At the request of federal prosecutors, a judge on Wednesday dismissed the criminal case against a woman accused of crashing into immigration agents in a school parking lot during Operation Metro Surge.


Special Assistant U.S. Attorney Robert G. Tucker III on Tuesday filed the motion to dismiss Christina Rank’s case, saying that “upon a further review of the evidence and affidavit in support of the complaint, the government does not believe that probable cause for assault exists.”


The dismissal is among several criminal cases brought against Minnesotans by the U.S. Attorney’s Office for charges of assault or resisting federal agents during last winter’s immigration enforcement operation that were later downgraded or outright dismissed (https://www.startribune.com/tracking-federal-assault-cases-against-anti-ice-protesters/601853692).


Magistrate Judge Douglas Micko signed off on the tossing of Rank’s case on Wednesday and dismissed the case with prejudice, meaning the case cannot be filed again.


In a statement to the Minnesota Star Tribune, Rank’s attorney Bruce Nestor called the move “long overdue.”


“This case never should have been brought and Ms. Rank did nothing wrong to be put through this six month ordeal of a federal criminal prosecution,” Nestor said in an email.


According to the affidavit written by a Homeland Security agent, Rank was accused of causing a collision on Jan. 12 in the parking lot at the Concord Education Center in Inver Grove Heights where she worked as a paraprofessional. The complaint alleged that she blocked the entrance of the school’s parking lot after asking the agents if they worked for U.S. Immigration and Customs Enforcement (ICE), which resulted in a collision with the car.


Nestor disputed the account, saying federal agents intentionally collided with Rank’s vehicle and arrested her out of retaliation for “expressing verbal opposition to their presence on the property” of the school.

April Walker, a San Diego resident, was observing federal immigration agents in a Target parking lot in April when she said they boxed her in and pointed a camera at her face and license plate.


She said she never provided her driver’s license and the agents only moved their vehicles and allowed her to leave after she called 911. Five days later, she learned that her Global Entry, which provides expedited TSA screening, had been revoked. It was only reinstated, she said, after she contacted a reporter who then reached out to the Department of Homeland Security to inquire about the revocation.

A U.S. District Court judge has ordered the federal government to turn over all grand jury materials for her review in the cases of 38 people facing conspiracy charges for an anti-ICE protest at a St. Paul church in January.

Independent journalists, including former CNN anchor Don Lemon and Twin Cities local Georgia Fort, are charged with conspiracy. Cities Church was targeted by protesters on Jan. 18 because one of the church’s pastors, David Easterwood, helped lead the U.S. Immigration and Customs Enforcement field office in St. Paul during the government’s surge into Minnesota this winter.

Defendants had argued it was likely the federal government grossly misrepresented facts and misstated the law to grand jurors in order to secure an indictment.

Grand jury proceedings are generally secret. But the Justice Department’s actions have been more scrutinized since a federal judge in Chicago uncovered prosecutorial misconduct in a case involving anti-ICE activists, which led to charges being dropped.

Defendants in the church conspiracy case challenged a June ruling by U.S. Magistrate Judge Douglas Micko that denied a motion to disclose all grand jury materials involved in the indictments. Provinzino will examine prosecutors’ presentation to grand jurors at hearings in January and February. She said in the order that the materials should also include any introductions, legal instructions, witness testimony, and answers to questions by jurors.

Whitmer and President Donald Trump had spoken earlier Wednesday, according to her office. During that conversation, the governor “underscored the urgency of the moment” surrounding the carp barrier, her office said.


The Army Corps had halted work on the Brandon Road Interbasin Project in late July, prompting widespread backlash from politicians and advocacy organizations across the Great Lakes. The Corps did not provide information on the reason for the stoppage.

ICE continues to spread chaos and terror in peaceful communities


ICE said in a statement to local media that they were in the area in “an effort to arrest a man” during a vehicle stop last Thursday morning but the man fled the scene, the Frederick News-Post reported (https://www.yahoo.com/news/us/articles/frederick-mayor-criticizes-ice-tactics-035900539.html?guccounter=1). After that more ICE officers arrived and tensions escalated.


In the evening, ICE officers confronted protesters by driving their vehicles towards them, as seen in bystander footage, and videos shared by the Hagerstown Rapid Response activist group also showed officers approaching a home. It was then that some protestors tried to stop them from reaching the building by creating a human chain, and violence erupted.


Officers in tactical vests can be seen raising batons and hitting at least one protester about their body, while others are dragged and shoved.


“The level of violence went beyond what the situation called for. It was too much. It exceeded what is permitted,” Diaz said, saying that at least two people had to go to the hospital due to injuries. “There are many other options when dealing with unarmed people.”


He called for an investigation, as did Congresswoman April McClain Delaney, whose district includes the city, calling the incidents deeply concerning.


In a statement, Delaney said: “No family should be afraid to leave their home or feel unsafe in their own neighborhood … I am especially disturbed by reports that ICE agents used force against Frederick residents. These allegations demand immediate answers and a full, transparent investigation.”


The Department of Homeland Security (DHS), the parent agency (https://www.theguardian.com/us-news/2026/jan/19/donald-trump-immigration-crackdown) of ICE, did not respond to a request for comment from the Guardian.


In an earlier statement to local network WBAL-TV, the agency declined to comment “for operation security” and “the safety” of their personnel.

Frederick authorities said they were not aware of any ICE or local arrests. Frederick police said personnel were dispatched to try to de-escalate the situation.


Police chief Kevin Meyer said his officers asked ICE whether they had an arrest warrant but that federal officers refused to discuss it.


Soolah Kemp, a member of Hagerstown Rapid Response, said she was recording video when an ICE car drove in her direction. “I heard the siren, I turned, and he was coming at me. He sped up, so I jumped out of the way. He had enough room on the street to not have an issue. He didn’t have to do what he did,” she said.

Additional research analyzed by the Kaiser Family Foundation (https://www.kff.org/immigrant-health/the-role-of-immigrants-in-the-u-s-health-care-workforce/)shows that immigrants make up about 30 percent of direct long-term care workers overall, and 41 percent of home health aides. Further, a significant rise in a given community’s immigrant population decreases the likelihood (https://www.nber.org/papers/w29520#fromrss)that an elderly person will be moved into an elder care facility at all, as immigrant caregivers often make it possible for older Americans to remain safely and receive care in their own homes.

When legal immigration pathways are disrupted, facilities lose trained staff overnight, and residents pay the price in broken continuity of care. In an interview with PBS (https://www.pbs.org/newshour/show/end-of-migrant-protections-creates-elder-care-staffing-challenges), a senior care leader described facilities losing between 16 and 40 workers overnight when protections such as temporary protected status have lapsed. This occurred not because those workers had done anything wrong, but because their legal status expired and there was no pathway to renew or reapply.

A loss on that scale does not give a facility time to recruit and train replacements before the next shift. The immediate response is almost always for each staff member to absorb more residents, which is precisely the staffing dilution that is a common thread in elder abuse and neglect cases.

This is happening at a moment when the population needing care is growing faster than the workforce (https://www.nbcnews.com/business/economy/eldercare-workers-job-growth-pressure-rcna258820) that provides them with care. It is pushing facilities toward a staffing crisis that the industry is poorly positioned to absorb. The fallout from these losses is systemic and devastating for the people caught in the middle, as care teams that residents had come to trust are broken apart and residents are forced to adjust to unfamiliar caregivers who do not yet know their needs or history.

Even skilled, well-trained caregivers become less effective under these conditions, because quality care depends on having enough time with each resident to understand their needs and potential risks, not just rely on credentials to do the job. This leaves facilities in a position where they must consider reducing the number of beds they can safely staff or, in some cases, close entire wings of facilities.

Legal immigration pathways are critical to the elder care infrastructure. Providing quality care to the seniors who depend on skilled nursing homes and assisted living facilities requires treating adequate staffing and continuity of care as a critical part of the elder care infrastructure.

Homeland Security officials quickly labeled Martinez a “domestic terrorist” after her run-in with Exum. Chicago U.S. Attorney Andrew Boutros’ office also brought charges against her of assaulting a federal agent — only to drop those charges 46 days later.

Still, Martinez’s lawyers say a trove of evidence from that prosecution shows Exum lied to justify shooting Martinez.

“Who’s the real domestic terrorist?” Parente asked at the news conference, after presenting some of the evidence.

The Illinois Accountability Commission concluded in April that Exum “shot an unarmed civilian without apparent justification”; that “evidence was deliberately tampered with and destroyed”; and “federal agents produced materially inaccurate official reports.”

Martinez had a firearm with her that day, but it was inside a bright pink holster at the bottom of her purse, and the holster was snapped shut, court records show.

Long Island U.S. District Court Judge Gary Brown issued his fiery, 28-page ruling on Monday in the case of Dominican immigrant Angel Almonte, one of the two men arrested by the agents.


Brown called into question the agents’ claim that they busted Almonte by mistake, since the man they said they were actually targeting was five inches shorter and 80 pounds lighter.


Masked ICE agents arrested Almonte and a second man, Jeury Concepcion, in separate caught-on-video rough take-downs on May 6 in the Bronx, on Decatur and Hull Aves. Concepcion, who was slammed to the ground by masked agents with guns out, is a U.S. citizen.
