Cemetary workers brutalized by ICE

A video of the encounter acquired and published by WGN-TV (https://wgntv.com/news/operation-midway-blitz/video-ice-agents-clash-with-cemetery-workers-attempting-to-help-man-in-des-plaines-river/) last week briefly shows agents approaching the cemetery’s gate, requesting access, then using what appears to be a wirecutter to gain entry. The video goes on to show agents releasing what appears to be pepper balls and asking cemetery workers to “get on the ground.”

Greer said after agents were through the gate, he was pushed to the ground and pepper-sprayed.

“My face felt like someone put lighter fluid (on it) and set me on fire,” he said.

Afterward, Greer said agents ziptied his hands behind his back and sat him against the wall of the pump house. After about an hour to an hour and a half of waiting, Greer and two of the other detained cemetery workers were taken to the Homeland Security Investigations field office in Lombard. The fourth worker arrested was transported to Rush Oak Park Hospital for medical treatment, according to Hoskins.

In a statement to the Tribune last week, a Rush spokesperson confirmed that ICE agents had been at the Oak Park campus with a detainee who needed health care.

Greer said he and the other two workers taken to Lombard waited for another two hours in private cells before they were released without being charged.

“I asked them repeatedly what I was charged with, and they said that they had to talk with their supervisor,” Greer said.

Ever since, he’s been averaging three to four hours of sleep a night.

“If this is happening to me, a U.S. citizen, what are they doing to the other individuals?” he said.

Forest Park will be engaging in know-your-rights trainings with the wider community in the wake of last week’s incident, Hoskins said.

Darren Eichler, one of the other cemetery workers in attendance Monday, declined further comment after the news conference. But in a text message to the Tribune, Eichler described the encounter through a poem.

“Amidst a trembling exchange of power, one where my hands could not rise in defense, and the law, in theory, should have risen for me, a burning rain began to fall,” he wrote. “Oil-born, it clung to my skin, slick and stinging, baptizing me in disbelief.

“Then came the chorus — a hail of peppered fire, each shot a punctuation of pain, each breath thick with the taste of vinegar and fear.”

Los Angeles County officials voted on Tuesday to declare a state of emergency over ongoing federal immigration raids.

The proclamation gives the county the power to assist residents they say have been impacted financially by Immigration and Customs Enforcement (ICE) action.

The declaration was introduced by County Supervisors Lindsey P. Horvath and Janice Hahn and passed by a 4-1 vote, with Supervisor Kathryn Barger opposing.

Federal agents chased a car through a residential neighborhood on the Southeast Side of Chicago Tuesday, and then intentionally crashed into the car in a risky maneuver restricted by some police departments nationwide.

The maneuver was caught on local security cameras, which showed the car being hit by the feds’ vehicle, leading the occupants of the car to fall out while it was moving. The occupants then fled on foot as agents ran behind.

The commotion attracted a crowd of onlookers and protesters, who converged near the scene of the crash at 105th Street and Avenue N in the East Side. A large number of armed Customs and Border Patrol agents responded to the crowd by hurling smoke grenades, shooting pepper balls and deploying at least three rounds of tear gas over the area, even with children and seniors in the area. At least four protesters were detained.

ICE menaces public officials

Federal agents pointed a gun at state Rep. Hoan Huynh in Albany Park on Tuesday afternoon after blocking his vehicle in and holding phones up to the windows, according to a statement from his office.

“My staff is a little shaken up, but we’re OK,” Huynh told the Sun-Times.

Huynh had been informing local businesses of their rights regarding the use of their property by federal agents when he and his staffers were alerted to the presence of federal agents nearby, the statement said. He and the staffers drove to Montrose and Kimball avenues to warn others of the federal agents by honking and yelling when six agents in two vehicles blocked Huynh’s vehicle from the front and back.

Huynh said one of the agents pointed a weapon into the open passenger window and demanded they identify themselves as another agent threatened to break another window. He said he didn’t immediately take his phone out to record the incident fearing the agent would think he was reaching for a weapon and open fire.

In video taken by one of Huynh’s staffers that was shared with the Sun-Times, Huynh can be heard identifying himself and noting the agent had been pointing a weapon as several masked agents in tactical gear move away from Huynh’s car as the camera turns to capture them. An agent circles Huynh’s car, filming the occupants inside. When the lead car of agents, a charcoal gray Kia minivan, moves, Huynh’s staffer follows it north on Kimball Avenue and west onto Montrose Avenue before the video ends.

“I never would have imagined in 2025, we would be living in an authoritarian regime in the United States,” Huynh said. “Once my colleague pulled out his camera, the agent put away the gun. ... [But] if they can do this in broad daylight to an elected official, and point a gun at someone, imagine what’s happening behind closed doors.”

U.S. Customs and Border Protection agents detained two city employees during an aggressive raid in Little Village, Ald. Mike Rodriguez (22nd Ward) said.

At least seven people were detained by agents during the mid-morning raid, including Jacqueline Lopez and Elianne Bahena, Rodriguez’s chief of staff, who is an elected member of the Ogden (10th) District Police Council. Both are U.S. citizens, Rodriguez said.

“These federal agents are operating lawlessly, demonstrating utter disregard for our constitutional rights,” Rodriguez said.

A spokesperson for the Border Patrol did not immediately respond to a request for comment from WTTW News.

Rodriguez demanded the immediate release of his ward office’s employees.

In the wake of reports of federal immigration officers driving cars without proper license plates or modified plates, Secretary of State Alexi Giannoulias has created a tipline to collect and investigate license plate violations, he said Wednesday.

Stagi, 57, started protesting Monday evening until about 8:30 p.m. before going home. She was back at the ICE building at 5:20 a.m. and saw an unmarked car pull up around 6:15 a.m., she said.

Stagi was recording on her phone when she asked an officer, “You’re a good Christian, aren’t you?”

“Boy, did that piss him off,” Stagi told The Sun on Tuesday. The officer, who was wearing a vest with “police” printed on it, knocked her phone out of her hands and she tried to grab it back.

The officer then yelled, “She’s assaulting me!” Stagi said.

The officer grabbed Stagi by her hair, put her in a chokehold and pushed her to the ground and over a grassy embankment, where she landed on her head, according to a video of the interaction reviewed by The Sun.

It was not clear through the video which agency the officer worked for.

Two U.S. citizens in Aurora say they were attacked by federal agents and detained outside of an elementary school this weekend.

Ruben Morales and Jessi Olazaba track, record and document federal agent and ICE activity in the Aurora area.

On Saturday they said neighbors alerted them to unmarked agent cars at the Allen Elementary School in Aurora.

“I was walking up to the vehicle to see why they were parked in a teacher parking spot," Morales told NBC Chicago.

He said an agent in the back seat told him to back away.

"I turn around to walk away and that’s when I hear footsteps coming in my direction and pepper spray hitting the back of my head," Morales said. "That’s when I felt body contact of them taking me down, hitting me.”

He said once they put him in handcuffs they identified themselves as federal agents.

He shared images with NBC Chicago that show his ripped pants, bloody knees and scratches to his throat and arm from the encounter.

Morales is a U.S. citizen and said agents questioned his status.

Meanwhile Olazaba, also a U.S. citizen, witnessed the interaction and tried to intervene by blowing a whistle and recording the agents.

"They told me to get back, get back, I stepped back," she said. "Then they lifted him [Morales] into the vehicle, so I went behind to get photos of the plates and make model of the car... the agent gets out of the back passenger side, which is where he had Ruben, he came out and he started to come towards me, I saw he had pepper spray in his hands. He knocked off my glasses and sprayed me with pepper spray. I went down like this and he came and used his force and pushed me with both hands and that’s when I fell back and hit my head,"

Morales said he was taken to an FBI office where he was questioned and later released without charges.

Olazaba was taken to a local hospital for evaluation. Her children were in her vehicle and were left with police.

"I was there just to record, that’s all I was doing because people need to know what's going on," she said.

U.S. Immigration and Customs Enforcement is considering hiring private bounty hunters to locate immigrants across the country, according to a procurement document reviewed by The Intercept. Under the plan, bounty hunters may receive “monetary bonuses” depending on how successfully they track down their targets — and how many immigrants they then report to ICE.

According to the document, which solicits information from interested contractors for a potentially forthcoming contract opportunity, companies hired by ICE will be given bundles of information on 10,000 immigrants at a time to locate, with further assignments provided in “increments of 10,000 up to 1,000,000.”

404 Media was the first to report (https://www.404media.co/ice-and-cbp-agents-are-scanning-peoples-faces-on-the-street-to-verify-citizenship/) the troubling rise of federal immigration officers busting out their phones to scan people’s faces to confirm their immigration status.

“I’m an American citizen so just leave me alone,” a Chicago-area man tells a swarm of masked immigration officials in a video circulating on social media. The man had refused to give his ID, and was declining to give officers information about his job. “Just get out of here, I have to go to work bro,” he pleads.

That’s when one of the officers points his phone camera at the driver’s face. He proceeds to fumble with his phone for a few seconds, while other masked feds crowd around and a small group of protestors gather.
“Hey, so listen, if you can — if you can take your hat off, it’ll go a lot quicker,” the officer stammers.

Fifty years ago, the Supreme Court ruled that customs officials could not target people based on the color of their skin. That decision was at least temporarily suspended thanks to an emergency ruling (https://www.nytimes.com/2025/10/24/us/ice-race-ethnicity-immigration.html) by 2025’s Supreme Court, allowing feds to stop people based on factors like race, ethnicity, or the language they’re speaking.

Now imbued with the power to racially profile whoever they want, federal agents are increasingly using facial recognition as the go-to tool to sort the citizens from the migrants. “It was awful, there were ICE agents and [Customs and Border Patrol] CBP agents pointing guns at community members, pepper spray in the face of community members within eyesight of our Chute Middle School students and that is not okay,” said Allie Harned, a Chute Middle School social worker.

Neighbors in the area began shouting and blowing whistles. Agents used pepper spray and arrested three U.S. citizens for "violence against law enforcement," the Department of Homeland Security said in a statement.

A Border Patrol vehicle was involved in a crash during the operation. According to DHS, agents tried to make a U-turn and the driver of a red vehicle crashed into their vehicle.

DHS said the genitals of one of their agents was also grabbed.

However, witnesses say the agents were the aggressive ones — some stating an agent pointed a handgun into the crowd.

"They were brutalizing people who were yelling at them, it’s legal to yell in America," Evanston Mayor Daniel Biss said

Biss said Evanston police are investigating the use of force by federal agents during the operation.

"There’s an open investigation and they’re gathering evidence and figuring out the best course of action to make sure hold these criminals accountable who came to Evanston and assaulted our residents," Biss said.

The father detained with his two children by U.S. Immigration and Customs Enforcement in southwestern Colorado earlier this week was wrongly identified by agents, a senior official with ICE's Denver field office said on Friday.

The official, Gregory Davies, testified in a federal court hearing on Friday that 45-year-old Fernando Jaramillo-Solano (https://www.cbsnews.com/colorado/news/ice-arrest-family-colorado-protesters-police/) was "mistaken" for someone else immigration agents were looking for. Jaramillo-Solano was taking his 12-year-old daughter and 15-year-old son to school in Durango when they were stopped by ICE agents and taken into custody. Word of the family's detention, combined with a now-viral video, prompted a protest outside ICE's Durango facility.

The Colorado Bureau of Investigation said on Thursday that it's investigating the use of force by an anonymous, masked agent against a woman at the protest, as well as any "state criminal law violations during the incident." That agent's actions could be seen in multiple videos.

Carlos Jimenez, a 24-year-old U.S. citizen, was on his way to work at a food bank when he was shot by ICE officers in what a DHS spokesperson calls “defensive shots.”

On Thursday morning at approximately 6:30 a.m., ICE officers were at Vineyard Avenue in Ontario when Jimenez, who was not in the target vehicle, attempted to pull in front of the officers.

According to Javier Hernandez, executive director of the Inland Coalition for Immigrant Justice, Jimenez was trying to assist and provide aid to the person who was being stopped by ICE officers.

After Jimenez was shot in the shoulder, the LA Times and LA Taco reported that he drove to his brother’s house so he could take him to the hospital.
He was released and then booked at West Valley Detention Center. He is now facing charges for assault on a federal officer.

I wanted those men and their families to be treated fairly in this unjust time we are living in.
Here’s what sticks out about my experience: being put in the back of an unmarked SUV and with handcuffs that were put on so tight, I have permanently lost feeling in my thumb; not being read my rights or being told what I was being charged with beyond not minding my business.

Shortly before my arrest, I had just gotten a new job working at an animal hospital and moved into a new apartment in a part of the city I’ve always wanted to live in. Things were going great. But would I even have a job to go back to now?

I’m glad I did. My supervisor actually thanked me for doing what I did, for standing up for a group of people being targeted in this country. And I cried. I believe that filming what federal agents were doing that day counted as basic human decency.

Also, these ordered deployments involve the intrusion of California and Texas National Guardsmen in their capacity as militiamen of those States, which constitutes an injury to Oregon’s “sovereignty under the Constitution,” let alone to Oregon’s “equal sovereignty among the States.”

And there is no dispute that Oregon’s sovereign injury is fairly traceable to, and therefore would be redressable by an order enjoining (1) the September 28, 2025 Memorandum federalizing and deploying the Oregon National Guard, Ex. 192; (2) the October 5, 2025 Memorandum federalizing and deploying the Texas National Guard, to the extent that it deploys members of the Texas National Guard in Oregon, Ex. 6; (3) the October 16, 2025 Memorandum deploying members of the California and Texas National Guards in Oregon, Ex. 2; and (4) any memoranda deploying members of any other State’s National Guard to Oregon based on the same predicate conditions that were relied upon to authorize the above orders

B. Preliminary Injunction

Next, this Court finds that Plaintiffs are entitled to a preliminary injunction on their claims that Defendants’ federalization and deployment of the National Guard in Oregon was ultra vires under 10 U.S.C. § 12406 and violated the Tenth Amendment.

1. Likelihood of Success

This Court finds that Defendants’ federalization and deployment of the National Guard in response to protests outside a single federal building in Portland, Oregon, “extend[ed] beyond delegated statutory authority” under 10 U.S.C. § 12406 and violated the Tenth Amendment.

Applying “a great level of deference to the President’s determination that a predicate condition exists,” id. at 1048, this Court nonetheless concludes that the President’s invocation of Section 12406 was likely not made “in the face of the emergency and directly related to the quelling of the disorder or the prevention of its continuance,” id. (quoting Sterling, 278 U.S. at 400). Critically, the credible evidence at trial established that following a few days in June, which involved the high watermark of violence and unlawful activity outside the Immigration and Customs Enforcement (“ICE”) building in Portland, Oregon, the protests outside the ICE facility between June 15 and September 27, 2025, were generally uneventful with occasional interference to federal personnel and property. Although there were sporadic instances of unlawful behavior, federal law enforcement, along with local law enforcement, were able to manage the situation and arrest and prosecute those responsible for criminal conduct.

More detailed findings of fact based on the trial testimony and exhibits are forthcoming following this Court’s full review of the record. Based on the trial testimony, this Court finds no credible evidence that during the approximately two months before the President’s federalization order, protests grew out of control or involved more than isolated and sporadic instances of violent conduct that resulted in no serious injuries to federal personnel. The violence that did occur during this time period predominately involved violence between protesters and counterprotesters, not violence against federal officers or the ICE facility. Although card readers at the ICE facility were occasionally damaged, this Court has found no evidence so far, based on the testimony at trial, that any significant damage to the ICE facility occurred in the two months preceding September 28, 2025. The credible testimony has not shown that ICE was unable to effect arrests or otherwise perform the agency’s duties. Although the evidence so far showed that protesters frequently blocked the driveway of the ICE building, the evidence also showed that federal law enforcement officers were able to clear the driveway. And even when the building closed from mid-June to early July due to property damage that occurred on June 12, 2025, ICE’s Enforcement and Removal Operations (“ERO”) office was able to temporarily relocate to another facility in Portland for administrative purposes until the building reopened. ERO officers were still making arrests in the community. Based on these preliminary factual findings, this Court concludes that the President likely did not have a “colorable basis” to invoke either Section 12406(3) or Section 12406(2) to federalize and deploy the National Guard to the Portland ICE facility in Oregon on September 28th

2. Irreparable Harm

Plaintiffs have also demonstrated a likelihood of irreparable harm in the absence of preliminary injunctive relief. If a plaintiff is likely to succeed on a constitutional claim, “that showing will almost always demonstrate [the plaintiff] is suffering irreparable harm as well.”

3. Balance of Equities and Public Interest

The balance of the equities and the public interest also weigh in Plaintiffs’ favor. “When the government is a party, the last two factors (equities and public interest) merge.” E. Bay Sanctuary Covenant v. Biden, 993 F.3d 640, 668 (9th Cir. 2021). Plaintiffs’ “likelihood of success on the merits of a constitutional claim,” under the Tenth Amendment, “tips the merged third and fourth factors decisively in [their] favor.” Baird, 81 F.4th at 1042; see also id. (“[I]t is always in the public interest to prevent the violation of a party’s constitutional rights.” (quoting Riley’s Am. Heritage Farms v. Elsasser, 32 F.4th 707, 731 (9th Cir. 2022))). “The government also ‘cannot reasonably assert that it is harmed in any legal cognizable sense by being enjoined from constitutional violations.’” Id. (quoting Zepeda v. INS, 753 F.2d 719, 727 (9th Cir. 1983)).

This Court further STAYS IN PART this preliminary injunction to the extent that it enjoins the federalization of any State’s National Guard until this Court issues its final opinion on the merits.

DHS causing car accidents and arresting the victims for assault seems to be a motif

As Figuero tried to drive through the 1600 block of West Hubbard Street on Friday, Oct. 10, an unmarked vehicle driven by federal agents collided with Figueroa’s as it tried to speed away from a hostile crowd, multiple videos reviewed by the Tribune show.

Seconds after the crash, agents abruptly stopped their vehicle and exited with weapons in hand pointing at Figueroa, a U.S citizen. Agents then forcibly opened her door and pulled her out of the vehicle by her legs without identifying themselves, presenting a warrant or informing her that she was under arrest. As bystanders yelled, “You hit her! We have it on video!” agents ignored the crowd and forced Figueroa into a red minivan and drove away.

Her car was left behind in the middle of the road, her coffee still in the cup holder, and her keys in plain view.

The Department of Homeland Security later released a statement claiming that Figueroa was at fault, saying “she crashed into an unmarked government vehicle and violently resisted arrest, injuring two officers.”

Figueroa was released the same day a few hours later without charges.

“I was in shock and terrified. The video evidence is clear: Agents crashed into me. Dayanne Figueroa is a US citizen who was driving in Chicago near a site where federal agents were arresting landscapers. According to DHS she “crashed into an unmarked government vehicle and violently resisted arrest, injuring two officers.” The Assistant Secretary of DHS Tricia McLaughlin (remember that name) said Figueroa “used her vehicle to block in agents, honking her horn,” and that she “struck an unmarked government vehicle…In fear of public safety and of law enforcement, officers attempted to remove her from the vehicle. She violently resisted, kicking two agents and causing injuries. This agitator was arrested for assault on a federal agent.”

Got it? Figueroa drove into a government vehicle, and the officers arrested her due to public safety concerns, during which she violently assaulted them, causing injury.

If there is violence in this interaction, it is only coming from one party. At no point does the woman look like a credible threat to anyone. There is no exercise of restraint, judgment, or nod to due process or constitutional protections on display by the officers.
