DOJ told Congress not to worry b/c Delaware US Atty Weiss was in charge of the Hunter probe and could be trusted as a “Trump appointee” to keep Biden’s political appointees from playing politics/pulling punches.
But, Weiss can only bring charges in Delaware under normal rules. Unless he has some special written authority to overrule the veto of another US Atty (appointed by Biden) to bring charges outside Delaware.
But if the crimes occurred in DC or CA, Weiss has to go hat in hand to Biden political appointees in those other districts to do anything there.
So they told Congress Weiss is the sole decider.
But behind the scenes, Biden appointees in DC and CA still got to veto the charges b/c the crimes occurred in those districts—not Delaware.
Weiss admitted in a 10/7/22 mtg he wasn’t really the decider—contrary to what Congress had been told.
That caused IRS agents to later blow the whistle. They refused to participate in misleading the public.
In the 10/7/22 meeting, Weiss said the quiet part out loud (that he wasn’t really the decider on charging Hunter Biden), IRS SSA Shapley wrote it down at the time, told Congress later, and then Congress voted to release the evidence last week.
Now Weiss and Garland have some explaining to do about their contrary claims to Congress that only Trump-appointed Weiss—and no Biden appointee—would have a say in what charges, if any, to bring against the President’s son.

Under oath Garland assured Weiss he could bring charges outside of Deleware and there would be no interference. When Weiss reached out to the top federal prosecutors in California and Washington to bring charges he was rejected by both federal prosecutors. Weiss was also denied Special Counsel authority by main DOJ.
Why was DOJ running interference on the IRS investigation?
