    I’m not paying attention to this particular case, but it seems like forum shopping if you’re asking a federal district court to rule on the same issue that a state Supreme Court just ruled on. A state Supreme Court ruling should be going to SCOTUS for review, not a federal district court.

    yeah they're not seeking review, per se. but they are very clearly forum shopping, and post hoc at that.
