    Bull , there is nothing about the ship's being manned. US casualties are explicitly avoided in the other plans when only one or two would be killed.

    Why would they want hundreds of deaths? Why would they be necessary here if they were not necessary anywhere else they planned to fake deaths?

    Why could they not fake deaths like they planned to in the other plans?

    Not in any of the plans.

    In fact, when anything is specifically mentioned, it is explicit that no one actually dies.

    The do ent supports the idea that these bas s only goal was invading Cuba, and they didn't care what carnage they had to leave to do so. That they didn't announce a body count doesn't alleviate their intent to blow up, set fire, sink ships with sailors aboard, initiate terror campaigns in major American cities, and use mortar rockets to s American facilities, without regard to fatalities. Fatalities are a given. They in fact serve the cause. They were planned for.

    Fatalities were not a given and they were explicitly to be avoided. No real deaths were necessary for what they were proposing. If they wanted deaths, they wouldn't have explicitly planned to avoid them.

Malice aforethought n. 1) the conscious intent to cause death or great bodily harm to another person before a person commits the crime. Such malice is a required element to prove first degree murder. 2) a general evil and depraved state of mind in which the person is unconcerned for the lives of others. Thus, if a person uses a gun to hold up a bank and an innocent bystander is killed in a shoot-out with police, there is malice aforethought.

    Nope. The second plan proves you wrong. There is no reason to believe the first one would involve killing sailors. No need.
