A federal judge has ruled that the Trump administration unconstitutionally retaliated against the American Bar Association when it abruptly canceled millions in grants awarded to the world's largest association of lawyers and legal professionals.
Judge Christopher Cooper of the U.S. District Court for the District of Columbia issued a preliminary injunction against the cancelation of the five grants and ordered the Justice Department to fully pay out the $3.2 million previously allocated to the ABA. The grants were intended to train lawyers and judges who work with survivors of domestic violence and sexual assault.

A growing backlog of hundreds of unsigned NOAA contracts has slowed agency operations to a crawl — so much so that even Sen. Ted Cruz, a staunch ally of the Trump administration, has raised concerns about the gridlock.
The bottleneck is due largely to one man: Commerce Secretary Howard Lutnick, whose portfolio includes the National Oceanic and Atmospheric Administration. After taking office in February, Lutnick insisted that he personally review any contract in excess of $100,000.
Intended as an attempt to identify waste and redundancy, the policy instead has sown chaos at the nation’s preeminent climate and weather agency, say former and current NOAA officials.
More than 200 NOAA contracts — including one aimed at helping local communities prepare for extreme weather events — are now stuck in limbo, waiting for Lutnick to make a decision. I wanted to know if anyone fired at the FAA directly impacted this. You brought it up so I thought you might know but apparently you don't. You seem to think it's plausible but you don't actually know.

I'm not a republican. I think the tax bill is nuts and not fiscally responsible. I think it will get better in the Senate but both parties aren't seriously addressing the budget deficit.
There are only a hand full of true deficit hawks like Chip Roy who don't just concede to every special interest group.

In an internal memo obtained by The Handbasket that was sent on Thursday to Acting FEMA Administrator David Richardson by Stephanie Dobitsch, Associate Administrator for Policy & Program Analysis, Dobitsch outlined the status of “critical functions” at the agency that a working group determined were at “high risk” of not properly functioning because of “significant personnel losses in advance of the 2025 Hurricane Season.” ...
One slide in the memo, which was also shared with approximately 30 members of FEMA senior leadership, pertains to staffing at Mount Weather Emergency Operations Center, a critical high security facility in Virginia. Another slide in the memo details the high risks facing FEMA’s Office of Response and Recovery—what a FEMA staffer told me is “THE disaster response program.” It lists issues with Resource Deployment; Disaster Staffing; Operational Guidance; Planning, Training and Exercising; Interagency Coordination; and Pre-Staging Assets. “Failure to mitigate or eliminate identified risks in critical functions will challenge the Agency's ability to execute response and initial recovery operations and may disrupt life saving and life sustaining program delivery,” the slide reads.
Under the heading of “Resiliency,” the memo details the high risk of “Potentially lapsing almost $3B in grant funding to hundreds of direct grantees and thousands of subgrantees.” It attributes the issue to, among other things, “Inability of ICE to advise on Sanctuary Jurisdictions and accept role for program design.” The resiliency slide also notes the high probability of “Timely Payment of Flood Insurance Claims” being disrupted.
The memo also notes that FEMA Mission Support lacks critical Information Technology (IT) infrastructure to “build out secure and maintain services supporting local field office disaster operations.” In other words, they lack the technical manpower to quickly stand up a field office when disaster strikes.

DeLauro and Murray pointed to Vought's removal (https://democrats-appropriations.house.gov/news/press-releases/what-are-they-hiding-delauro-murray-demand-omb-promptly-restore-access-website) in late March of an OMB website that made federal spending allocations available to the public as evidence that he is depriving "the public of information they are entitled to in law but also undermin Congress' ability to carry out its legislative and oversight functions."
Further, they wrote, under Vought's direction the OMB has developed "inconsistent and inadequate spending plans for fiscal year 2025 submitted by departments and agencies under section 1113(a) of the Full-Year Continuing Appropriations Act."
"Many agencies' plans still have yet to be submitted or blatantly omit basic funding details at your agency's direction."
The bill was passed in mid-March, with departments and agencies required to submit a complete "spending, expenditure, or operating plan for fiscal year 2025" within 45 days of its passage.
"These spending plans were due to the appropriations committees on Tuesday, April 29," wrote DeLauro and Murray. "Four weeks have now come and gone, and while the committees began receiving [I]some spending plans from departments and agencies consistent with the 45-day requirement, many agencies' plans still have yet to be submitted or blatantly omit basic funding details at your agency's direction."
The lawmakers pointed to the spending plans of the Departments of Education and Health and Human Services (HHS) as evidence that the OMB and the Trump administration have "demonstrated an inability to effectively and efficiently manage public resources."
The Department of Education's plan was submitted on the deadline of April 29, but "completely omitted dozens of specific programs and activities."
The education document also said nearly $13 billion was "unallocated," though much of that funding is directed for specific purposed by law. A revised plan sent to Congress on May 23 still included $8 billion in "unallocated" funding and lacked "detail on dozens of programs now with only four months left in the fiscal year."
The spending plan submitted by HHS included the label "Hill Version" in the file name—suggesting there was another internal version that the agency headed by Secretary Robert F. Kennedy Jr (https://www.commondreams.org/tag/robert-f-kennedy-jr). was not sharing with lawmakers.
The HHS document included only "high-level funding amounts" and provided no funding information for hundreds of programs.
"Instead, it lists 530 asterisks in place of details about how this administration is choosing to fund—or not fund—hundreds of programs that the American people count on every day," wrote DeLauro and Murray. "We need to see the 'real version' of HHS' spend plan, and we need to see actual funding amounts—not asterisks—for these vital programs."
The lawmakers demanded that the OMB comply with section 1113 by the end of May "and ensure that all spending plans contain sufficient information to demonstrate how each department and agency intends to prudently obligate all amounts provided by Congress."

The US Department of Education is paying more than $7 million a month to employees it has forced to go on leave, according to analysis from the American Federation of Government Employees Local 252, the union that represents department employees.

Under the terms of the layoffs, affected Department of Education workers were to be paid their salaries until June 9, their last day of employment.

However, following a May federal court decision blocking White House plans to shut down the agency, the workers were reinstated and placed on “administrative leave” — meaning they are employed but not allowed to work — as lawsuits continue.

A federal judge on Tuesday ruled that EPA’s termination of $600 million in environmental justice grants issued by the Biden administration for low-income areas and communities of color was unlawful.
The ruling over the Thriving Communities Grantmaking Program comes as EPA is separately appealing a ruling (https://www.politico.com/news/2025/05/19/court-questions-epa-termination-climate-grants-00356918) that its termination of $20 billion in Greenhouse Gas Reduction Fund grants was also unlawful. Congressional Republicans have proposed rescinding funding for both grant programs as part of their reconciliation bills.
The Thriving Communities Grantmaking Program was part of a $2.8 billion tranche of funding under the Democrats’ Inflation Reduction Act intended for community groups to provide block grants to address pollution that takes a disproportionately heavy toll on communities of color and low-income and rural areas.
Announced in December 2023, EPA selected 11 groups to disburse the funds to subrecipients, a setup the Biden administration argued would help the groups cut through red tape and access the money more easily.
EPA in February terminated the grants as it sought to end environmental justice work under the Trump administration’s move against diversity, equity and inclusion programs. Three of the regional grantmakers sued: the Green and Healthy Homes Initiative, which worked in the mid-Atlantic region; the Minneapolis Foundation, operating in the Midwest; and Philanthropy Northwest, which funded programs in the Pacific Northwest and Alaska.
EPA’s termination of these grants violated the Administrative Procedure Act, ruled Judge Adam Abelson of the U.S. District Court for the District of Maryland.
“EPA contends that it has authority to thumb its nose at Congress and refuse to comply with its directives. That constitutes a clear example of an agency acting ‘in excess of statutory jurisdiction, authority, or limitations, or short of statutory right,’ and thereby violating the APA,” wrote Abelson, a Biden appointee.
Abelson rejected the argument EPA made in this and similar cases that the grant terminations are effectively contract disputes that must be heard by a special court, the U.S. Court of Federal Claims.
Instead, he ruled that EPA’s terminations of the grants because the administration opposes environmental justice efforts were unlawful precisely because Congress intended the agency to spend it on environmental justice activities.
“Congress expressly required EPA to use the appropriated funds for ‘environmental justice’ programs. By terminating Plaintiffs’ grants on the basis that current EPA leadership no longer wants to support ‘environmental justice’ programs, EPA exceeded its authority under the Clean Air Act, and therefore was ‘in excess of statutory . . . authority, or limitations,’” under the Administrative Procedures Act, Abelson ruled.
Abelson also rejected EPA’s argument that the grants were terminated to prevent waste. “EPA is required to spend the funds that Congress appropriated … and to do so on specified types of projects, and to specifically ensure that such projects benefit disadvantaged communities,” he wrote.

A former Obama administration official and Trump critic was barred from attending the graduation ceremony of a K9 officer he had sponsored - and named after his dead wife.
James Clapper, who served as Director of National Intelligence from 2010 until 2017, was informed by the nonprofit dog-training group that his name had been taken off the list for the event.
The 84-year-old had sponsored the yellow Labrador, named Susan, as she completed her CIA training for “detection canines.” Once deployed, the dogs help to sniff out concealed explosives.
Clapper’s late wife, Susan, a former National Security Agency employee, had been a great animal lover and had volunteered at a local animal shelter.
According to The Atlantic, Clapper was informed that he was not permitted to attend Susan’s graduation a day before the event in late May. The order to bar him had come from an executive order signed by the president.

The case was so clear that the court skipped over preliminary injunction and gave partial summary judgment on the merits
Under the United States Constitution, it is the job of Congress to decide how American taxpayer dollars are spent, including how many dollars to spend and on what priorities to spend them. Once Congress authorizes funding through an appropriations bill, and the President signs the bill into law, constitutional responsibility shifts to the Executive Branch to allocate the funds according to congressional instructions. The decisions about how to allocate funds are called “apportionments,” and they are used to ensure that the Executive Branch does not spend more or less than Congress appropriated. Defendants in this lawsuit are the Executive Branch officials responsible for apportioning congressionally approved spending.
To facilitate congressional oversight of the apportionment decisions of the Executive Branch and provide the public with insight into the decisions, in 2022, Congress passed, and the President signed into law, a statute requiring the Executive Branch to publish its apportionment decisions on a publicly available online database within two days of the decision. Thereafter, the Executive Branch created a public database (the “Public Apportionments Database”) and complied with this law until late March 2025 when, without notice, it took the database offline. Defendants argue that this public disclosure law is an unconstitutional encroachment on the Executive Branch’s decision-making authority. Relying on an extravagant and unsupported theory of presidential power, Defendants claim that their apportionment decisions—which are legally binding and result in the actual spending of public funds—cannot be publicly disclosed because they are not final decisions about how to administer the spending of public funds.
However, the law is clear: Congress has sweeping authority to require public disclosure of how the Executive Branch is apportioning the funds appropriated by Congress. Under the law, the decision of the Executive Branch must be made public within two days of the decision. And if Defendants need to make a new decision, that new decision must also be made public within two days. Plaintiffs in this lawsuit monitor these decisions, and they have the right to report on and re-publish this information. Dabney Friedrich, a Trump-appointed judge

U.S. District Judge Dabney Friedrich, who was appointed by Trump during his first term in 2017, granted the request on Monday.
"The defendants have likely unlawfully frozen the Endowment's funding," Friedrich, who sits on the federal court in Washington, D.C., wrote in a 15-page ruling.
NED, a private, nonprofit organization, was formally recognized in the National Endowment for Democracy Act, which was passed by Congress in 1983.
Friedrich wrote that Congress has the "prerogative" to conduct policy-related oversight of the organization and approve its funding, while NED's board of directors is responsible for ensuring it complies with the purposes laid out in the NED Act.
The executive branch, Friedrich wrote, is tasked with funding the endowment. But evidence in the case "clearly shows" that the Trump administration is "withholding funding" from NED "for impermissible policy reasons," the judge added.
Friedrich also laid out how the Trump administration's decision to halt NED's funding severely hampered the organization's function.
"It was unable to fund 226 approved grants, 124 grants recommended for approval by the Board, and 53 core institute projects. These are activities that the Endowment, in consultation with Congress, has determined are 'important and time-sensitive' to furthering 'critical election monitoring, helping democracy activists overcome authoritarian censorship, [and] maintain[ing] access to independent news and information,'—in other words, to fulfilling the Endowment's mission," Friedrich wrote. "The defendants have fallen woefully short of providing an 'annual grant' that 'enable[s]' the Endowment to fulfill its statutory purposes."
The judge also rejected the government's argument that it withheld NED's funding to "ensure" its "level of funding in the coming fiscal year."
"Before and during litigation, the defendants obstructed routine drawdown requests on money already set aside in the Endowment's Treasury account, imposed and then abandoned a novel waiver requirement, and delayed the obligation of apportioned funds," the judge wrote.
She went on to note that she did not need to rule on whether the defendants were barred from imposing an "alternative apportionment schedule in all instances."
"The Court merely finds that the defendants may not withhold appropriated funds under the present conditions: on the grounds that the Endowment's projects do not align with the Executive's priorities," Friedrich wrote.
"In sum, subjecting $95 million of the Endowment's funding to 'review for alignment with Administration priorities,' ... is precisely the kind of extra-statutory requirement prohibited by the NED Act," Friedrich wrote. "Accordingly, the Court concludes that the Endowment is likely to succeed on its claim that the defendants violated the NED Act."

The administration’s action to pay the military during the shutdown violates the Constitution, the Antideficiency Act (https://www.gao.gov/legal/appropriations-law/resources) (which gives teeth to the Constitution), and the “purpose” statute (https://uscode.house.gov/view.xhtml?req=granuleid:USC-prelim-title31-section1301&num=0&edition=prelim) (31 U.S.C. § 1301), as well as appropriations law and authorization statutes.
Let’s start with the Constitution. Article I, Section 9, Clause 7, is often known as the Appropriations Clause. It says:
No Money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law; and a regular Statement and Account of the Receipts and Expenditures of all public Money shall be published from time to time.
In plain terms, the federal government can’t spend money on something unless Congress has provided money for that specific purpose. The Antideficiency Act and the purpose statute are laws that enshrine this prohibition into the U.S. Code. Under the Antideficiency Act, the federal government can’t spend money without an appropriation enacted into law and an apportionment (explained below) of the appropriated funds by the president’s Office of Management and Budget (OMB). Under the purpose statute, it can’t spend the money it does have for any purpose not specifically allowed in the authorization law and the appropriation made for the budget account(s) that funds that authorized purpose.
When President Trump used money authorized only for the purpose of supporting R&D to instead pay the troops, he used existing money for a purpose not allowed by that appropriation. He also spent money to pay the troops when he didn’t have an appropriation usable for that purpose.
