ORLANDO, Fla. -- A three-judge panel in Florida has ruled that a former neighborhood watch leader charged in the fatal shooting of teenager Trayvon Martin should be granted a new judge in his case.
Florida's Fifth District Court of Appeal ruled Wednesday that Judge Kenneth Lester should enter a motion to disqualify himself in George Zimmerman's second-degree murder case. Zimmerman's attorney Mark O'Mara asked the court earlier this month to overturn a previous ruling by Lester not to leave the case.
One of the three judges dissented in the ruling.
O'Mara had argued that Lester should disqualify himself after he said the judge made disparaging remarks about Zimmerman's character and advocated for additional charges against him in setting his $1 million bond in July.
Zimmerman remains free on bail. He's pleaded not guilty.

At a wide-ranging hearing, Circuit Judge Debra Nelson heard argument on an array of issues, including defense requests for greater access to evidence from state and federal investigations into the Feb. 26 shooting of Trayvon Martin (http://www.orlandosentinel.com/topic/crime-law-justice/crimes/crime-victims/trayvon-martin-PEOCVC000188.topic).
On the bond issue, the defense argued Zimmerman has been well-behaved: Since his current, $1 million bond was put in place, Zimmerman has not violated its terms, a probation officer testified during the hearing.
But defense attorney Mark O'Mara (http://www.orlandosentinel.com/topic/crime-law-justice/justice-system/lawyers/mark-omara-PEBSL0000917.topic) went beyond that, arguing that the evidence also favors his client's freedom. Pulling out a bloody photograph of Zimmerman's nose from the night of the shooting, O'Mara said the court must consider "undeniable evidence of innocence" that he said exists in the case.
"The very issue of his innocence is an issue for you to consider," he said to the judge. O'Mara also argued his client needs to travel to assist his defense, and is not safe in Seminole County, where he has received threats.
However, prosecutor Bernie de la Rionda argued it's money and publicity — not safety— that the Zimmerman team is after.
"Isn't the defendant safer if law enforcement knows exactly where he is?" de la Rionda said. "If there are threats, why is he appearing on national television?"
Why does Zimmerman want to travel? De la Rionda made reference to a recently announced plan to send signed thank-you notes to defense-fund donors. "Maybe it's for autographs," he said.
After hearing argument, Nelson denied the defense motion.
Zimmerman's bond has repeatedly been a contested issue in the case. He was granted and released on $150,000 bond soon after his arrest, but that bond was revoked after prosecutors alleged that Zimmerman and his wife had conspired to hide money. Zimmerman's wife, who testified that she and her husband were broke, was charged with perjury.
Zimmerman was later granted his current $1 million bond.
In addition to the bond decision, Nelson ruled on a slew of motions:
•The state will turn over the original recording of an interview of a girl identified as Trayvon's girlfriend. The girlfriend, identified as Witness 8, is a key state witness: She says she was on the phone with Trayvon moments before the shooting, and her account largely corroborates the state's theory.
•Zimmerman may re-depose Sanford police Investigator William Erwin, who the defense says was present when police played 911 audio for Trayvon Martin's father. Police have said that Tracy Martin denied the cries for help in the audio were those of his son; however, the elder Martin has since disputed the police account.
•The state will alert the defense to any witnesses who say that they believe the cries were those of Zimmerman, who told police after the shooting that he was the one crying for help. However, prosecutors will not be required to tell the Zimemmerman team about witnesses who came to the opposite conclusion: That Trayvon was the one yelling.
•The defense can demand additional documents from investigators with the Federal Bureau of Investigation (http://www.orlandosentinel.com/topic/crime-law-justice/crimes/fbi-ORGOV000008.topic) and U.S. Department of Justice (http://www.orlandosentinel.com/topic/crime-law-justice/u.s.-department-of-justice-ORGOV0000160.topic), who are conducting a civil rights probe. However, those agencies will be granted a 20 day window to file a legal challenge to those demands.
•Nelson also denied a motion for additional Florida Department of Law Enforcement records. She told O'Mara to request the documents from the agency himself, and to re-file his motion if the FDLE doesn't comply.
The case is currently set for trial in June, with hearings expected at least once a month before then. The next court date was tentatively set for Jan. 8.
A hearing is also expected in April for Zimmerman to argue he should be immune from prosecution under Florida's the controversial "stand your ground" law.

I think the sports world, or if you want to be specific the QB position :lol, is one of the areas in this country where there isn't an injustice against blacks. Heck, the only time rednecks in the South ever look at blacks positively is when they're watching an SEC football game :lol.
My view on blacks in sports has nothing to do with the obvious racial injustices in other areas (the legal system, the racism behind the war on drugs, black presidential candidates having to publish their birth certificate to prove they're not from Kenya, 8 hour lines at the polls in black areas of Miami every 4 years to which the Republican governor always insists is mere incompetence, passing legislation to stop people from voting after church the sunday before the elections that definitely has nothing to do with the tradition of black communities in Florida to get on a bus and vote after church that Sunday, etc.). I think it makes it harder for people to recognize real injustices when people like Warren Moon cry about supposed racism in the NFL.

After the unnamed agency returned the phone, during the first week of January, 2013, the state sent it to Cellbrite in New Jersey for analysis. Cellbrite also was able to access the internal memory, and the state provided the defense with the results on January 18. The defense says Cellebrite obtained an "enormous" amount of information from the internal memory. But, guess what's missing? All data for Feburary 26, the day/evening of the shooting.
As illustrative example, while the analysis includes GPS locating records for Mr. Martin's phone for all of the time that he was in the Sanford area, specifically absent is any such data for February 26, 2012, the date of the event. Similarly, there seems to be missing entries regarding phone calls or texts made to or from the phone in the evening hours of February 26,2012.

I forget. That was out there almost a year ago. If I recall, he tweeted his friends he attacked the bus driver.
Does it matter? That and other material does support he was a violent kid. Remember the 'fight club" type video with him in it?
When it goes to court, if it does, I'm pretty sure the bus driver will be a witness. The physical evidence alone should have never allowed this to go this far. Martin's knuckles bloodied, Zimmerman's broken nose, bloody nose, and head injuries.
Unless it can be shown that Martin was defending himself, there is no basis to prosecute Zimmerman.

Stand Your Ground Law:
Even if George Zimmerman is convicted of murder and spends time behind bars, we will still have to grapple with the fact that Florida's controversial and deadly "Stand Your Ground" law has yet to be repealed. The legislation states that if an individual feels threatened, they can shoot first. Even before Trayvon's death, the law resulted in self-defense claims tripling in Florida, which made it difficult to prosecute cases against people who shoot others. Trayvon is not the first innocent and unwarranted death by this law, (Zimmerman's defense is using the law in the June trial), and he won't be the last. If we fight for Trayvon, we have to continue to fight for this law. Justice for Trayvon isn't about putting Zimmerman behind bars...it's making sure this doesn't happen again.

Davis was the other 17-year-old Florida teen who was shot and killed by Michael Dunn for allegedly playing his music too loud. The similarities are eerie. Michael Dunn, the 46-year-old gunman, also called upon the Stand Your Ground Law. Both teens were 17. Both were black. Both were shot by men who are allegedly racists. If we forget Trayvon, we forget all little black boys who are senselessly shot because their skin presents a threat. If we forget Trayvon, the fight for Davis, kids on street corners in Chicago, there or anywhere, are trivialized.

If we forget Trayvon Martin, we forget who killed him. But most importantly, we forget what killed him. George Zimmerman was a man who legally owned a gun. He was licensed to carry a firearm. Why was Zimmerman "scared" of a teen boy walking home with a packet of Skittles in his hand? What made Zimmerman label him a thug and a punk? Why was he suspicious? Trayvon was black, and holding that card is still the deadliest thing in America. If we forget Trayvon, we forget why he was targeted. We forget why he died. We forget that the post-racial world the media tries to convince us we live in is false. We remain blind to the violent and hateful climate of this nation. Arguably, Trayvon was killed because of his skin. And so are hundreds of little black boys in America. Black boys 15 to 19 years old are 28 times more likely than White boys the same age to be killed in a gun homicide. If we forget Trayvon's cause, we forget our children. We forget to secure our future.

Zimmerman certainly has not helped his case with his court room testimony and his Hannity interview. The case will really come down to his april hearing on self-defense. With the facts that have been released through the TV/Internet. I do not see how the prosecution can get a conviction. If they can get past the self-defense hearing then they stand a chance based on public outrage. I can honestly say that if I were the prosecutor, I would not prosecute him based on the facts/testimony that have come out. Then again, I do not have to answer to the people come November.

I have not seen any facts that show he confronted Martin. He was certainly searching for him, but no facts point to Zimmerman starting the actual confrontation. This case could very well come down to this issue.

Bernie de la Rionda says his office should not be sanctioned for hiding witness misstatement.
In a sarcastic, insult-laden pleading, the lead prosecutor in the George Zimmerman case on Thursday called defense attorney Mark O'Mara a "craven" duplicitous grandstander who "courts anything resembling a microphone or camera."
He also suggested that O'Mara was either unethical or does not know the meaning of one of the most common words in a defense attorney's vocabulary: exculpatory, an adjective used to describe a piece of evidence that tends to prove a suspect's innocence.
Bernie de la Rionda's pleading came three days after O'Mara asked Circuit Judge Debra S. Nelson to fine de la Rionda an unspecified amount, accusing him of hiding a key piece of information for seven months: the fact that his most important witness had lied under oath in April.
In his response today, de la Rionda admitted that he'd failed to disclose that until three weeks ago but said O'Mara hasn't shown any actual damage and thus, his office should be off the hook.
"No misconduct has occurred, nor should sanctions be rewarded to compensate counsel," de la Rionda wrote.
Important to note, de la Rionda wrote, is that the witness' misstatement has nothing to do with whether Zimmerman committed murder when he shot Trayvon Martin, the unarmed black 17-year-old, in Sanford last year.
Zimmerman is awaiting trial on a second-degree murder charge. He says he acted in self-defense.
O'Mara's request for sanctions is just grandstanding, de la Rionda wrote, the act of a lawyer guilty of "craven conduct." O'Mara "courts anything resembling a microphone or camera," he wrote, and should understand the awkwardness of other people making misstatements.
De la Rionda also pointed out that O'Mara has made misstatements, including when he told a judge that Zimmerman and his wife were indigent.

The young woman who says she was on the phone with Martin when he encountered George Zimmerman lied about her whereabouts at another time, the prosecution told a judge Tuesday.
The woman, whose name has not been released, had told prosecutors that she was in the hospital on the day of Martin's funeral. The defense then sought her medical records.
In court on Tuesday, the state said the woman, known as Civilian Witness 8, was not in the hospital, so there are no such records to be turned over.
Questions have long surrounded the woman. Martin family attorney Benjamin Crump first played an audio recording of the woman a year ago at a news conference. The recording seemed to have very poor quality.
Police said that as of that point they had not interviewed her.
Crump said the witness was 16 years old. But prosecutors have since said she was already 18 -- legally an adult -- on the night of the killing, February 26, 2012, in Sanford, Florida.

Judge Kenneth R. Lester Jr. found that Zimmerman's deceit over cash holdings at his first bond hearing in April was not enough to hold him without bail. However, he also said he believed the suspect may have been planning to flee the country to avoid prosecution in the killing of Florida teen Trayvon Martin.

Gladys ended the letter by thanking supporters and promising that her son's trial will not disappoint.
"The truth will finally be revealed to many, but to some who have always seen through the narrative - the truth George always told will [not] be 'revealed,' but rather 'confirmed,'" she wrote.
On Thursday afternoon, Trayvon Martin's family and their attorneys issued a statement in response to Gladys Zimmerman's letter.
"The facts of this case are simple and straightforward," the Martin family statement reads. "We are confident that a jury following the overwhelming evidence against George Zimmerman will hold him accountable for killing our son, Trayvon Martin."
The Martin's call Gladys Zimmerman's view of the justice system "disingenuous and disrespectful to the very system that is currently affording [George Zimmerman] every available opportunity to defend himself."
"The arrest of an admitted killer is not violation of due process, it is due process," the statement says.
The Martin family says they hope the death of their son will help to prevent "other senseless acts of gun violence" in the future.

Police sergeant fired for Trayvon Martin shooting targetsBREVARD COUNTY, Fla. (WFTV) -- Officials with Port Canaveral said a police sergeant has been fired after he brought Trayvon Martin shooting targets to a firearms training session.
Sergeant Ron King was terminated from the police department on Friday, according to officials.
Port officials said King brought two shooting targets which had an images resembling Trayvon Martin on them to a firearms training session on April 4.
King was supervising the training session and asked if anyone wanted to use them. Officials will not say if the targets were actually used.
"Whether his act was hatred or stupidity, none is tolerable," said John Walsh, CEO of Port Canaveral.

The defense team for George Zimmerman, the man accused of killing unarmed teenager Travyon Martin, released dozens of photos and text messages of the 17-year-old murder victim in a seeming effort to portray him as a “gangsta” troublemaker.
It is unclear whether the texts and photos will be permissible in court, though attorneys for Martin’s family claim they represent “irrelevant red herrings.” Zimmerman’s attorneys are expected to use the “evidence” to make insinuations about Martin’s character, as the Zimmerman can be heardin a 911 call (http://www.documentcloud.org/documents/326700-full-transcript-zimmerman.html) accusing the teen of being “up to no good” and “on drugs or something.”
