    In the 1969 case of Tinker v. Des Moines, the Supreme Court famously held that students in public schools do not “shed their cons utional rights to freedom of speech or expression at the schoolhouse gate.” The Supreme Court did not, however, endorse absolute freedom of expression in the Tinker case. Instead, the Court said that the First Amendment would protect expression only insofar as it does not that “materially disrupt classwork or involve substantial disorder or invasion of the rights of others.”

    In the landmark 1985 case of New Jersey vs. TLO, the Supreme Court held that the Fourth Amendment applies to searches conducted on school grounds. However, the Court also held that schools are not required to get a warrant to search a student. The TLO Court also decided that school officials do not have to meet the usual standard of “probable cause” that is required when the state searches an adult. Rather, schools can search students based on a lower threshold, sometimes referred to “reasonable grounds” or “reasonable su ion.”

    its not my proposal to make it legal for kids to buy guns, its koriwhat's. he claims to believe there should be absolutely no regulation on gun ownership. i'm convinced he doesnt actually believe that. im sure even he would agree that children shouldnt be able to buy guns. but that would require him to rethink his moronic blanket statement of having absolutely no restrictions whatsoever
    The 2A isn't absolute (as ruled in DC vs er). Guns != nukes. I never heard a gun called a nuke or vice versa and pretty sure the Nuclear Nonproliferation Treaty isn't about guns.
    what he really means is there should be some restrictions/regulations on guns. we just differ on where the line is as to what is or isnt an acceptable regulation. but he wont actually admit that because he's a dishonest , or really just hasnt thought this through beyond slogans and talking points

    and yes, dealing with hypothetical outcomes of laws is an important part of making and enforcing laws, so it does come up in my profession. other side argues that the law should be applied in a certain manner, and its my job to figure out if that makes sense. if the law as they want it to be applied would lead to absurd results in other situations, then its a good argument against their position. thats how things work.
    Does it make sense to mention nukes when discussion gun control? You rely on hyperbole and that indicates you're frustrated with the discussion because it's become a canned argument. You know where it's going and so does everyone else on both sides of the argument. Saying "it's not absolute" is fine between two people looking for a resolution. If one of those people though is looking to simply remove a cons utional right bit by bit (fallacy of the beard etc...) then admitting a right isn't absolute is opening the door for "well then where does that right end, where is infringement? Surely you care about kids, right?" as the opposition attempts to tie the deaths of children to people who do not wish to give up their rights instead of the people who did the crime.
    if a state passes a blanket abortion ban, and somebody says "hm, so this is going to force a raped 13 year old girl to carry her pregnancy to term", you cant just brush that off as a stupid hypothetical. because its absolutely what is contemplated by the law as proposed.
    Abortion is a separate issue.

    I actually showed text that clearly states, and I quote, children do not "shed their cons utional rights to freedom of speech or expression at the schoolhouse gate", which implies they do posses cons utional rights.

    There are all sorts of permissible regulations on cons utional rights, that apply based on age, location, etc, not just children.

    You can't yell "bomb" on a theater or carry a gun in a gun-free zone or be searched without a warrant in an airport... the BoR doesn't pertain to you then?

    If the nuke argument doesn’t sit right with you I’m ok with the hypothetical of a toddler purchasing a military grade machine gun. It’s the same point being made. Everybody is ok with some infringement despite the language of 2A. Once people admit that we can discuss where that line should be.

    why don’t we allow convicts to have guns on them in their prison cell? The cons ution says shall not be infringed. Doesn’t carve out an explicit exception for people in prison or anything

    They had due process. See how easy it is to show examples without going to nukes? (however showing laws to prove rights are not absolute is faulty reasoning. Laws do not supersede rights, they often trample them though).

    I never said I'd provide you with a SCOTUS link. You showed in your response that rights for adults and rights for children are not the same. Obviously minors don't get 2A rights. Any instance where you see someone say kids have the same cons utionally protected rights as adults will either fail to explain 2A and other amendments that aren't considered for kids, or they will say their rights are curbed or special or those rights are delayed until age 18, or whatever euphemism they can find to avoid saying "no, they don't have those rights as children".

    Children are in different cir stances which requires a different standard to fairly judge and apply the law/right given said cir stance. Like I said nuance is a struggle for you.
