Both are illegal. If you want to argue scale of illegality then Trumps was probably worse. Hillary's was more equivalent to what Petraeus did.
the DOJ didn't think so after investigating, intent was lacking for prosecution.

HRC screwed up badly and paid the price politically, but investigators didn't think they could prove the elements of the crime.

Intent may have been lacking or not proven, but clipping out the exact statement from the report " there is evidence of potential violations of the statutes regarding the handling of classified information". And Comey (FBI) made the call, not the DOJ.

I already said I thought Trumps was more egregious. But ask yourself, does knowing a congressional subpoena is coming for the email server and then hiring professionals to destroy the data on the server qualify as hiding the information?
    you swallowed the lie

the fbi arrived and seized hrc’s computers and they were forensically copied

anything after that - such as bleach bit/hammers/ etc

were propaganda fed to you and you swallowed it all

she never destroyed any evidence because the fbi had already obtained everything they needed and she cooperated with all of it
including sitting and getting grilled by partisan hacks like gowdy for 13 hours

and she answered all their garbage nonsense questions while trump, his criminal spawn, his criminal associates, his pardoned criminal traitors

    all plead the fifth

    but hey

both sides is bad blah blah

Comey couldn't prosecute, he could only make a referral. DOJ decides in any case, and they're not bound by investigating agencies.

You think Condi Rice and Colin Powell should have been prosecuted too?

BTW, if Comey -- a lifelong Republican -- was in the bag for HRC like you're suggesting, why did he announce a criminal probe of her ~ two weeks before the election?

I didn’t read the entire thread, so admittedly I didn’t read where you said “more egregious.” I did read where you posited that Trump was “probably worse,” as if it were questionable.

The FBI investigation on the emails as far as I recall didn’t find that Clinton attempted to destroy evidence. She deleted some of her emails, like everyone does. But was the wiping of the server ever been confirmed? I’ll say this, if they had found that she had the server wiped to try to destroy evidence, I would have had zero problems with them going after her and indicting her. With Trump, everything we know about his case, from the Archives requesting the do ents, his attorneys signing and lying that they returned everything, issuing a subpoena, and then conducting the search and finding the classified he refused to return and finding some of them in his bedroom and office closet instead of the locked room in the basement, it’s pretty undeniable there was criminal intent on his part.

One might have been criminal, but it’s at least questionable. The other is a ing idiot who basically did everything to let everyone know he was proactively breaking the law.

As usual, you are uninformed and are full of .

    From Comey's report:

I have so far used the singular term, “e-mail server,” in describing the referral that began our investigation. It turns out to have been more complicated than that. Secretary Clinton used several different servers and administrators of those servers during her four years at the State Department, and used numerous mobile devices to view and send e-mail on that personal domain. As new servers and equipment were employed, older servers were taken out of service, stored, and decommissioned in various ways. Piecing all of that back together—to gain as full an understanding as possible of the ways in which personal e-mail was used for government work—has been a painstaking undertaking, requiring thousands of hours of effort.

For example, when one of Secretary Clinton’s original personal servers was decommissioned in 2013, the e-mail software was removed. Doing that didn’t remove the e-mail content, but it was like removing the frame from a huge finished jigsaw puzzle and dumping the pieces on the floor. The effect was that millions of e-mail fragments end up unsorted in the server’s unused—or “slack”—space. We searched through all of it to see what was there, and what parts of the puzzle could be put back together.

    From Comey's report:
"As a result, although the Department of Justice makes final decisions on matters like this, we are expressing to Justice our view that no charges are appropriate in this case"

Why do you want to press charges if the FBI, who conducted the extensive investigation, didn't want to

Why do you want to argue about everything? Feelings hurt much? I said she broke the law and she clearly did as per Comey's report. I have no insight into Comey's reasons on the subject.

Maybe for the same reason your team wants to continue the Trump Russia collusion conspiracy after the investigation turned up no incriminating evidence, "muh team" - or consider Kyle Rittenhouse to be a murderer after being found not guilty by a court of law and a jury of his peers. You only consider the legal decisions to be a standard when the outcome is favorable.

I'm not arguing. I'm asking you why you think she should be prosecuted if the DOJ and FBI refused.

Also what should the penalty be for her?

Similar to Petraeus since they were very similar. one plea count, probation and a fine.

the standard answer seems to be that Comey was getting out in front of rogue NY agents who were going to leak it anyway. who knows?

I thought they were supposed to neither confirm nor deny.

Are you whining because I didn't respond to this post? He opened the case again because they found Hillary classified emails on Carlos Dangers laptop.
