    Do your job Ginsburg, leave anything outside the parameters of your job, to the people whose job it actually is.

    Big pet peeve of mine when federal agencies or employees overstep their bounds and get into the arena of policy prescription.

    Speaking at the Planned Parenthood conference in DC this afternoon, Barack Obama leveled harsh words at conservative Supreme Court justices, and he offered his own intention to appoint justices with "empathy."

    Which aspects of the internet? I mean, what specifically is there about the internet does the Cons ution not address?

    Our rights to free speech? Right there in the First Amendment.

    Our ability to engage in trade over the internet? Covered.

    Our right to own computers, servers, cabling, etc...? Yep. Property rights...check.

    So, where is the Judiciary Act of 1789 specifically mentioned in the Cons ution?

    You mean other than Article III, Section 1's statement that "The judicial power of the United States shall be vested in one Supreme Court and such other inferior courts as the Congress may from time to time ordain and establish?"

    I really can't imagine how anyone could have read that express provision of the Cons ution to allow Congress to enact legislation that created a bunch of federal courts that were jurisdictionally inferior to the Supreme Court. Baffling to me, really.

    So, you're agreeing the Cons ution could contain language that relates to specific things without specifically mentioning those things in the do ent?

    I still can't reconcile any of those quotes with:

    , he's even suggested putting someone with no legal background but that has an ability to empathize and settle cases based on a just outcome instead of some "lofty legal theory."

    To me, it sounds like Obama is seeking a justice in the Breyer mode. Considering his political pragmatism, I don't think that's very surprising.

    Yoni found an Obama soundbite he thought resembled bloggy pla udes about liberal justices.

    He thought the resemblance was so plain, that mere juxtaposition would make the argument for him.

    It's typical. Yoni can't really connect the dots. He just jumps to conclusions and blows dog whistles so he can identify his low information buddies in the thread.
