No one in the executive branch has the legal authority to unilaterally cancel congressional appropriations. No one has the legal authority to turn the Treasury payments system into a means of political retribution. No one has the authority to summarily dismiss civil servants without cause (https://www.nbcnews.com/think/opinion/trump-tweeted-he-can-fire-anyone-including-robert-mueller-here-ncna871166). No one has the authority to take down and scrub government websites of public data, itself paid for by American taxpayers. To describe the current situation in the executive branch as merely a constitutional crisis is to understate the significance of what we’re experiencing. “Constitutional crisis” does not even begin to capture the radicalism of what is unfolding in the federal bureaucracy and of what Congress’s decision not to act may liquidate in terms of constitutional meaning.

Together, Trump and Musk are trying to rewrite the rules of the American system. They are trying to instantiate an anti-constitutional theory of executive power that would make the president supreme over all other branches of government. They are doing so in service of a plutocratic agenda of austerity and the upward redistribution of wealth. And the longer Congress stands by, the more this is fixed in place.

Gently, softly, calmly, let’s talk about what’s happening in DC right now.

Friends, have you ever been through a ZBB process? If not, let me give you my take. So, in a corporation where expenses are out of control, you have to put the entire company through a zero based budgeting process. It is one of the most painful things that people in a company experience.

You basically have to justify every. single. expense. And you also cut a bunch, and then only add back after you’ve gone through a proper ZBB cycle.

The US government is going through a ZBB right now. And that is necessary because spending is out of control. The complexity is so vast that I expect it will take AI to decipher.

You cannot tell me that a government that accidentally wires hundreds of millions of dollars to the Taliban has its finances in order. That signals an underlying disaster. That signals bad stewardship of resources.

In fact, it is a disaster. Over the last 20 fiscal years, the US government has made ~$2.7 trillion in "improper payments," according to the US Government Accountability Office. Trillion! With a T!

That financial management disaster was not caused by Elonmusk
. And there is no painless way to clean it up.

Elon is doing what any executive would do walking into a giant mess. You ZBB and then build back.

So, I don’t believe that America is going to be on the wrong side of global right and wrong, as some are saying. I don’t believe that America is going to be permanently isolationist. I do believe that unwatched finances will get out of control in any human system, and that the GAO has been trying to ring this bell for years, and that scaled complexity requires scaled financial management.

Because the US has the largest budget in the world, it will now go through the single most complex ZBB ever undertaken in the history of the world.

Some states do ZBB, but it's never been done at the federal level. President Jimmy Carter tried, but the bureaucratic systems were too complex, and President Ronald Reagan abandoned the attempt.

So, if there is one person in the world chosen to lead this Grand Canyon of projects, we would hope for the president to choose one of the best capital allocators on the planet. Better if that human is also one who can leverage AI and technical talent to manage the massive complexity.

Anyone who has lived through a ZBB at the corporate level will tell you that it’s hell and everyone hates it. This is why I feel really bad for federal workers -- I have a lot of empathy for civil servants and people doing a great job every day for the United States. No doubt, the uncertainty is trying and stressful for many. It's an unfortunate situation.

So, that's my take. I don't want to speak beyond what I know and can observe from the other side of the country. I've worked both in the private sector and the public sector -- the cultures are different. And an Elon-Musk-style culture is going to be the most hard core of them all. No doubt, it's jarring. It's gonna be a lot.

But what I also know is that every time I have ever doubted Elon, I ended up being the one who was wrong.

He also instructed the Trump administration to swiftly notify workers of the order freezing implementation of the “deferred resignation” program — which excuses workers from the administration’s return-to-office mandate and allows them to maintain their pay and benefits through Sept. 30.
O’Toole, an appointee of President Bill Clinton, noted that his freeze was just “table-setting” for the hearing and was not an indication of his eventual ruling.

A lawyer for the government said the administration would quickly comply with his order and alert federal workers of the development.

On Friday night, the NIH announced it was cutting payments (https://x.com/NIH/status/1888004759396958263?mx=2) toward overhead costs for research institutions that receive its grants, a policy that could leave universities with major budget gaps, The Associated Press reported.

Currently, some universities receive 50% or more of the amount of a grant to put toward support staff and other needs, but that would be capped at 15%, according to AP.

The University of Alabama at Birmingham and the University of Alabama in Huntsville are examples of the state institutions that could be affected by the cuts.

UAB alone has received more than a billion dollars in NIH funding in recent years, AL.com’s John Archibald reports. UAH also receives NIH funding, university spokesman Russell Nelson said Saturday but couldn’t say how much.

Steve Ammons, president of the Birmingham Business Alliance, said he was unsure of the specifics of the cuts, “but certainly any reduction in funding would be a hit to UAB since they were in the top 30 for 2024 for NIH funding. Certainly something we need to watch and make sure we advocate for the state’s largest employer.”

No federal agency has had a bigger target on its back in the last fifteen years than the Consumer Financial Protection Bureau. Pro-business conservatives are simply offended by an agency with a mission to protect ordinary people, the lowest rung on America’s totem pole, from financial scams, and they have yearned to litigate, legislate and intimidate it out of existence. All of the lawsuits have failed at erasing the CFPB’s fundamental structure; the last opinion preserving it was written by Clarence Thomas. Legislative efforts to kill the bureau never got off the ground.

Frustrated in Congress and the courts, MAGA has turned to snuffing out the CFPB by executive fiat. And even there, they haven’t gotten everything that they wanted, while their success are likely to be beaten back in the courts.

Russell Vought, the Project 2025 architect and White House budget director who took over as acting CFPB director on Friday, expanded a shutdown of the bureau’s activity in a Saturday night memo, in ways that conflict with established law. He then attempted to defund the CFPB, only to find that it was already funded for the rest of the fiscal year.

It also means that small community banks are now regulated more than big banks. As part of a political compromise during the creation of the CFPB, it supervises only banks with more than $10 billion in assets. The other banking regulators handle banks under $10 billion. Since the other regulators are still active, smaller banks are the only ones being checked right now for compliance with things like the Truth in Lending Act, the Home Mortgage Disclosure Act, and more. This could threaten competition, since big banks will for the time being have lower compliance costs and a freer rein to profit from cheating customers. The playing field was just unbalanced in favor of the big banks.

No it isn’t. Not really; these people aren’t interested in saving taxpayer money, they’re interested in making the government incapable of functioning, and in this case undercut universities in general, perhaps with a soupçon of gleeful punishment for supposedly “elite” institutions. Per Project 2025: “This market-based reform would help reduce federal taxpayer subsidization of leftist agendas.” Leftist agendas like, say, curing cancer, or Alzheimers, or Parkinson’s, or whatever the next pandemic virus is.

President Donald Trump’s Small Business Administration (https://www.bloomberg.com/quote/0249229D:US) told probationary staff members it had mistakenly sent them termination notices, and then informed some of them the next day that they were fired after all.

“Probationary employees across the Small Business Administration may have received an unsigned notice of employment termination,” according to an email sent to some SBA staff on Monday that was viewed by Bloomberg News.

“Please be advised that this draft letter (see attached) was sent in error – and as such, it is not currently in effect. If you are in receipt of the initial notice, your employment has not been terminated as was erroneously indicated in the initial notice,” the email continued.

On Tuesday, some of those probationary staff — employees who are generally within their first year on the job — received a new message telling them they actually were, in fact, dismissed, according to a fired worker who spoke on condition of anonymity because of concerns about being targeted.

“During this probationary or trial period, it has been determined that your continued employment does not promote the efficiency of the service because you have failed to demonstrate fitness for continued federal employment,” according to the email sent Tuesday.

The language of the termination notice matched the form letter that the agency had said was previously erroneously sent to staff.
