing of the Democratic Party would actually show up to vote, and give their representatives cover to actually make those changes.
but then, that would be too inconvenient to go to the polls, when it’s so much easier to try to blame the “establishment”

Fun fact - Hillary's 2016 campaign determined it wasn't a good idea to have Hillary yard signs up in Michigan because they were worried people would be more "motivated" to go out and vote for Trump if they saw Hillary yard signs. Instead of continuing to vote shame someone who votes, maybe consider the possibility that Hillary not getting great turnout from progressives had something to do with her being such a bad candidate that her own campaign was legitimately worried yard signs with her name would have a negative effect on voters :lmao

The best political move for Dems seems to be to let Republicans do what they will with the new justice and just hammer the message home that the Senate is spending all of their time on an unpopular SCOTUS confirmation instead of a new stimulus package. Any impeachment carries more political risk than it's worth, IMO.

i don’t care about Hillary. This is a long standing issue. Folks complain about the shift to the right. It didn’t happen in a vacuum. It took a long time to get there.
too many god damned lefty’s have sat out for decades, and let this happen. The pubs figured out a long time ago they have no ability to govern. They don’t. Their mission was, is, and will continue to be, to destroy the apparatus.
too many liberals have sat back, and continued to observe norms that no longer exist, choosing to moralize and lament and false equivalence their way into absolving themselves of responsibility to take their country back.
it doesn’t pay at all to be the adults in the room any more. Hopefully, the people that fall under the giant umbrella that is the Democratic Party May finally comprehend that, even though it’s too late and you have fucked over all women poc’s and lgbtq persons for the next generation.
