I will echo what others said, that it's hard to justify shooting someone if they don't show some sort of imminent threat. A guy in your house might have a gun. The guy in your vehicle driving off MIGHT have a gun, yes, but he's probably not going to turn around and try to shoot you while he's hauling off.
