Either way, no defense is needed since Raffensberger recording his own conversations is allowed under Georgia law, DC law and Federal law. It’s not illegal to record a call with Trump just because he’s the president.

I kinda get his frustration. If the only penalty for trying to rig an election is that it doesn’t work, what’s the incentive to not try rigging every single election? They should be issuing subpoenas and scheduling hearings over this, not advancing symbolic gestures.
