so as it was before this law, if a 22 year old guy and a 16 year old girl had sex, judges in california had the discretion to reduce penalties based on the cir stances (was it consensual, forcible, were they in a relationship, etc). however, the way the law was written, that discretion was only given if it was specifically penis-vagina intercourse. so if it was an identical situation but with a 22 year old girl and a 16 year old girl, or a 22 year old boy and 16 year old boy, they were subjected to different minimum sentencing laws and judges no longer had any discretion.
basically, identical crimes were treated differently solely based on whether or not the acts were heterosexual or sexual.
this law just now made them equal. now you could argue that the way they should have made it equal was just to further punish the hetero ones, rather than giving discretion to the ones, but either way all this law does was make the treatment equal.
Weird, I didn't pick up on that nuance from Mark Dice's description.
