One of the FOX and Friends re s actually thought this could be a hate crime.
It's stupid and incredibly offensive but a hate crime it is not.

Colbert had a great joke about them last week. He was going off on how we couldn't let cartoon characters vote because they'd surely be democrats. His solution was to drop anvils on people's heads. If a bump began to protrude from their head, they were a cartoon character and we shouldn't let them vote. If their skull was crushed then they can vote, or host FOX and Friends. It was a segment of The Word so the punchline was typed and put on screen. It was hilarious...and accurate.

If it would be a hate crime to depict a black man hung in effigy (and there's reason to think it might), I'm not sure why it wouldn't be a hate crime to depict a white woman hung in effigy. I'd generally agree that it's not a hate crime in either situation, but it can't be a hate crime in one scenario and not a hate crime in the other.
It's ridiculous in either situation and should be tolerable in no situation.

If hanging something in effigy (whether black, white, woman, man, jew, christian, etc) is a hate crime, why arent the public rallies of Nazis and KKK?
I mean, an effigy just sits there while these people have bullhorns and an at ude, actively preaching death and destruction to other humans in plain sight, down Main streets (hating that phrase lately).
What is the difference? Why is a silent effigy a hate crime, but actively and vocally spreading hate not a hate crime?
Which is exactly why hate crime legislation is ridiculous. Its a legislature's dream invention. Make something illegal that already was illegal and run as being tough on crime.

A few things:
(1) this is not a hate crime; whether or not you agree with enhacing punishment for violent crimes that are inspired by racial hatred, it's clear that this is not in that category
(2) this is tasteless and cruel, but it begs the issue of double standards; if this were Obama hanging in effigy, Al Sharpton and Jesse Jackson would be agitating and CNN would be doing a ten-part series on racism in America
(3) the hatred for Palin--on the left and the right--is puzzling to me; I don't like her, but I'm honest enough to admit that I'm embarrassed to have a VP who sounds like she's from Fargo--in other words, I want my president and my VP to look and sound a certain way, and I know it's a stupid thing to care about; but the hatred for her, and the doubt as to her qualifications, is like nothing I've ever seen (BTW, Obama ain't much more qualified, and Biden says absurdly idiotic things every day)

There have been a couple posts in this thread about effigies of Obama hanging by nooses...I have yet to see any national news media go off the deep end calling for those responsible to be prosecuted for anything.

I missed "ghost" and assumed it was the George Fox incident, that's why I said fishing line. Looks like I may be wrong on this one.
Clarification. I am speaking of the incident at Geroge Fox College in Newberg Oregon.
Remember the Jena Six incident? They hung lasso's after game victories. The time before the supposible one that sparked the beating, the Rodeo team hung a dipiction of a rivals mascot in one, after they won. A Mavrick if I remember right. It was simply a normal thing, but when the media got hold of the story, the lasso's became nooses.
