Attorney General Loretta Lynch said Friday that she will take a step back from the decision whether to charge anyone in the Hillary Clinton private email server probe but is not fully recusing herself from the case.
Lynch told Washington Post journalist Jonathan Capehart in an interview at the Aspen Ideas Festival that she will accept whatever recommendations the FBI and career prosecutors make. (Career prosecutors are Justice Department lawyers who were not appointed by the president.)
“I will be briefed on it and I will be accepting their recommendations,” Lynch said. She added that the team of FBI investigators and career prosecutors on the case has been working “independently” since before she took office last year.
The announcement comes after Republicans and some Democrats criticized Lynch for a half-hour meeting on Monday with former President Bill Clinton. Those critics said the meeting suggested a conflict of interest.
“What on earth were you thinking?” Capehart asked Lynch of her meeting with the former president.
Lynch said the meeting at the Phoenix airport was primarily social and that the email inquiry was not discussed. She said they talked about Clinton’s grandchildren. “I certainly wouldn’t do it again, because I think it has cast a shadow over what it should not, over what it will not touch,” Lynch said, adding that the questions over the Justice Department’s integrity have been “painful.”
The FBI is investigating whether Hillary Clinton or others mishandled classified information by using a private email server for official business while she was secretary of state. Investigators have not interviewed Clinton in the probe.
Some Republicans have called on Lynch to completely recuse herself from the inquiry and appoint a special prosecutor to handle it, arguing that a Democratic appointee cannot fairly head an investigation that potentially has a big influence on the presidential election.
This step falls short of that. “A recusal would mean I wouldn’t even be briefed on what the findings were,” Lynch said. “While I don’t have a role in those findings or coming up with those findings … I will be briefed on it and I will be accepting their recommendations.”
The step does mean, however, that Lynch is promising she would not change the outcome of the investigation or attempt to downgrade the recommendations, which attorneys general have done in the past. (Former Attorney General Eric Holder, for example, downgraded the recommended charge for Gen. David Petraeus’ mishandling of classified information to a misdemeanor.)
Lynch said she has long planned to defer to the recommendations of the FBI and career prosecutors but decided she should take the unusual step of announcing the decision to clear up doubts over a conflict of interest.
A Justice Department official declined to comment on whether other political appointees, such as Assistant Attorney General John Carlin, would also take a step back from the case.

Democrats Are More United Now Than in 2008
By historical standards, the primary was not extraordinarily bitter. Sanders refused to go after Clinton on potential scandals (such the e-mail scandal, which he publicly denounced) and rather ran a campaign to push the Democratic party to the left on issues with broad popular support.
Indeed, Sander’s endorsement signals a level of party unity that has occasionally evaded Democrats. In 1992, Jerry Brown called Bill Clinton the “prince of sleaze” and refused to endorse Clinton, even after clearly losing the primary. In 1972 the party was openly divided about McGovern, and he ended up being crushed. Though it has quickly slipped into the memory hole, the 2008 primary was quite vicious, and many Hillary supporters refused to support Obama in the general.
Indeed, the relatively low levels of support among Bernie supporters for Trump signal far more party unity among Democrats than existed in the past.
Using the Cooperative Congressional Election Study 2008, I find that 24 percent of those who reported voting for Hillary in the Democratic primary supported McCain in the general (74 percent supported Obama).
According to polls from Washington Post-ABC News, in May, 20% of those who backed Bernie in the primary would support Trump in the general. By June, that number had fallen to only 8%.
For comparison, in June of 2008, 20% of those who supported Clinton in the primary said they preferred McCain over Obama in the general.

During an extended exchange with Rep. Trey Gowdy (R-S.C.), Comey affirmed that the FBI's investigation found information marked classified on her server even after Clinton had said that she had neither sent nor received any items marked classified.
"That is not true," Comey said. "There were a small number of portion markings on, I think, three of the do ents."
Asked whether Clinton's testimony that she did not email "any classified material to anyone on my email" and "there is no classified material" was true, Comey responded, "No, there was classified material emailed."
"Secretary Clinton said she used one device. Was that true?" Gowdy asked, to which Comey answered, "She used multiple devices during the four years of her term as secretary of state."
Gowdy then asked whether it was true that Clinton, as she said, returned all work-related emails to the State Department.
"No, we found work-related emails, thousands that were not returned," Comey said.
"Secretary Clinton said neither she or anyone else deleted work-related emails from her personal account. Was that true?" Gowdy asked.
"That's a harder one to answer," Comey responded. "We found traces of work-related emails in, on devices or in slack space. Whether they were deleted or whether when a server changed out something happened to them, there is no doubt that the work-related emails that were removed electronically from the email system."
Gowdy asked whether Clintons' lawyers read every one of her emails as she had said. Comey replied, "No."
