That is what I mentioned above and no one responded. That law makes little sense to me because often both people are intoxicated- like at college parties. And if the law specifically relates to drunk women not giving consent then what about gay males?
I think that the assumption is that if the guy can pop wood he's not too drunk to know what he is doing.

You can rape someone without being "successful."

    I wouldn't know about that.

In that case could the guy say he was intoxicated as well, and then what does it become, a double-foul with no yardage assessed?
    REPLAY FIRST DOWN!

Are you saying you've never failed an attempt?

Yep...never succeeded a rape attempt either.

Basically. That's why fewer charges are pressed by angry parents who find out that their teenagers are having sex, because if his/her partner is also under-aged, there's not a whole lot they can do since the other party would be able to produce the same charges.

And if the law specifically relates to drunk women not giving consent then what about gay males?
... why would the law say that? To the best of my knowledge the law is written in a non-gender specific way with regards to consent.

In Texas you cannot consent to sex if you are intoxicated. I don't know the laws in Iowa, but in Texas it would not be considered consensual.
If that's the case, then am I legally married?

If you drive drunk, you are responsible for that choice. What about a FWI?
