no probable cause
The man who federal agents accused of dealing Greg Bovino a groin injury from which the Border Patrol commander purportedly needed two weeks to recover will no longer face charges after prosecutors on Monday moved to drop their case against him.
Per a motion to dismiss (https://storage.courtlistener.com/recap/gov.uscourts.ilnd.487603/gov.uscourts.ilnd.487603.23.0.pdf) the complaint, federal prosecutors will no longer pursue a charge of impeding a federal officer. Cole Sheridan, the protester, was initially charged with assaulting and impeding a federal officer over an Oct. 3 protest in which a Homeland Security Investigations agent accused the man of shoving Bovino. Prosecutors could still bring charges against Sheridan in another form.
A spokesperson for the U.S. Attorney’s Office for the Northern District of Illinois did not immediately return TPM’s request for comment about the reasons for the dismissal. A spokesperson for the Department of Homeland Security referred TPM to DOJ. Sheridan’s lawyer declined to comment.

Border Patrol agent Lairmore testifies that he was not injured by the sandwich, but he felt the impact through his ballistic vest.
The sandwich came apart and "kind of exploded" on his chest upon impact, he says.
"I could smell the onions and mustard (https://bsky.app/profile/jamieson.bsky.social/post/3m4su7zwui224)."

Defense is now questioning Lairmore on cross-examination. They show a video still of the sandwich and wrapper on the ground, post-throw.
"Do you recognize that sandwich?" the attorney asks.
Lairmore won't confirm.
"I did not go back to collect it," he says.

Defense tells judge they want to question Lairmore about 'gag gifts' he received from fellow officers after the alleged assault, including a Subway sandwich plush toy and a patch that (unless I misheard) said 'Felony Footlong.'
Prosecutors object. Defense argues they reflect CBP 'state of mind.'

The defense team presses Lairmore on whether the sandwich really 'exploded.' They return to the photo of the sandwich and wrapper on the ground.
"That sandwich hasn't exploded at all, has it?" defense asks.

A day care teacher was taken into ICE custody Wednesday morning on the city’s North Side, WGN News has confirmed.
The incident happened around 7:05 a.m. at Rayito de Sol Spanish Immersion Early Learning Center, located at 2550 West Addison Street in the North Center neighborhood.
An SUV of federal agents followed the teacher’s vehicle to the day care, then proceeded to follow her into the building — where children were in attendance at the time.

Before dropping an expanded preliminary injunction and certifying the press as a class for the purpose of legal relief, Judge Ellis called Greg Bovino a liar and pointed out DHS's misrepresentations to the court in detail
DHS starting sh!t in the street then complaining about violence won't wash with video evidence and judges with their eyes open
Court grants the motion and orders as follows:
1. It is hereby ORDERED that Defendants, their officers, agents, assigns, and all persons acting in concert with them (hereafter referred to as “Federal Agents”), are ENJOINED in this judicial district from:
a. Interactions with Journalists: Dispersing, arresting, threatening to arrest, threatening or using physical force against any person whom they know or reasonably should know is a Journalist, unless Federal Agents have probable cause to believe that the individual has committed a crime unrelated to failing to obey a dispersal order lawfully issued to non-Journalists. Federal Agents may order a Journalist to change location to avoid disrupting law enforcement, as long as the Journalist has an objectively reasonable amount of time to comply and an objectively reasonable opportunity to report and observe;
b. Dispersal of Others: Issuing a crowd dispersal order, meaning a lawful command given by an authorized Federal Agent for all persons to leave a designated area, that requires any Class member to leave a public place that they lawfully have a right to be, unless dispersal is justified by exigent circumstances such that immediate action is objectively necessary in order to preserve life or prevent catastrophic outcomes as defined by Department of Homeland Security Use of Force Policy (updated Feb. 6, 2023), Section XII.E;
c. Using riot control weapons––including kinetic impact projectiles (KIPs), Compressed Air Launchers (e.g., PLS and FN303), Oleoresin Capsicum (OC) Spray, CS gas, CN gas, or other chemical irritants, 40 mm Munitions Launchers, less-lethal shotguns, Less-Lethal Specialty Impact-Chemical Munitions (LLSI-CM), Controlled Noise and Light Distraction Devices (CNLDDs), Electronic Control Weapons (ECWs)––on any Class member, unless such force is objectively necessary to stop the person from causing an immediate threat of physical harm to another person;
d. Using riot control weapons (including those described above) at identified targets if it is reasonably foreseeable that doing so could result in injury to any Class member, unless such force is objectively necessary to stop the person from causing an immediate threat of physical harm to another person;
e. Deploying CS or CN gas canisters, OC spray, or other chemical irritants into a group of people or in residential or commercial areas in a manner that poses a reasonably foreseeable risk of injuring any Class member who is not causing an immediate threat of physical harm to another person;
f. Deploying CS or CN gas canisters, Controlled Noise and Light Distraction Devices (CNLDD), or Less-Lethal Specialty Impact and Chemical Munitions (LLSI-CM) so as to strike any Class member, unless such force is objectively necessary to stop an immediate threat of the person causing serious bodily injury or death to another person;
g. Deploying CS or CN gas canisters, Controlled Noise and Light Distraction Devices (CNLDD), or Less-Lethal Specialty Impact and Chemical Munitions (LLSI-CM) above the head of any Class member, unless such force is objectively necessary to stop an immediate threat of the person causing serious bodily injury or death to another person;
h. Firing Compressed Air Launchers (e.g., PLS and FN303), or Munitions Launchers (e.g., 40mm), or KIPs so as to strike the head, neck, groin, spine, or female breast of any Class member, unless such force is objectively necessary to stop an immediate threat of the person causing serious bodily injury or death to another person;
i. Striking any Class member with a vehicle, unless such force is objectively necessary to stop an immediate threat of the person causing serious bodily injury or death to another person;
j. Using hands-on physical force such as pulling or shoving to the ground, tackling, or body slamming any Class member who is not causing an immediate threat of physical harm to others, unless objectively necessary and proportional to effectuate an apprehension and arrest;
k. Using chokeholds, carotid restraints, neck restraints, or any other restraint technique that applies prolonged pressure to the neck that may restrict blood flow or air passage against any Class member, unless such force is objectively necessary to stop an immediate threat of the person causing serious bodily injury or death to another person;
l. Using any riot control weapon, including those listed in this Order, against any Class member, without first giving at least two separate warnings at a sound level where the targeted individual(s) can reasonably hear it, unless justified by exigent circumstances when immediate action is necessary in order to preserve life or prevent catastrophic outcomes, as defined by Department of Homeland Security Use of Force Policy (updated Feb. 6, 2023), Section XII.E. Such warnings shall explain that Federal Agents may employ riot control weapons or force, give the targeted individual(s) reasonable time to avoid the use of force, and provide a reasonable opportunity to comply;
m. Seizing or arresting any Class member who is not resisting a lawful and authorized crowd dispersal order (as defined in 1.b. above), unless there is specific probable cause to believe that the person has committed a crime for which a custodial arrest is warranted and for which the Federal Agent has lawful authority to make an arrest; and
n. Defendants shall not be liable for violating this injunction if any Class member is incidentally exposed to riot control devices after such a device was deployed in a manner that complies with this injunction.
2. To facilitate the Defendants’ identification of Journalists protected under this Order, the following are examples of indicia of being a Journalist: visual identification as a member of the press, such as by displaying a professional press pass, badge, or credentials; wearing distinctive clothing or patches that identify the wearer as a member of the press; or carrying professional gear such as professional photographic or videography equipment. Other indicia of being a Journalist under this Order include that the person is standing off to the side of a protest, not engaging in chanting, sign holding, or shouting slogans, and is instead documenting protest activities, although these are not requirements. These indicia are illustrative, and a person need not exhibit every indicium to be considered a Journalist under this Order. Defendants shall not be liable for incidental violations of this Order if Defendants establish that the affected individual lacked any of the illustrative indicia of a Journalist described in this provision.
3. It is further ORDERED that all Federal Agents, excepting those who do not wear a uniform or other distinguishing clothing or equipment in the regular performance of their official duties or are engaged in undercover operations in the regular performance of their official duties, must have visible identification of a unique, personally assigned, and recognizable alphanumeric identifier sequence affixed to their uniforms and conspicuously displayed in two separate places. The same unique and personally assigned identifier sequence must remain conspicuously displayed in two separate places despite changes to a Federal Agent’s uniform or tactical gear.
4. It is further ORDERED that all Federal Agents, excepting those who do not wear a uniform or other distinguishing clothing or equipment in the regular performance of their official duties or are engaged in undercover operations in the regular performance of their official duties, that are, have been, or will be equipped and trained with body-worn cameras (“BWCs”) shall activate them when engaged in enforcement activity unless expressly exempted by CBP, ICE, or DHS policy.
a. The definitions of “body worn cameras” shall be as defined in DHS Policy Statement 045-07 Section VIII and CBP Directive 4320-020B Section 6.2: Audio/video/digital recording equipment combined into a single unit and typically worn on clothing or otherwise secured to a person, e.g., affixed to the outside of the carrier/tactical vest facing forward.
b. For the purposes of this Order, the definition of “enforcement activity” shall be as defined in ICE Directive 19010.3 Section (3.6)(8) and CBP Directive 4320-020B Section 6.4. Such activities include but are not limited to: i. ii. iii. iv.
c. Protecting Federal Government facilities; Responding to public disturbances; Interacting with members of the public while conducting Title 8 enforcement activities in the field; and When responding to emergencies. Enforcement activities where BWCs are not required to be worn or activated for the purposes of this Order are: i. ii. iii. iv. v.
d. Where agents are conducting undercover activity or confidential informants will or may be present; Information-gathering surveillance activities where and when an enforcement activity is not planned; Onboard commercial flights; Controlled deliveries; and Custodial interviews conducted inside jails, prisons, detention centers, or DHS owned or leased facilities. This provision requiring BWCs shall not apply to Federal Agents operating at any port of entry into the United States including but not limited to Chicago O’Hare International Airport and Chicago Midway International Airport.
e. Federal Agents shall not be liable for violating this provision (i) for failure to record due to equipment failure beyond the control of Federal Agents, or (ii) in the event that cloud storage for storing recordings made by BWCs should become unavailable, through no fault of Federal Agents, either due to (a) the lapse in appropriations, or (b) license or contract expiration.
5. It is further ORDERED that Defendants widely disseminate notice of this Order. Specifically, Defendants are ORDERED to provide copies of this Order, in either electronic or paper form, no later than 10 p.m. Central Time on November 6, 2025, to all those described below:
a. all law enforcement personnel, officers, and agents of the Federal Agents currently or subsequently deployed in the Northern District of Illinois, including but not limited to all personnel operating within this District who are part of Operation Midway Blitz or any equivalent operation by a different name; and
b. all employees, officers, and agents of Federal Agents with supervisory or management authority over any law enforcement officers or agents currently or subsequently deployed in the Northern District of Illinois, up the chain of command to and including the Secretary of Homeland Security and other named Defendants.
6. It is further ORDERED that Defendants shall issue guidance to officers and agents to implement this Order. Defendants shall file with this Court such guidance and any directives, policies, or regulations implementing the guidance within 5 business days of issuance of the Order, with a continuing obligation to immediately file with this Court any subsequent changes or revisions to that guidance or implementing directives, policies, or regulations through the period of this Order.

Justice Kavanaugh blessed racial profiling, so DHS is racial profiling
An Illinois Department of Transportation employee was stopped by U.S. Immigration and Customs Enforcement agents while working on a Park Ridge construction project Friday morning — and questioned about incoming New York City Mayor Zohran Mamdani before being released.
Gov. JB Pritzker is speaking out about the incident, calling it another example of President Trump and Homeland Security Secretary Kristi Noem “continuing to question U.S. citizens apparently based on the color of their skin.”
The employee, who is Indian and a U.S. citizen, was stopped and questioned by agents while working on the Busse Highway resurfacing project.
Three agents, wearing masks, questioned him about his immigration status - and also asked him if he had traveled to New York and if he was “aware” of the mayor-elect in New York City, the governor’s office said.
“I am appalled they would stop and question a state employee working hard on the job to help improve our state’s roads and infrastructure,” Pritzker said in a statement. “Our state employees should be able to go to work and do their jobs without masked agents targeting them for no legitimate reason.”

masked criminals sowing fear in Chicago
Right now, the city of Chicago does not feel safe for anyone, no matter their status. We’ve seen people being arrested without a warrant, tear gas released near schools, people knocked down and car windows smashed. Make no mistake. These tactics threaten all of us. When one person’s right to due process is taken away, all of us have lost that foundational right. Our Constitution ensures that our laws and legal system operate with equity and fairness and apply to everyone who is on U.S. soil. We are seeing the consequences of actions that sow fear in real time, and this trauma will be with our communities for years.
My family came to the United States with three truths firmly rooted in our minds: There’s no antisemitism in America; America is a country of immigrants and values our contributions; and everyone is subject to the rule and protection of our laws. 2025 is proving us wrong on all three counts, and we’re ever closer to resembling the Soviet Union.

Feds purport to ban prayer in front of and inside their Broadview facility
Is this the Lord's work?
Federal authorities told demonstrators Friday that there would be “no more prayer” in front of or inside the Broadview ICE facility, in a move that mystified local leaders and raised legal questions.
A federal representative delivered the news to a huddle of faith leaders and activists standing outside the Immigration and Customs Enforcement facility Friday, speaking after faith leaders were denied entry to the building for the third time Friday.
Broadview Police Chief Thomas Mills, whose department helped facilitate the phone call, said that he was “trying to figure out” in discussions with Mayor Katrina Thompson and an attorney if a federal agency could legally ban religious gatherings on land owned by the village. Religious groups previously have been allowed to practice outside the facility, he said.
“I’m just a messenger,” an anonymous voice stuttered over the phone to a huddle of faith leaders and activists standing outside the Broadview immigration processing facility on Friday.
During the call, which took place with a Block Club reporter present, the anonymous representative, told a group of faith leaders and activists that “There is no more prayer in front of building or inside the building because this is the state and it’s not [of a] religious background.”

DHS pointing guns at local officials for no reason
Hard to see how this relates to immigration enforcement, tbh
A Waukegan councilman says he faced the guns of four federal immigration enforcement agents Friday while sitting in his car with his hands raised, as he tried to return to work from home after lunch, before they left him alone as people on the street shouted, “He’s the alderman. He’s the alderman.”
Ald. Juan Martinez, 3rd Ward, was briefly detained by U.S. immigration agents while all of them were stopped in traffic on Baldwin Avenue in Waukegan in what he came to believe was an operation by the officers.
While the guns were pointed at him with his hands raised, Martinez said he kept saying, “Don’t kill me. Don’t kill me.”
“My life flashed before my eyes,” he said. “All I could think of was my family was going to be planning my funeral.”
His day started like most. Martinez said he went to work, came home for lunch and began driving on Baldwin Avenue back to his job as he does every day. It was almost 1 p.m. when he ran into a traffic jam.
“I saw the commotion and I stayed in my vehicle,” he said. “I didn’t pay attention to what was happening around me.”
A vehicle was stopped in front of Martinez, and he said he could not see what was in front of him because the vehicle ahead of his was blocking his view. He was worried about being late in returning to work. He said he tapped his horn with a short honk and remained in his car the entire time.
“I waited two or three minutes, and a man wearing a mask came up to me with his gun drawn,” Martinez said. “It was a rifle. He said, ‘Put your hands up or I’ll blow your f—–g face off.’ I told him four or five times, ‘I’m the alderman.'”
While he sat in the car, a second agent came to the other side of the car with what Martinez believed was a handgun.
“They were both yelling at me,” he said. “I was frazzled. I said, ‘Please don’t kill me.’ Then a black vehicle appeared and two more guys got out. They also drew their guns. There were four barrels pointed at me.”

“What happened to me today should never happen to anyone,” Martinez said in the statement. “We deserve accountability, respect and the right to feel safe in our own city.”
Cunningham said in an interview Friday night that it is time to let the police complete their investigation. He knows what he will do when it is done.
“Once they conclude it, I will walk it across the street to the Lake County state’s attorney and get direction from them.”

resistance isn't rebellion, it's self-protection
What the national press is missing is this: Those physical confrontations aren’t protests. They’re a community organizing itself against its own government. In the absence of help from the courts, parents are forming brigades to watch schools during pickup and dropoff. Mutual aid networks established during the pandemic or earlier now serve as broadcast channels for ICE information: How many cars, how many agents, where and what are they doing.
A father on my own block organized work-from-home parents to monitor roofers and landscapers, who are targeted when their employers aren’t home, early in the morning or late in the afternoon. People are paying house cleaners to stay home, or escorting them to and from their cars so they’re not harassed. Residents have stopped grocery delivery after ICE began taking drivers from nearby food stores. Volunteers are putting up anti-ICE signs and telling local businesses not to let ICE park in their lots or eat at their restaurants.
The pressure hangs over everyone: We have to protect one another, because no one else is coming to save us. We have to save each other.

it's 100% legal to move freely in your own city and observe government workers doing their job in public
for some reason DHS agents don't want the public to see who they are or what they're doing
A Fullerton police officer intervened when he saw a man in plain clothes pointing a gun at a female driver on a busy street in Santa Ana. The man later identified himself as an immigration agent and accused the driver of “following him” during an “operation,” a refrain increasingly heard as agents push back on people recording their movements.https://archive.is/20251110193244/https://www.latimes.com/california/story/2025-11-10/ice-agent-points-gun-at-female-fullerton-police-stop-not-knowing-the-identity-of-the-armed-male#selection-3067.0-3067.345

Individual discrimination by national origin is unamerican
Apparently we no longer take refugees from unfree countries -- if they're not South African whites
The Trump admin is planning to say that being from Cuba (or any other travel ban country) is a "significant negative factor" that could lead to a denial of any of several discretionary immigration benefits (like green cards).
Seriously; national origin discrimination as official government policy.

racist thugs harass innocent Americans, spread terror and violence
Diaz, 23, had been walking down Archer Avenue on the Southwest Side in late September, heading toward the CTA Orange Line for a trip downtown. Earbuds in, he was listening to music and said he barely registered the vehicle that pulled up near him. That was until he felt the pain in his shoulder.
Diaz felt confused and disoriented. He couldn’t hear because “Higher Power” by Coldplay was still playing in his ears. But when he craned his neck, and saw more than half a dozen federal agents surrounding him, he understood what was happening.
“I’m Hispanic and I’m dark (skinned), so that’s why they picked me up,” Diaz, a U.S. citizen, said. “It feels scary because I’m wearing a target — you know, pick me up because I’m this color. It shouldn’t be like that.”
Diaz is one of the five U.S. citizens and green card holders the Tribune spoke to who has either been questioned or detained by federal immigration agents during Trump’s Operation Midway Blitz (https://www.chicagotribune.com/2025/11/06/chicago-immigration-enforcement-raids/) for seemingly no other reason than being Latino, an experience they said was equal parts terrifying and frustrating.
A landscaper in Evanston was handcuffed (https://x.com/royalpratt/status/1984346801361862852)until he proved he’s an American citizen. House painters and laborers in the northwest suburbs were asked to show proof of citizenship. (https://www.chicagotribune.com/2025/10/31/chicag-halloween-immigration-raids-evanston/) A woman finishing her shift at a downtown bar zip-tied and questioned for an hour (https://www.chicagotribune.com/2025/10/13/ice-fines-chicago-man-for-not-having-papers-on-him/) because she “doesn’t look like” her last name. An Illinois Department of Transportation employee, who is Indian, questioned if he’s aware of New York City Mayor-elect Zohran Mamdani at a resurfacing project in Park Ridge.
While he was up against the vehicle, Diaz said one of the agents ripped out his earbuds and handcuffed him. He said the masked agents didn’t tell him their names or badge numbers. He worried that they may not even be real agents.
They asked him a series of questions — is he a citizen, does he have a green card, is he here illegally, where was he born, Diaz recalled. He told agents they could check his ID and Social Security card that he’s carried in his wallet since hearing about immigration raids in Los Angeles earlier this year.
While an agent inspected the card, Diaz said he tried to move his sore right arm that was pinned behind his back.
“And one of the agents says, ‘Don’t move. Don’t try to run.’ And I told him, ‘I’m not trying to run. I’m just getting comfortable,’” Diaz said. “He’s like, if you move again, I’m gonna tase you. And he takes out his taser, and points it at my ribs.”

After about five minutes, he said an agent put the cards back in his wallet and threw it on the ground. They then walked to their vehicle and drove away, he said.
“I felt like a piece of trash,” Diaz said. “They’re not even treating me like a human being. They’re treating me like I’m some piece of plastic.”

Willy Aceituno said he’d just left a Charlotte restaurant Saturday morning when federal agents approached him in his pickup, broke a window and stole his keys. “Are you an illegal immigrant?” he said an officer asked in the parking lot outside Pollo Campero, near the intersection of South Boulevard and Archdale Drive. Immigration and Customs Enforcement officers began detaining people at their green card interviews in downtown San Diego this week.
On Wednesday, word spread quickly among immigration attorneys about clients arrested at routine appointments with U.S. Citizenship and Immigration Services that should’ve been the last part of the process to get their green cards for permanent residence in the United States.
“It's pretty shocking honestly,” said Tessa Cabrera, whose client was among those detained. “It's not something we've seen at all.”

Charlotte is wondering why
—
With dozens of people arrested in North Carolina’s largest city during the Department of Homeland Security’s latest targeted immigration blitz (https://www.cnn.com/2025/11/15/us/federal-immigration-raids-begin-in-charlotte), one question has emerged for many of its residents and leaders: Why Charlotte?
The city hadn’t been previously publicly singled out as an enhanced immigration enforcement target by the Trump administration in the same way as other cities like Chicago (https://www.cnn.com/2025/10/17/us/chicago-immigration-crackdown) and Los Angeles (https://www.cnn.com/2025/10/14/us/los-angeles-state-of-emergency-immigration). It’s a Democrat-led city, but it’s hundreds of miles away from either the northern or southern border. And crime has dropped 8% from last year, with violent crimes down 20%, according to data (https://www.charlottenc.gov/cmpd/News-Information/Newsroom/CMPD-Third-Quarter-Report-2025) released by the city in October.
Before it even started, the announcement that an immigration enforcement operation would arrive in Charlotte – right off the heels of a weekslong operation that led to hundreds of arrests (https://www.cnn.com/2025/11/12/us/chicago-ice-arrests-hearing) and fierce protests (https://www.cnn.com/2025/11/10/us/dhs-ice-immigrants-chicago-shooting) in Chicago – provoked fear and anxiety in the city.
Democratic leaders in Charlotte have largely framed the operation – which came as a surprise to local officials – as a political distraction ahead of next year’s midterm elections (https://www.cnn.com/2025/11/03/politics/trump-elections-virginia-new-jersey-new-york-california).
“This administration ran on rhetoric that is anti-immigrant to score political points,” said City Council member Dimple Ajmera, a Democrat. “We have a very important US Senate race in 2026 coming up. And they want to score political points and use fear to divide our community.”

The Court recognizes that the relief sought by the defense is rarely granted. However, the record points to a disturbing pattern of profound investigative missteps, missteps that led an FBI agent and a prosecutor to potentially undermine the integrity of the grand jury proceeding. Therefore, in this case, “the Court has before it a rare example of a criminal defendant who can actually make a ‘particularized and factually based’ showing that grounds exist to support the proposition that irregularities may have occurred in the grand jury proceedings and may justify the dismissal of one or more counts of the indictment.” See Naegele, 474 F. Supp. 2d at 10 (citations omitted).
Accordingly, the defense request for all grand jury materials is granted.
ENTERED this 17th day of November 2025.

The Court need not now determine whether any facts herein have been proven, or whether there is merit to any motion yet to be filed. That task may lie ahead. Rather, the Court is finding that the government’s actions in this case–whether purposeful, reckless, or negligent–raise genuine issues of misconduct, are inextricably linked to the government’s grand jury presentation, and deserve to be fully explored by the defense.

Halligan is having trouble showing her work
(it's her first prosecution -- Halligan's an insurance lawyer)
online lawyers are saying this is about as close as a judge gets to calling the government liars
The short time span between the moment the prosecutor learned that the grand jury rejected one count in the original indictment and the time the prosecutor appeared in court to return the second indictment could not have been sufficient to draft the second indictment, sign the second indictment, present it to the grand jury, provide legal instructions to the grand jury, and give them an opportunity to deliberate and render a decision on the new indictment. If the prosecutor is mistaken about the time she received notification of the grand jury’s vote on the original indictment, and this procedure did take place, then the transcript and audio recording provided to the Court are incomplete.12 If this procedure did not take place, then the Court is in uncharted legal territory in that the indictment returned in open court was not the same charging document presented to and deliberated upon by the grand jury. Either way, this unusual series of events, still not fully explained by the prosecutor’s declaration, calls into question the presumption of regularity generally associated with grand jury proceedings, and provides another genuine issue the defense may raise to challenge the manner in which the government obtained the indictment.
Winehole23
11-17-2025, 05:53 PM
screwiness detected
If the Court is to read the prosecutor’s declaration as suggesting there was no contact between any government official and the grand jury after 4:28 p.m., then it begs the question of how the then-First Assistant learned that the grand jury had refused to indict on one count, and how the First Assistant knew which count had been rejected by the grand jury, all before the indictment was returned in open court.

this law won't pass, but accountability is coming for Trump's lawless secret police
Seizing on allegations of federal law enforcement officials' committing constitutional violations (https://www.nbcnews.com/news/us-news/chicago-court-hearing-focus-allegations-immigration-agents-used-excess-rcna242077) as part of President Donald Trump's immigration crackdown (https://www.nbcnews.com/news/us-news/charlotte-north-carolina-border-patrol-operation-rcna244106), Democrats have launched a new effort to allow civil rights claims against rogue agents.
Lawmakers reintroduced legislation (https://www.nbcnews.com/politics/supreme-court/lawmakers-renew-push-hold-federal-officials-accountable-civil-rights-v-rcna164713) Tuesday that would ensure federal officials, including immigration agents and other law enforcement officers, can be sued individually for constitutional violations.
The bill, introduced in the House and the Senate by Rep. Hank Johnson, D-Ga., and Sen. Sheldon Whitehouse, D-R.I., would amend a post-Civil War-era law that allows such claims against state and local officials to make it clear that federal officials are covered, too.

Jana Brady, an assistant US attorney representing the Department of Homeland Security in the case, did not have much information about what had happened to the footage, and said she was trying to get in touch with contractors the government had hired. She also said the government should not be forced to retain surveillance footage from every camera at the facility and that the “we [the federal government] don’t have the resources to save all of the video footage"https://www.404media.co/ice-says-critical-evidence-in-broadview-abuse-case-was-lost-in-system-crash-a-day-after-it-was-sued/

The first thing they asked Fernando Vazquez was “Where are you from?”
When two unmarked SUVs full of Border Patrol agents arrived Tuesday at the Cary construction site where Vazquez, 18, is employed, the only thing he could think of was to call his dad, another worker on the site. “I just told him, run, and to hide.”
The work at the site was virtually complete, with only around 10 workers present on an average day. Because of absences — with fears of Border Patrol and ICE chilling construction sites across the Triangle (https://ncnewsline.com/2025/11/18/federal-immigration-raids-in-raleigh-impact-one-of-the-citys-largest-projects/) — Vazquez said there were only about four people on the site, part of why he didn’t believe they would be targeted.
“I didn’t believe it would happen to me,” Vazquez said. “I was born here.”

The agents who approached him wore masks, gloves, and dark glasses. At first, Vazquez reserved his right to remain silent, but when one agent began questioning him in Spanish, he started swearing at them “to make time to stall them,” he said. “I’m thinking about the workers and my dad.”
As he tried to step out of the enclosure, he said, Border Patrol agents climbed over the fence to corner him. One yanked an AirPod out of Vazquez’s ear and set it on the AC unit beside him. When Vazquez tried to retrieve it and put it back in the case, he said, the agent shouted, “Don’t touch me.”
“I’m like, ‘I’m not touching you.’ And then he said, ‘If you touch me, there’s going to be a problem,’” Vazquez said.
That was when they handcuffed him and searched him, pulling his wallet out of his pocket.
“They saw my North Carolina Real ID,” he said. “They were looking for an ID or some sort of documentation, so at that moment, they could have let me free. But no, they decided to take me.”
Winehole23
11-21-2025, 07:39 AM
Vazquez was placed in the SUV with one of his fellow workers on the construction site, a young man who was crying. As they drove away, the agents continued to question Vazquez, asking him again where he was from and where he was born as they went through his wallet.
When he told them he was born in Raleigh, the agent questioning him grew angry, Vazquez said. They abruptly pulled off the road into the parking lot of a carpet cleaning company, where they dumped him, a half mile away from where they picked him up, throwing his wallet and cards out of the SUV window as they drove off.
“I have no idea why they just dropped me off,” he added. “I kind of felt like I was being kidnapped.”
His video of Border Patrol uncuffing him and driving away has gone viral on TikTok (https://www.tiktok.com/t/ZP8UdTtGj/), accumulating 3 million views and thousands of concerned comments. In the video, an agent with his face covering lowered appears to lunge at the phone with a raised hand, which Vazquez said he believed was an attempt by the agent to conceal his identity.
As Vazquez left the SUV, the other detainee asked him, “Tell my brother that they got me.”
“It devastated me,” Vazquez said. “It broke my heart to realize how two brothers were being separated in front of my eyes.”

A Rhode Island Superior Court intern was briefly taken into custody by Immigration and Customs Enforcement agents in Providence Thursday afternoon before a judge intervened, according to the state’s Judiciary office.
The student, a high school intern at Superior Court, was reportedly detained by the agents outside the Licht Judicial Complex on Benefit Street.
Superior Court Judge Joseph McBurney insisted the agents had the wrong person. It was not until ICE verified their information and admitted the intern was not their intended target that he was released.
Multiple sources told Target 12 that Rhode Island sheriffs earlier noticed someone taking photos of the intern inside the courthouse and in Superior Court Judge McBurney’s courtroom. When approached, the individual identified himself as an ICE agent and was told to abide by standard courthouse rules, and to stop taking pictures.
The intern was reportedly shaken, so McBurney offered to drive him home. ICE agents then surrounded the judge’s car and demanded everyone to exit the vehicle, threatening to smash in the windows if they did not comply.
Dana Smith, Head of Security Operations for R.I. Superior Court, confronted the agents and told both the judge and the intern to stay inside the car. After an argument, ICE confirmed they had misidentified the teen and left. The intern was released once his ID was checked.

none of the September 27th DHS charges of violence against officers stood up in court
zero
Back on October 8, I noted (https://www.emptywheel.net/2025/10/08/greg-bovinos-january-27-shitshow-batting-18/) that of the eleven people DHS claimed had been arrested at a September 27 protest at the Broadview ICE facility in Chicago, a protest at which Greg Bovino had promised a “shitshow,” the cases of all but one had been dismissed.
Bovino, I noted, was batting just 9% on his claims that protestors had engaged in violence.
Well, yesterday, the case of Dana Briggs, a 70-year old Air Force veteran charged with assault when he fell as officers were pushing him back, was dismissed too (https://storage.courtlistener.com/recap/gov.uscourts.ilnd.487150/gov.uscourts.ilnd.487150.40.0.pdf). He had planned to call Bovino as a witness at his December trial. Bovino’s success rate at substantiating his claim there were any rioters from that day is now zero.
https://www.emptywheel.net/wp-content/uploads/2025/11/Bovino-902x1030.png (https://www.emptywheel.net/wp-content/uploads/2025/11/Bovino.png)
Briggs is not actually the most stunning dismissal from yesterday. The case against Marimar Martinez (and her co-defendant Anthony Ruiz) was also dismissed (https://storage.courtlistener.com/recap/gov.uscourts.ilnd.487595/gov.uscourts.ilnd.487595.69.0.pdf), just before a follow-up hearing on the things the CBP agent, Charles Exum, did and said before and after he shot her.
https://www.emptywheel.net/wp-content/uploads/2025/11/Screenshot-2025-11-21-at-09.58.53.png (https://www.emptywheel.net/wp-content/uploads/2025/11/Screenshot-2025-11-21-at-09.58.53.png)
At a press hearing afterward, Martinez’ attorney Christopher Parente suggested they would still be seeking vindication for her, so hopefully we’ll still get to learn what DOJ dropped the case in hopes of suppressing.
The Magistrate Judge who dismissed Briggs case (who had also signed the arrest warrants for the five actual arrests on September 27), Gabriel Fuentes, wrote a long opinion (https://storage.courtlistener.com/recap/gov.uscourts.ilnd.487150/gov.uscourts.ilnd.487150.43.0.pdf) about the collapse of the September 27 cases.
Examining more closely the five September 27 Broadview criminal arrest cases, all of which came before the undersigned magistrate judge, the Court notes the following facts:
1) The initial complaints charged four (Collins, Robledo, Ivery, and Briggs) of the foregoing five persons with felony violations of Section 111(a). Only the complaint against Mazur was filed as a misdemeanor.
2) With today’s dismissal of the Briggs criminal information, none of these cases remains pending today – all have been dismissed.
3) As the docket entries reflect in all five of the cases, the undersigned magistrate judge obtained a sworn statement from the affiants in each affidavit, at the time of complaint issuance, that not only were the affidavit allegations true, but that video evidence of the encounters existed, that the affiants had reviewed the video evidence, and that the video evidence corroborated the version of events set forth in the affidavits. Mazur (D.E. 11); Collins/Robledo (D.E. 26); Ivery (D.E. 13); and Briggs (D.E. 14).
[snip]
4) Each of the five persons arrested on September 27 from Broadview on Section 111 charges endured official detention (or other government restrictions on their liberty) after their arrests.
[snip]
Importantly, nothing in this order should be construed as scolding the government for dismissing in these cases. Dismissing appears to be the responsible thing for the government to have done, in light of the government’s judgment and discretion. But the Court cannot help but note just how unusual and possibly unprecedented it is for the U.S. Attorney’s Office in this district to charge so hastily that it either could not obtain the indictment in the grand jury or was forced to dismiss upon a conclusion that the case is not provable, in repeated cases of a similar nature. Federal arrest brings federal detention, even for a short time. It brings the need to obtain counsel, to appear at court hearings, to answer the charges (as Briggs did in this case, pleading not guilty), and to prepare for trial (as Briggs also has had to do in this case). Being charged with a federal felony, even if it is later reduced to a misdemeanor, is no walk in the park.

US citizen detained twice in the same morning
DHS officers' contempt for brown complected Americans stands out here as it does elsewhere
Aceituno, 46, was grabbing breakfast before his construction job when he was accosted by border patrol agents. Confident that his U.S. citizenship would protect him from the perils (https://immigrantjustice.org/research/policy-brief-snapshot-of-ice-detention-inhumane-conditions-and-alarming-expansion/) of immigration detention, he bantered back and forth with the agents, figuring any time he could get them to waste would allow others nearby extra time to get away. Those agents, as the New York Times reported (https://www.nytimes.com/2025/11/15/us/us-border-patrol-charlotte-nc-immigration.html), eventually allowed him to go.
But after he got in his truck, a second group of agents rolled in and started to harass him, banging on his window. His friend Karina Sanabria told me Aceituno warned them not to break it because he would demand they pay for it. And then they went ahead and broke the window. Two agents pulled him out and threw him on the ground. A passerby recorded the altercation, imploring the agents to leave Aceituno alone because he had already shown his citizenship documentation to the first group of agents.
“They just ID’d him, don’t you guys fucking coordinate?” the passerby asked.
Aceituno had kept his calm while dealing with agents earlier, but after this second group drove him to the ground and then threw him into a van, he started to get scared. Sanabria told me that another detained immigrant who was in the van wept as they were driven around. When he tried to share his wife’s phone number with Aceituno so that he could call her and let her know where he was, the agents started yelling at both men to shut up.
“They were yelling at them treating them like shit, as if he was one of the worst animals, that’s when he got scared thinking these assholes are going to take me somewhere and no one is ever going to see me again,” said Sanabria, who is part of Latino Tu Voto Cuenta, an electoral-focused group in North Carolina.
After Aceituno again told the agents he was a U.S. citizen, they finally threw him out of the van. By then, he was a twenty-plus-minute walk away from his car, which he still could not drive anywhere because the agents had taken his keys. Eventually, someone from a local advocacy group contacted the agents to get the keys back.
(If you want complicated, here you go (https://www.youtube.com/shorts/kgF4cVkhkcA): Aceituno voted for Trump in 2024 because of the border and the economy. He now calls it “the worst decision of my life.”)

The extraordinary judicial determination is that DHS's word was no good
In each of the five cases, Fuentes pointed out, he obtained sworn statements that “not only were the affidavit allegations true, but that video evidence of the encounters existed, that the affiants had reviewed the video evidence, and that the video evidence corroborated the version of events set forth in the affidavits.”
He pointed to the ruling last month by U.S. District Judge April Perry, questioning federal agents’ “ability to accurately assess the facts.” He noted that Briggs had U.S. Border Patrol Cmdr. Gregory Bovino on his witness list — and that U.S. District Judge Sara Ellis found he “lied multiple times about the events that occurred in Little Village.”
Fuentes called these “extraordinary judicial determinations.”

criminals impersonating Trump's deportation goons is a motif
A church safety director is under arrest after being accused of posing as an ICE agent to extort a woman for money.Donald Doolittle, 58, is charged with impersonating a public servant. He's listed as safety director on the Gateway Community Church of Webster's website and noted he's worked at the church for 10 years in an affidavit filed with the court.
Eyewitness News has learned the victim of the alleged extortion plot is a massage therapist operating out of a northwest Houston office building.
Police say Doolittle booked and received a massage Thursday, but that problems arose when he went to pay.
Officers say Doolittle wanted to pay with a credit card, but that the victim told him she only accepts cash or Zelle payments.
At that point, police say Doolittle pulled out an ID card labelled 'ICE,' identified himself as an ICE agent and said he needed to see the victim's ID.
Police say she complied and showed him her temporary visa, but that he then demanded money.
"He demanded she Zelle him $500 or he would take her away and she would never see her family or children again," a magistrate said during Doolittle's probable cause hearing Saturday.
Zelle is a digital payment network that allows people to send and receive money between bank accounts.
After the victim sent Doolittle the money, police say he texted her that she wouldn't hear from any other ICE agents because he had marked her case for non-prosecution. He also allegedly asked her to delete the text messages.
Police say the victim told her story to officers whom she happened to run into the next day at a luncheon.
When interviewed by investigators, police say Doolittle denied getting a massage or going to the victim's business, but police say surveillance video proved otherwise.

There’s also speculation that AT&T data could have been used by DHS to target people during the shocking raid (https://www.propublica.org/article/chicago-venezuela-immigration-ice-fbi-raids-no-criminal-charges) at the 7500 South Shore Drive residential building raid in Chicago. That raid featured multiple agencies coming from different directions at 1 a.m., including agents rappelling down from a Black Hawk helicopter like it was a Michael Bay movie. I asked AT&T spokespeople if they could confirm or deny the use of the company’s technology and services in the 7500 South Shore Drive raid and they did not respond to multiple requests for comment. No criminal charges (https://www.pbs.org/newshour/show/dramatic-chicago-ice-raid-touted-as-anti-terror-win-results-in-no-criminal-charges) resulted from the raid—it was just an embarrassing, made-for-TV spectacle.https://www.thebulwark.com/p/backlash-brewing-against-companies-home-depot-att

Trump hates Americans and is on the warpath against them
In his second term, Donald Trump has turned a campaign pledge to punish political opponents into a guiding principle of governance.
What began as a provocative rallying cry in March 2023 – “I am your retribution” – has hardened into a sweeping campaign of retaliation against perceived enemies, reshaping federal policy, staffing and law enforcement.
A tally by Reuters reveals the scale: At least 470 people, organizations and institutions have been targeted for retribution since Trump took office – an average of more than one a day. Some were singled out for punishment; others swept up in broader purges of perceived enemies. The count excludes foreign individuals, institutions and governments, as well as federal employees dismissed as part of force reductions.
The Trump vengeance campaign fuses personal vendettas with a drive for cultural and political dominance, Reuters found. His administration has wielded executive power to punish perceived foes – firing prosecutors who investigated his bid to overturn the 2020 election, ordering punishments of media organizations seen as hostile, penalizing law firms tied to opponents, and sidelining civil servants who question his policies. Many of those actions face legal challenges.
At the same time, Trump and his appointees have used the government to enforce ideology: ousting military leaders deemed “woke,” slashing funds for cultural institutions held to be divisive, and freezing research grants to universities that embraced diversity initiatives.

racial profiling leads to detentions of Native Americans
Our most-read article (https://nativenewsonline.net/currents/indigenous-actor-elaine-miles-reports-detention-by-alleged-ice-agents) on Native News Online this week involved Native American actress Elaine Miles, who was detained by four ICE agents while walking to a bus stop in Redmond, Wash., near Seattle.
Best known for her role as Marilyn Whirlwind in the television series Northern Exposure and in films such as Smoke Signals and The Business of Fancydancing, Miles is a card-carrying member of the Confederated Tribes of the Umatilla Indian Reservation.
According to what she shared with The Seattle Times, she did exactly what any citizen should do — she presented her federally recognized tribal ID when ICE agents demanded identification.
That should have been the end of it.
For those of us who are citizens of federally recognized tribes, a tribal ID is our primary form of identification. I have used mine to get past TSA agents at airports. Miles has used hers to cross international borders. Federal agencies accept it. Yet one of the agents told her the card was “fake.” Another said, “Anyone can make that.”
Miles said both her son and her uncle were previously detained by ICE agents who initially refused to accept their tribal IDs before eventually releasing them.
“What we’re talking about here is racial profiling,” Seattle-based Indigenous rights attorney Gabriel Galanda, who is not representing Miles, told The Seattle Times. “People are getting pulled over or detained on the street because of the dark color of their skin.”
In another story Native News Online (https://nativenewsonline.net/currents/native-american-nearly-deported-after-polk-county-jail-issues-ice-detainer-by-mistake) earlier this month, Salt River Pima-Maricopa tribal citizen Leticia Jacobo was jailed in a small town in Iowa.
Jacobo was booked into the Polk County Jail in Des Moines in September on a charge of driving with a suspended license. She was set to walk free on Nov. 11, but what should have been a routine release was thrown into chaos — and delayed — after jail staff flagged her with an ICE detainer that never should have existed.
Jacobo’s sister questioned authorities: “How is she going to get deported if she’s a Native American?”
Both stories reveal a disturbing pattern. Separated by hundreds of miles and different circumstances, they share the same core problem: When federal or local authorities disregard tribal identification, they disregard tribal sovereignty. And when they dismiss our sovereignty, Native people pay the price — in fear, humiliation, and unjust detention.

A woman in medical scrubs who was driving on U.S. 1 in the Florida Keys Wednesday morning was stopped by federal immigration agents and forcibly removed from her car, despite screaming she was an American citizen.
About 9:15 a.m. in Key Largo, in front of the Pink Plaza at mile marker 103.4, federal agents stopped the woman driving a white Toyota Corolla and surrounded the vehicle. Video recorded by a Miami Herald reporter shows an agent pulling the woman from her car. Agents with ICE, CBP and U.S Border Patrol could be seen. She can be heard screaming as agents attempted to handcuff her.
“I’m a U.S. citizen, please help me,” she shouted after agents forced her to the ground. “This is unfair. Why are you doing this to me?”
Agents then placed her in a patrol vehicle. She was released a short time later. https://www.miamiherald.com/news/local/community/florida-keys/article313356223.html#storylink=cpy

detaining people without particularized probable cause is unlawful
After agents removed the woman from her car, they found her driver’s license in the vehicle, ran it through their system and confirmed she is a U.S. citizen, Regalado said.
He would not specify the criteria agents were using to justify pulling people over during the operation, which has been ongoing in the Key Largo area for the past few weeks.
“We can’t go into specifics bout what we’re going to look for,” Regalado said.

the frequency of this happening suggests the point of immigration sweeps is to intimidate US citizens
but it could have the opposite effect
A video obtained by CNN appears to show masked federal agents chasing a 22-year-old woman, who says she's a U.S.-born citizen, back to her home in Marrero.
The woman — identified as Jacelynn—told CNN she was born and raised in Marrero. She said she was walking home from the grocery store when the agents tried to approach her.
She is seen running toward her front door as agents emerge from nearby unmarked vehicles and follow her, and she can be heard telling them to leave her alone.
“I got spooked by how fast they pulled up,” Jacelynn told CNN. (https://www.cnn.com/us/live-news/immigration-enforcement-minnesota-nola-12-04-25)“Two people came out, and they were like ‘Ma’am, ma’am, come here, please,’ and I kept yelling at them saying, ‘I’m legal! I’m a US born citizen! Please, leave me alone! I’m going home, my daughter is in the house. My baby is waiting for me!’”
“They were trying to tell me to wait, but I did not trust them one bit, especially since I’m a woman and I’m alone, and they are masked men surrounding me,” Jacelynn added. “I tried to walk away, then another car pulled up, and a bunch of men hopped out, which was even more scary for me, so I ran, and he chased after me.”
The video then shows her stepfather confronting the agents. After a brief exchange, they return to their vehicles and drive off.
It’s still unclear why the agents targeted her. CNN and WWL have requested more information from the Department of Homeland Security.
“I just don’t understand how they’re allowed to do that. It’s harassment and attempted kidnapping. I felt like he kept trying to get closer to grab me because when I ran and looked back, he had his arms out,” Jacelynn told CNN.

DHS is out of control
On November 16, after Martinez photographed federal agents in public places around the city, Border Patrol officers stopped his car and told him to step out “voluntarily.” When Martinez refused and drove away, agents chased him for nearly two miles through busy streets.
Video (https://www.charlotteobserver.com/news/local/crime/article313010544.html) shows ICE agents suggesting smashing Martinez’s vehicle and imagining him being shot. They laughed that the chase was “fun,” even as Martinez swerved into oncoming traffic and medians to avoid crashes. Martinez was arrested and charged with two felonies. A court later dismissed (https://www.wfae.org/crime-justice/2025-12-01/judge-dismisses-more-serious-charge-against-u-s-citizen-arrested-by-cbp) the charge accusing him of using his vehicle as a deadly weapon, finding that it was federal agents who tried to hit Martinez with their vehicles, not the other way around.

evil bigots tearing American families and communities apart
Thi Bui, a resident who was born at the end of the war, came to the U.S. as a refugee at age 3 and lives in New Orleans. She told Scripps News this DHS operation feels like a betrayal for the community that has sought refuge here and has had a significant cultural impact on cities like New Orleans.
"The folks who came here in the 70s were allies of the U.S. in a proxy war that the U.S. got involved in, you know, probably shouldn't have gotten involved in, but because the U.S. was there, now the refugees of that war have to come here," she said. "And they rebuilt their lives from scratch, and now this is their home. It's been over 50 years that the Vietnamese have been in the U.S. and in New Orleans. They've raised families, opened businesses, become part of the culture, the fabric of this country. And now they're getting ripped apart. Their families are getting torn apart. They are in a constant state of dread. And it's really hard to live like that."

racist thugs targeting Americans based on skin tint
If you rolled past Bedrosian Park after the final bell rang at Waukegan High School on any given weekday this fall, you were likely to find Diego Rosales and his mop of unruly black hair, basketball in hand, permanently grinning and playing down to the level of local middle-schoolers. Until Oct. 6, when Rosales watched two dark SUVs come to an abrupt stop while he waited for the bus to school.
Rosales brought his eyeglasses to his nose just in time to see three White men in green fatigues, cloth masks and body armor emerging from the vehicles with pistols on their hips. They stared and then rushed toward him.
His first thought was to run home to his mother. She had warned him that even though he was a U.S. citizen, born in this city on the northern outskirts of Chicago 15 years ago, the streets were no longer safe for people who looked like him. Federal agents had arrived in the Chicago area and were arresting people first and asking questions later, she told him.
Surveillance footage from a nearby school captured Rosales in full sprint, curving around a building and through a parking lot, backpack in hand, the agents trailing by a stride. After a three-block race, they tackled the teenager to the pavement and shouted a question:
“Where were you born?”
Rosales didn’t return to Bedrosian Park in October, refusing to leave his home for fear of meeting immigration agents again. The Department of Homeland Security’s Operation Midway Blitz (https://www.washingtonpost.com/immigration/2025/09/08/ice-midway-blitz-chicago-trump/) was still in full force. And while Secretary Kristi L. Noem recently said no U.S. citizens were detained in the crackdown, Rosales and numerous other Latinos in the Chicago area say their experiences show that is not true. Some, like Rosales, were stopped for no apparent reason than for officers to question their status in the United States.
How many U.S. citizens were stopped or arrested during Midway Blitz and other recent enforcement operations is not known. DHS did not respond to requests for comment on the incidents described in this story and has not provided any figures. The Washington Post identified several cases of U.S. citizens being targeted by immigration enforcement agents that are documented in video and witness accounts. Lawyers and community leaders said there are many others involving people too frightened to come forward.
Some of those targeted now wonder if there is still a place for them in the U.S.
“I’m disappointed about what America has come down to,” Rosales said. “I thought the president was supposed to protect us, but he only made things worse for Hispanics.”
The Supreme Court recently cleared a path for immigration officers (https://www.washingtonpost.com/politics/2025/09/08/supreme-court-lifts-limits-immigration-raids-los-angeles-area/) to use skin color as a factor in determining whom to stop and ask about their legal status, stretching DHS powers far beyond that of traditional policing guardrails. Justice Brett M. Kavanaugh wrote that if lawful residents were picked up in raids, their detention would only result in a temporary inconvenience. Officers would see that they were in the country legally and release them.
But in Chicago and elsewhere, Latino U.S. citizens and lawful residents describe being detained for hours, and in some cases, days. Others were not detained, but say they were assaulted because of the color of their skin.
Upon being tackled, Rosales stammered that he was a U.S. citizen, born in Waukegan. And then, just as abruptly as the agents entered his world, he said, they vanished.

DHS sued for indiscriminate use of chemical irritants in Portland
The Trump administration has been sued over claims federal agents harmed families by firing chemical agents near an apartment building as part of an attempt by Homeland Security Secretary Kristi Noem to impress conservative influencers.
Since the summer, the use of force by Immigration and Customs Enforcement agents has escalated around a federal facility in Portland, Oregon, with the deployment of tear gas, pepper balls, and chaotic tactics that even hit peaceful crowds. A new lawsuit alleges that their use has affected residents living near the facility.
https://www.thedailybeast.com/resizer/v2/OZCMNIAE3NAV3BJONFAMVJ2GCM.jpg?auth=6e22b5b27274d7 b21f2d7a7666fe3aa8987fb3088c732a63ef5c64469a1f8daa&width=800&height=533A resident of the Gray's Landing apartment building directly across the street from the Portland Immigration and Customs Enforcement facility shields his eyes as officers confront protesters on June 19, 2025.Jan Sonnenmair/Jan Sonnenmair/Getty Images
The complaint (https://katu.com/resources/pdf/cc64fb1a-c806-4039-be5b-00c042ec0b5b-reachvdhscomplaint.pdf#toolbar=0&navpanes=0&scrollbar=0), filed Dec. 5 by REACH Community Development and nine residents of Gray’s Landing in Portland, Oregon, argues that, for the past six months, federal agents have “indiscriminately deploy[ed tear gas], smoke grenades, pepper balls, and other chemical agents in mass volume,” with fumes that “seep through windows and vents, accumulate in hallways and bedrooms, and bind to walls, carpets, clothing, furniture, and children’s toys.”
It details yellow gas clouds, persistent coughs, burning eyes and throats, dizziness, and headaches.

Some deployments were “not to address any real danger,” according to the complaint, but to ”put on a show for conservative ‘influencers’” who had been invited by Homeland Security Secretary Kristi Noem and DHS to the ICE facility “to film the protests for propaganda purposes.”
They have included (https://www.opb.org/article/2025/10/11/right-wing-influencers-shape-nation-and-trumps-understanding-of-portland-protests/) Benny Johnson, a pro-Trump social media personality from Florida, with 4 million X followers, and Trump ally Nick Sortor, who were mocked (https://www.thedailybeast.com/gavin-newsom-trolls-ice-barbie-kristi-noem-war-zone-stunt/) in October after filming Noem on the roof of the facility looking down at what Johnson called an “army of antifa,” but was actually just two small groups of peaceful protesters—and a man in a chicken suit. The deployment of munitions is said to have left children at Gray’s Landing living in fear, led some people living there to fall ill, while military veterans and domestic violence survivors living with PTSD said that “each gassing…serves as a new triggering event," the filing says.
“The sudden, loud explosions next to their apartments, and plumes of gas and other chemical agents, provoke horrifying PTSD reactions. Other residents have experienced extreme anxiety and panic attacks from the gases invading their homes,” it reads.
https://www.thedailybeast.com/resizer/v2/LGKNOKNIANOAJHGY7TWCIOZECM.jpg?auth=881671d2132d32 fd4139f5c8ba0d296472292f0d01a2b66142cad88f4314e016&width=800&height=533Oregon Police wearing anti-riot gear march towards protesters through tear gas smoke during the 100th day and night of protests against racism and police brutality in Portland, Oregon, on September 5, 2025.ALLISON DINNER/AFP/Getty
The complaint alleges that the actions by federal agents are also unconstitutional: “It should go without saying that, under our Constitution, the federal government may not knowingly release poison gas into the homes of citizens who are simply trying to go about their lives.”
Yet the suit alleges that federal agents “shoot their munitions directly toward Gray’s Landing,” knowing that the building “is in the line of fire and that its residents will be exposed,” although they “do not care.”
When a building representative confronted agents about the impact on residents, the suit claims, “the officers laughed and told her that they only use gases that are ‘environmentally friendly.’” It also alleges officers fired “pepper bullets into the backs of retreating protesters.”

One resident, Jane Doe, a domestic abuse survivor “once…shot in the head at point-blank range by her abuser,” alleges the blasts and fumes “trigger a horrific panic.” Whitfield Taylor lives about 100 feet from the ICE facility with his daughters, ages 7 and 9, and the suit says the girls “sometimes sleep in their father’s closet to feel some sense of safety.”

Air Force veteran Susan Dooley, 72, who served during the Vietnam War, alleges repeated exposures in her west-facing unit. Resident Mindy King, who lives with her 13-year-old son, recorded tear-gas deployments from her apartment of ten years.
The ordinary rituals of home life—“opening a window, stepping onto a balcony, letting a child sleep in her own bed”—have become “sources of danger and anxiety,” the suit says.

The filing seeks declaratory and injunctive relief to halt what it calls the government’s “shocking and unconstitutional poisoning.”
The lawsuit also notes broader collateral fallout. The Cottonwood School of Civics and Science, located across the street, was, it says, “forced to permanently relocate over the summer” because chemical munitions made the area unsafe.

abuse and illegal detention of US citizens is becoming routine
On Tuesday, December 9, 2025 at 3 PM ET in 216 Hart Senate Office Building in Washington, DC, U.S. Senator Richard Blumenthal (D-CT), Ranking Member of the Senate Permanent Subcommittee on Investigations, and U.S. Representative Robert Garcia (D-CA), Ranking Member of the House Committee on Oversight and Government Reform, will hold a bicameral public forum to receive testimony from five U.S. citizens who have experienced unconstitutional detentions by agents of the Department of Homeland Security (DHS).DHS continues to lie about its treatment of American citizens. In October, Secretary of Homeland Security Kristi Noem falsely claimed, “[t]here’s no American citizens that have been arrested or detained” and the account @DHSgov posted just last week, “ICE does NOT arrest or deport U.S. citizens.”On Tuesday, the following Americans will share their personal experiences being assaulted, detained, and denied their constitutional rights by DHS agents:
Wilmer Chavarria (Vermont): Mr. Chavarria, a school superintendent, was detained after returning to the U.S. from visiting family overseas, interrogated for hours, and had his personal and professional devices searched without his consent.
Dayanne Figueroa (Illinois): Ms. Figueroa was sideswiped while driving to work and then violently pulled from her car by DHS agents; while detained for hours, she suffered internal trauma, having recently undergone two kidney surgeries weeks before the incident, as well as injuries to her wrists from being handcuffed.
Javier Ramirez (California): Mr. Ramirez was violently assaulted by DHS agents and held for four days, where he was denied adequate treatment for diabetes, leading to severe complications.
George Retes (California): Mr. Retes is a U.S. Army veteran who was violently arrested and detained during a raid at his job site in Southern California and detained for three days, during which he was refused the ability to contact his family during this time, and missed his daughter’s birthday.

4 US citizens detained by ICE after breaking down their door, allegedly without any warrant, 7 year old child left in home without family
Insane levels of violence for administrative violations
On Saturday, U.S. Immigration and Customs Enforcement agents raided a home in Burnsville and detained four people, according to family members at the house.
Ring camera footage shows more than a dozen agents at the front door of the home on McAndrews Road.
"They just kept banging on the door until they broke it down," said Sofia Alvarado, through an interpreter. Alvarado's husband owns the home and they rent the lower level.
Damage could be seen not only on the front door but also on multiple doors throughout the home on both levels.
Alvarado heard banging and she, along with three other family members on the upper floor, hid in the bathroom, not knowing who was at the door.
Angel, Sofia's brother, said ICE agents took his sister, mom, daughter and niece into the kitchen and made them hand over their phones.
"They all were scared, crying... they were pointing with the guns not to move," Angel said.

About a dozen ICE agents were captured on a Ring camera before raiding a Burnsville home.
He said all four are U.S. citizens and were able to show their paperwork to ICE eventually.
Sofia said it all started when the couple renting on the lower level was headed home from the grocery store. According to Sofia, the couple was followed home by ICE agents.
Ring camera footage shows ICE agents detaining the man while the woman runs away. Family said she ran into the house and hid with her 7-year-old boy.
On Sunday, a large hole could be seen through the bedroom door. Sofia and other family members at the house said ICE agents detained both of the 7-year-olds' parents and that his father has a work permit.

A hole can be seen in the downstairs bedroom after ICE agents raided the home on Saturday.
Sofia says ICE also detained another man downstairs and a fourth man, a father to two kids with a third child on the way.
His wife, who asked to remain anonymous for safety reasons, is six months pregnant.
"She said as soon as her husband walked out of the room, she didn't see him again," an interpreter told KARE 11.
She hid with her 7-year-old daughter and 1-and-a-half-year-old boy.
"When she went out, they were pointing their guns at her," an interpreter said.
She said the family is here illegally from Honduras for work and that ICE told her to voluntarily self-deport.
A translator said, "She said that if you can have someone help her... have her husband come back home because in the state that she is in with two kids and one more on the way, she thinks it's going to be very hard for her."
She is also now taking care of the 7-year-old boy while they wait to find out what will happen to his parents.
The families at the house claimed ICE entered the home without showing a warrant. KARE 11 has not been able to independently confirm that, but we have reached out to the Department of Homeland Security and are waiting to hear back.
The city of Burnsville put out a statement on Sunday:
We are actively monitoring federal immigration activity in our city. Federal government agents have been present to carry out immigration enforcement operations. We know this has created fear and uncertainty for many in our community.
Burnsville Police do not engage in federal immigration enforcement and are typically not notified of federal operations. Burnsville police officers enforce only state and local laws. Burnsville Police do not check someone's immigration status. Our role is to keep everyone in our community safe. If gatherings or protests occur in response to federal actions, our officers may respond to ensure safety for everyone present.
Over the last week, city staff have been in contact with impacted community leaders and groups to offer support, hear and address their concerns and provide accurate information and resources. That work will continue.
You should never hesitate to call 911 if you witness or are a victim of a crime, regardless of your immigration status. To everyone in our community, your safety and wellbeing is always our focus.

administrative detention of US citizens for asking questions and observing is becoming routine
A 55-year-old woman who is an American citizen was arrested early Tuesday after confronting ICE officers over the arrests of three of her neighbors in the Willard Hay neighborhood of north Minneapolis. She appears to be the first observer arrested by federal law enforcement officers since the agency launched an immigration surge in the Twin Cities last Monday.
ICE spokespeople did not respond to a request for comment or confirm the arrests.
Susan Tincher was awakened a little before 6:30 a.m. by alerts on her phone that an ICE arrest was happening in her neighborhood. She walked over alone and asked one of the officers across the street from the home that was being raided if they were ICE. She said the officer told her to “get back.” Tincher refused, and said multiple agents approached her.
Federal law (https://www.law.cornell.edu/uscode/text/18/111)makes it a crime for anyone who “forcibly assaults, resists, opposes, impedes, intimidates or interferes” with a federal law enforcement agent while they’re conducting their duties. Tincher, a white woman in her mid-50s who stands 5’ 4” tall, insists she was at speaking distance from the agent and said that she did nothing to “impede” their actions.
“Pretty soon they were throwing me on the ground and handcuffing me and putting me in their unmarked truck,” Tincher said, estimating that the whole interaction just took a few seconds. “There were other watchers, who were asking me what my name was and everything, so I identified myself to them, then I started yelling, ‘Help!’ because I was being kidnapped.”
Video shared with MPR News shows three officers escorting Tincher to an unmarked truck as observers yell, “Where are you taking her?” Agents don’t appear to respond.
Tincher said agents told her in the truck that if she didn’t watch herself “they were going to pull me over to the side of the road and give me this OC,” law enforcement shorthand for pepper spray

so is US citizens standing up for themselves
A convenience store manager in Kenner locked a group of Border Patrol agents out as they approached the store on Saturday. In a cell phone video he took of the incident, the group appears to be with the agency’s commander, Gregory Bovino.
“You want some chicken? You ain’t getting it here, bro,” Wayne Davis can be heard taunting the agents through the door.
Davis is an assistant manager of the Brother’s convenience store in Kenner where the incident happened.
He said he was helping a customer when he saw two unmarked SUVs speed into the parking lot and stop in front of the store. Agents came out wearing Border Patrol vests.
“The customer asked me, ‘that's ICE?’ and I said, ‘yeah,” said Davis. “He goes, ‘oh s***.’” (Note: Border Patrol is leading the current enforcement operation and is a different agency than ICE, though they are both part of the Department of Homeland Security and often share similar duties)
Davis locked the door from behind the counter as the agents approached. “They're trying to open it, open it, open it. And they're looking at me like, ‘what's going on?’” he said.
Then, he began filming on his cell phone. In the video, he can be seen raising his middle finger at the agents then approaching the door. “Go somewhere else,” he can be heard saying through the door.
One of the people outside of the door turned away as the Davis approached with his phone up. It appeared to be Gregory Bovino, commander of Border Patrol, who has been in the New Orleans area as part of the operation. (https://www.wwltv.com/article/news/politics/immigration-news/immigration-enforcement/border-patrol-chief-seen-in-kenner-as-mayor-elect-moreno-presses-for-transparency-on-federal-ops/289-b5b152c6-9b57-4416-82d6-b518fc2e5c65)
“It took me a second to realize it was him,” Davis told WWL Louisiana.
The video continues with more taunts. “Dang, you don’t want to show your face now? I know you can hear me,” Davis can be heard saying to the masked agents.
A new state law makes it a crime to interfere with federal immigration enforcement activity. However, immigration attorney Michael Gahagan said it would not apply in this scenario, as businesses generally have the right to keep people off of their premises.
“It's their properties, their private property, forbidding you from coming in is not the same as preventing [agents] from doing their job,” said Gahagan in an interview Monday.
He said agents can only force their way onto private property with a specific type of warrant.
“They need to go to a state or federal judge and get a search warrant to arrest somebody inside the building, signed by a judge after a probable cause hearing,” he said.
Davis said he knew that when he locked the door. He told WWL Louisiana he has been researching what rights businesses have during immigration enforcement operations in case agents were to show up at his store.
“I'm not going to let them do what they think they can do,” he said, “because they can't.”
About a minute into the video, the agents and Bovino are seen getting into the SUVs and driving away. “Bye-bye,” Davis can be heard saying as he waves in front of the camera, then adds, “f*** you.”

Illinois standing up for Illinoisans against a cruel and oppressive government
Gov. JB Pritzker on Tuesday signed into law a ban on federal agents making certain arrests near courthouses and easing a path for individuals to sue if they think their rights were violated during civil immigration arrests, capping off months of resistance to the Trump administration’s sometimes-violent enforcement crackdown (https://www.chicagotribune.com/2025/12/06/immigration-agents-use-tear-gas-on-crowd-in-elgin/) in Chicago and the suburbs.
“We know that this new set of laws can’t mitigate all of the harm,” Pritzker said at a bill signing ceremony in La Villita Community Church in Little Village, “but it gives us new protective tools and is a symbol of our shared action against those terrorizing our communities and our state.”

shackled for hours, wedding ring cut off for observing feds and talking to them
It was at about noon that Jim Tincher learned that his wife was being released. He picked her up at the Whipple Federal Building.
Tincher has marks on her neck and wrist from where agents restrained her. Agents cut off her wedding ring and held her in leg shackles at Whipple Federal Building for about five hours, where she saw about seven other detainees.
Tincher said she’s even more motivated after her arrest to volunteer to support immigrants in her community.
“I’m just so concerned about our neighbors, our peaceable neighbors, being abducted, and the worries their families are going through,” Tincher said. “I just don't want this to be happening in our country.”

California federalization blocked, National Guard troops return to the control of Gov. Newsom
Judge called bullshit on the pretext, citing blocked federalizations in Illinois and Oregon. It's a fact pattern now.
The Founders designed our government to be a system of checks and balances.1 Defendants, however, make clear that the only check they want is a blank one. Six months after they first federalized the California National Guard, Defendants still retain control of approximately 300 Guardsmen, despite no evidence that execution of federal law is impeded in any way—let alone significantly. What’s more, Defendants have sent California Guardsmen into other states, effectively creating a national police force made up of state troops. In response to Plaintiffs’ motion to enjoin this conduct, Defendants take the position that, after a valid initial federalization, all subsequent re-federalizations are completely, and forever, unreviewable by the courts. Defendants’ position is contrary to law. Accordingly, the Court ENJOINS Defendants’ federalization of California National Guard troops.https://www.courtlistener.com/docket/70496361/225/newsom-v-trump/

The Court STAYS this order until noon on Monday, December 15, 2025.
Plaintiffs are ORDERED to post a nominal bond of $100 within 24 hours. The bond shall be filed in the Clerk’s Office and be deposited into the registry of the Court.

another US citizen arrested, manhandled and taunted by ICE
more blatantly unconstitutional conduct
What we know:
The woman was arrested while running an errand near Nicollet Mall in downtown Minneapolis. Her cousin said she was confronted by multiple federal agents, who zip-tied her and brought her to the Sherburne County Jail in Elk River.
He also said the agents mocked her hijab and touched her inappropriately. The woman was released on Thursday after more than 24 hours in custody. She was let go after her husband showed authorities her passport card, proving her citizenship, he said.
The woman was too shaken up to speak publicly, he said.
What they're saying:
"'What could you be hiding under your hijab?’ and stuff like that. And then they even made a joke, saying, ‘This would be the wrong attire to try and run away from us in,’" he said of his cousin’s interaction with federal authorities. "I feel upset. Obviously, it brings me a lot of anxiety and stress because this is my family, and I call Minnesota home."

US citizen put in a headlock, tackled in the snow, detained and fingerprinted, not permitted to show his US passport
A Minneapolis man said federal immigration officers chased him on foot in the Cedar-Riverside neighborhood Tuesday, tackled him and handcuffed and arrested him even though he’s a U.S. citizen.
He shared his story Tuesday, identifying himself as Mubashir, but declining to share his last name. Mubashir spoke at a news conference organized by the Minnesota chapter of the Council on American-Islamic Relations (CAIR-MN) after video of his arrest was widely viewed on social media.
“I just felt targeted,” Mubashir said. “That shouldn’t happen to anyone, that’s not right.”
In the video, a federal officer is seen putting Mubashir in a choke hold and forcing him onto his knees in the snow as he was on his way to get food. Mubashir said he told officers multiple times that he is a U.S. citizen and asked if he could show them his I.D. Officers ignored him, dragged him in the snow and pushed him into a car as witnesses yelled and blew whistles, according to the video of his arrest.
The video also showed witnesses chasing after the car in traffic; one person stood in front of the vehicle at one point.
The arrest occurred as federal agents walked into nearby businesses in the Somali-heavy neighborhood, questioning people and asking them to show their passports.
Mubashir said he was in the car with officers for about 20 minutes, asking them repeatedly if he could show them his I.D. They refused, he said.

Officers asked if they could take a picture of him to check if he was a U.S. citizen. Mubashir told reporters that he declined their request, because, “How would a picture prove I’m a U.S. citizen?”
Officers took him to the Bishop Henry Whipple Federal Building at Fort Snelling, which houses immigration court and U.S. Immigration and Customs Enforcement offices. They took his fingerprints and then one of the officers allowed Mubashir to show his I.D., proving his U.S. citizenship, Mubashir said. He was then immediately allowed to leave.
Mubashir said he asked if the officers could take him home to Cedar-Riverside, but they refused. They told him to walk home, he said, so his parents picked him up.
“I deserve to be here like anyone else — I’m a U.S. citizen,” he said. “I can’t even step outside without being tackled — no question — because I’m Somali.”
Mubashir has lived in Minneapolis since he was a year old, according to a newsletter published by Minneapolis City Council Member Jamal Osman.

ICE calls for back up in a panic, receives police escort
Minneapolis police said in a statement that they responded to an “officer needs help” call, but confirmed that no one was being assaulted and that no “life-safety conditions” warranted further officer involvement. A spokesperson said Minneapolis police left the scene within 10 minutes.

The Hennepin County Sheriff’s Office said in a statement that deputies didn’t witness any attacks on agents or any injured agents. Deputies helped agents leave the scene but did not make any arrests themselves or deploy any chemical munitions, according to the statement.

is it a free country when people are afraid to leave their houses?
The MPD has reported success—large declines in serious crimes reported since the feds arrived. The feds are getting something out of the arrangement, too; local cops are chauffeuring Immigration and Customs Enforcement (ICE) officers around town, leaving many immigrant families afraid to leave their homes. Some refer to the task force as “the occupation” and say the feds are using the crime issue as a Trojan horse. “I feel nervous—I have to protect them and myself,” Diego’s 12-year-old daughter tells me as she sits beside her parents in the dark.
“I’ve lived here for a long time,” Diego adds, “and I’ve never seen so many police cars.”
Neither have I. Though I’m new to Memphis, I’ve been reporting on the criminal justice system for more than a decade and have spent time in cities with a lot of law enforcement. I’ve also lived in an authoritarian country overseas, yet I’ve never experienced a police presence like this. Some Memphians critical of the surge liken the city to a war zone, with helicopters circling over neighborhoods, National Guard officers patrolling downtown, and unmarked law enforcement vehicles in the streets. Immigrant citizens carry their US passports, lest they be detained. One volunteer I spoke with compared the vibe to 1930s Germany.
Tennessee Gov. Bill Lee, a Republican, has welcomed the task force, and Memphis Mayor Paul Young, a Democrat, has cooperated, crediting (https://content.govdelivery.com/accounts/TNMEMPHIS/bulletins/3fc4e88) the effort for reducing 911 calls about gun violence. But Shelby County Mayor Lee Harris, another Democrat, compares occupied Memphis to a failed state. “Our risk is that [America is] gonna become a Yemen or a North Korea, or something else altogether, where there is an armed individual with a semi-automatic weapon and military fatigues on many corners,” he told me. “There may be zero crime, but we also won’t be leaving our houses. I know that’s a dark scenario, but that’s kind of where we are.”

another US citizen detained, Dulce Consuelo Diaz Morales
“The thing that’s been the most difficult so far is that, in all of our interactions with the government, they’re denying that any of her birth certificates, which are from Laurel, Maryland, her records of immunization, medical records — they’re denying the authenticity of them,” Perez said.
“It is something I’ve never encountered in all my work as an attorney,” Perez said. “It’s infuriating.”
Diaz Morales’ situation is somewhat unusual. After being born in Maryland, she went to Mexico as a child but never obtained a U.S. passport. At some point, she entered the United States without documentation, fleeing what her attorneys described as an emergency, life-or-death situation. Diaz Morales’ father referenced the danger posed by Jalisco Nueva Generación, a cartel.
Reentering the country without documentation does not affect whether someone is a U.S. citizen, Diaz Morales’ attorneys noted.
“If you’re a United States citizen — which she is, she was born a United States citizen — you have the right to return to the country,” Perez said. “She’s never been denaturalized. I want to be very, very clear on that.”

warrantless invasion of property for needlessly violent arrests
WHEN LEO FELER GOT HOME, there was blood everywhere. On his front door, the window sills, the foyer. This wasn’t some tragic accident or a murder scene; rather, while he was out of town to run a marathon, immigration agents had decided to attack the workers replacing windows on his house.
Footage from Ringsurveillance cameras around the house, as well as cell-phone videos from protesters outside, tells the story: Masked agents sent to Chicago as part of “Operation Midway Blitz” saw workers taking items to a dumpster in front of Feler’s home. The agents then hopped his locked gate. They trampled his property, aggressively manhandled at least one worker, and entered Feler’s garage. They even tried to pull a bleeding worker out of a second-story window.
They did it all without ever presenting badges, identification, or a warrant.
“It was violent. There’s blood all over the house. It’s insane,” Feler, who is a U.S. citizen, told me the day after this happened in October (https://www.youtube.com/watch?v=f7NuB33XwqA). “It’s complete lawlessness. How does the government have impunity to jump into my home without a warrant?”
As far as Feler has been able to discern, his house and the crew working on it were targeted at random. The Department of Homeland Security did not reply to detailed questions about agents’ actions or why they were there, but did send me a statement complaining about “agitators” (i.e., protesters) in the street who “obstructed federal law enforcement and ignored multiple warnings to disperse.”
This wasn’t an isolated incident. Rather, it was just one of a rash of warrantless raids on private, residential construction sites recently—raids that are sweeping up basically anyone who looks Latino, including U.S. citizens, and subjecting them to dangerous and sometimes life-threatening conditions.https://www.thebulwark.com/p/trump-is-walloping-construction-businesses

tow truck driver exonerated
A Los Angeles tow truck driver accused of towing a federal SUV (https://www.nbclosangeles.com/news/local/la-tatiana-martinez-immigration-arrest-tow-truck/3772962/) during an immigration enforcement operation was found not guilty by a federal jury Friday.
Bobby Nuñez, 33, was arrested and charged with theft of government property in connection with the mid-August arrest captured on video (https://x.com/USAttyEssayli/status/1962875213823275243) outside a downtown Los Angeles apartment complex.
The four-day trial concluded Friday afternoon with Nuñez being acquitted of the single charge. The 33-year-old was free on bond before the trial, according to the United States Attorney's Office for the Central District of California.
"We are pleased to confirm that the jury exonerated our client Bobby Nunez. We thank the jurors for their service as an essential backstop against prosecutorial overreach in our constitutional system," wrote Nuñez's attorney in a statement to NBC4.

warrantless intrusion of private property, illegal detention of Americans
ICE agents illegally break into a woman's bathroom in a NY nutrition bar manufacturing plant. "Pull up your pants," says a male agent. The agents only had a warrant to review employer documents. They didn't have a warrant to search for, detain, or arrest anyone there.
Agents lined up Latino workers and released people they said were U.S. citizens. They questioned and detained 57 people, including people who said only that they wanted a lawyer.https://bsky.app/profile/davidjbier.bsky.social/post/3malz3xiawk2o

US citizen deported
All they have to do is claim your papers are fake, then deport you without a hearing
A family in Maryland (https://www.newsweek.com/topic/maryland) is trying to find a woman arrested by U.S. Immigration (https://www.newsweek.com/topic/immigration) and Customs Enforcement (ICE (https://www.newsweek.com/topic/ice)), whose attorneys say is an American citizen but the government insists is Mexican.
Agents arrested Dulce Consuelo Diaz Morales, 22, on December 14 in Baltimore while she was heading home with her sister.
Despite her saying she was born in the U.S., she was held in ICE custody after failing to prove citizenship, the agency said. Attorneys rushed to get a court order keeping her in Maryland, but the Department of Homeland Security (https://www.newsweek.com/topic/department-of-homeland-security) (DHS) moved her to Louisiana (https://www.newsweek.com/topic/louisiana) anyway.
Speaking to the media Monday, attorneys representing Diaz Morales said they had not been able to reach their client, who they say has no criminal record, after being told by ICE to call the detention facility holding her earlier in the day.
“There is law here. There is law written. There are systems and circumstances of mandatory detention, this is not one of them,” Zachary Perez, supervising attorney at Sanabria & Associates, based in Maryland, told Newsweek Monday. “Not once has the government alleged to us in our communications that this falls under mandatory detention for X, Y, Z.
“It is irregular. She could have been released yesterday, she could have been released five minutes ago. We’re not seeing the government assert that there are criminal proceedings, for instance, or any additional charges that would necessitate holding her and transferring her, now twice.”
Her family has now been told she has been deported, despite U.S. District Judge Brendan Hurson ruling Thursday that she could not be deported pending a hearing. Perez and colleague Victoria Slatten said they had not been able to confirm Diaz Morales' whereabouts.

Trump loses the emergency appeal, SCOTUS upholds the stay on deploying the National Guard in Illinois
(Trump has won 20 of 24 emergency appeals this year)
The U.S. Supreme Court on Tuesday ruled against President Donald Trump and refused to lift a block on National Guard deployment within the state of Illinois, finding that Trump invoked a law that required him to first be unable to execute federal law with help from the U.S. military.
The justices wrote, in an unsigned opinion, that their conclusion means the law only applies in situations where the military has legal authority to execute criminal law — circumstances the high court called “exceptional.”
“At this preliminary stage, the government has failed to identify a source of authority that would allow the military to execute the laws in Illinois,” they wrote.

Evanston, Illinois, Mayor Daniel Biss reportedly confronted Border Patrol Chief Gregory Bovino during a Title 8 enforcement operation in Evanston after protesters gathered. Biss accused agents of violence and racism, while Bovino argued the operation was intended to make the city safer.
Biss said, “The abuse has not been acceptable, the racism has not been acceptable, the violence has not been acceptable.”
Biss added, “The only ‘violent mob’ in Evanston today was Greg Bovino and his masked thugs, terrorizing innocent people and then lying about our city to try and sow chaos. recap of Midway Blitz in the Chicago Tribune
The tear-gassing of Chicago neighborhoods. The rousing of suburban mothers in bathrobes, drawn into streets (https://www.chicagotribune.com/2025/10/19/immigration-raid-mount-prospect-neighbors/) to yell at agents and shame them. The attempted deployment (https://www.chicagotribune.com/2025/11/17/texas-national-guard-illinois/) of the Texas National Guard, on Trump’s command, only for a federal judge to order the troops to stand down (https://www.chicagotribune.com/2025/10/06/illinois-to-block-trump-national-guard-deployment/) almost immediately upon their arrival (https://www.chicagotribune.com/2025/10/07/national-guard-arrives-chicago-illinois/) in Illinois.
The agents who pointed guns and other weapons (https://www.chicagotribune.com/2025/12/07/experts-immigration-agents-poor-tactics-unsafe-policing/) at bystanders. The arrests of more than 4,500 people in a mission, the Department of Homeland Security said targeted “the worst of the worst.” The reality is (https://www.chicagotribune.com/2025/12/01/operation-midway-blitz-criminal-record/) that most of them (https://www.chicagotribune.com/2025/11/14/only-2-5-on-list-of-614-operation-midway-blitz-arrestees-had-criminal-histories-doj-records-show/) were people with brown skin (https://www.chicagotribune.com/2025/11/15/latino-us-citizens-racially-profiled-immigration-chicago/) who were at the right place — their landscaping jobs, the hardware store, a Dunkin’ Donuts drive-thru — at the wrong time.

What happened here for more than two months is unlike anything in recent American history: the federal government sending agents dressed for war into neighborhoods of the country’s third-largest city to arrest mostly people who look Latino and to ask questions later. To target people largely on the basis of their skin color, on the presumption that they may be in the country without documentation, or that they may have a criminal record, or an association with a gang.
Cook County Board President Toni Preckwinkle, a former history teacher, said she had never seen anything like the autumn raids in her lifetime and she believes the operation will be judged harshly.
“Historians are not going to be kind to us in this moment,” she said. “We should all be ashamed of what our country is doing in our name.”

When the Border Patrol gathered at Millennium Park, it was two days after one of the agents executed a drive-by pepper-spraying of a young couple and their 1-year-old daughter in Little Village. Five days after they stormed a Spanish-immersion preschool in North Center and arrested a beloved teacher.
It was less than two weeks after a dizzying stretch that left Chicagoans stunned in late October:
On Oct. 23, agents tossed tear gas (https://www.chicagotribune.com/2025/10/24/dhs-defends-tear-gas-little-village-chicago/) behind the discount mall in Little Village, the proud Latino neighborhood that, from the beginning of Trump’s immigration enforcement operation in Chicago, had remained a focal point.
On Oct. 24, agents lobbed more tear gas (https://www.chicagotribune.com/2025/10/24/federal-immigration-agents-chicago-north-side/) in Lakeview, a wealthy neighborhood that up until that moment had been relatively unaffected by the chaos.
Oct. 25, agents deployed even more tear gas, this time right before a children’s Halloween parade in Irving Park (https://www.chicagotribune.com/2025/10/25/chicago-tear-gas-irving-park/), where a resident raced out of his house, still in his Chicago Blackhawks pajamas, to confront feds who’d tackled a man in his front yard.
On Oct. 31 (https://www.chicagotribune.com/2025/10/31/chicag-halloween-immigration-raids-evanston/), agents fired pepper balls in Albany Park, pointed weapons and assaulted residents in Evanston and grabbed workers in Edison Park, Hoffman Estates, Skokie and Niles.

An observer at the scene said a woman was shot and received CPR after what appeared to be an immigration enforcement operation near E. 34th Street and Portland Avenue in south Minneapolis.
“I live right here, so I came over, tried to figure out what was going on,” said Venus DeMars, who described arriving after hearing reports of activity near Central Elementary School. DeMars said there were reports that federal agents had detained parents dropping off a child at the school.
She said she later heard that someone had been shot at the nearby intersection and went to investigate.
“I saw them doing CPR behind the snowbank,” DeMars said. “They did CPR on her for about a minute. And then the ambulances came and they loaded her onto a stretcher.”
DeMars said she did not see how or why the woman was shot and could not confirm who fired the weapon. She described the woman as white and said she appeared to be an observer.

this is acceptable statecraft, why?
A Valley couple says a dream vacation turned into a nightmare after immigration agents detained the husband on a cruise ship.
Jose Martinez said he was taken into custody on a Carnival cruise ship Monday morning. He and his wife, Tamara Verhas, are U.S. citizens.
The couple says three armed agents dressed in black busted into their stateroom before sunrise, handcuffing Martinez.
“Flashlights in our faces, screaming my name, barking commands, telling me to get out of bed, put me up against the wall and handcuffed me,” he said.
Martinez, a Coast Guard veteran, said he was escorted off the ship and taken to a concrete holding cell at the Port of Miami.
“Just a steel bench in the back of the room that I sat on waiting for them to verify my identity,” Martinez said.
He says the wait lasted 1.5 hours before he was finally released, without an apology. Martinez was told someone with his same name had warrants out for his arrest.
“I’ve never committed a crime, so much as maybe a traffic infraction, a speeding ticket,” Martinez said. “I’m a law-abiding citizen. I’m a veteran.”
The incident happened at the end of a nine-day Caribbean cruise to celebrate Martinez’s and a friend’s birthdays.

The Department of Homeland Security on Wednesday released a Maryland woman who was held for 25 days despite evidence that her lawyers say proves she was born in the United States and is a citizen.
Dulce Consuelo Diaz Morales, 22, walked out of a U.S. Immigration and Customs Enforcement detention center Wednesday afternoon in Elizabeth, New Jersey, where she was met by members of her legal team, according to one of her lawyers, Victoria Slatton.
We were afraid that it wasn’t really going to happen, and then when we saw her, it was very surreal and we were really, really happy,” Slatton said in an interview. “There was a lot of tearing up.” (https://www.washingtonpost.com/ask-the-post-ai/)
Slatton said the case against Diaz Morales has not yet been dismissed by the governmentand she could still face deportation proceedings. But Slatton is confident her client’s claim to citizenship has been established.
“She is a U.S. citizen. She was born here. I think that we’ve presented more than enough evidence, but we will continue to fight it until every single court accepts and acknowledges it,” she said.

A ban on police face coverings (https://washingtonstatestandard.com/2025/12/08/ban-on-police-face-coverings-pitched-ahead-of-was-2026-legislative-session/) has been one of the most talked about policy proposals in the first two days of Washington’s legislative session, with lead lawmakers and the governor lining up in support.
Senate Bill 5855 (https://app.leg.wa.gov/billsummary?BillNumber=5855&Year=2025&Initiative=false), which covers local, state and federal law enforcement, stems from fears of masked federal agents carrying out immigration raids and arrests across the country.

American bravery in the face of tyrannical oppression
A young protester narrowly avoided being killed but was left permanently blind after a Department of Homeland Security agent fired a nonlethal round at close range during a Santa Ana protest last week, according to family of the victim.
Jeri Rees said her 21-year-old nephew, Kaden Rummler, underwent six hours of surgery and that doctors found shards of plastic, glass and metal embedded in his eyes and around his face, including a metal piece lodged 7 millimeters from a carotid artery.
“That could have cost him his life,” Rees said.
“But now, for the next six weeks, he can’t sneeze or cough because it could do a lot of damage.”
She said doctors did not want to remove the shrapnel near the artery out of fear that it could kill him. She said her nephew also suffered a fractured skull around his eyes and nose and that doctors said he had permanently lost the vision in his left eye. She said the Homeland Security agent was a few feet from her nephew when he fired the weapon.
Several videos of Friday’s incident were shared on social media (https://x.com/abc7abigail/status/2009876815117160779?s=20). One video shows demonstrators, who were protesting the fatal shooting in Minnesota of Renee Good (https://www.latimes.com/world-nation/story/2026-01-08/woman-killed-by-ice-agent-in-minneapolis-was-mother-of-3-poet-new-to-city), throwing orange safety cones at the agents, who were standing guard outside the Santa Ana federal building.
The video cuts to three agents approaching the group before one agent tries to take a young person into custody, prompting at least three demonstrators to try to intervene. The person taken into custody was identified by friends as Skye Jones.
In the video, at least one agent appears to fire nonlethal rounds at the crowd, hitting one woman in the leg before aiming and striking Rummler’s face.
The video shows Rummler dropping to the ground after being shot, holding his face as the crowd retreats. The same agent then drags him by the hood of their jacket; they appear to be choking, grasping at the jacket binding their neck as blood pours from their left eye.
Another video shows Rummler inside the building, lying on the ground bleeding while agents fire what appear to be pepper balls at the back of the head and neck of a man trying to record the incident with his cellphone.
Rees said her nephew told her that the agents pressed his face against the pool of blood and did not immediately call paramedics.
“The other officers were mocking him, saying, ‘You’re going to lose your eye,’” she said, recalling what her nephew told her.

terrorizing daycares is apparently SOP for DHS in Minnesota
Apparently ICE goons in multi-car caravans are circling Spanish immersion preschools in the city taunting and photographing the parents and neighbors who are patrolling the school perimeter to keep kids safe.

Can confirm (https://bsky.app/profile/ericholthaus.com/post/3mc6agxa2cs24) I have personally seen three attempts just today of agents in a convoy of ICE vehicles trying to snatch random POCs along Central Ave - and then being chased off by neighbors with whistles. It's blatant racial profiling.

hopefully we'll see hearings like this in 2027 related to DHS
over the course of 1871, congress held seven months of hearings on ku klux klan and other white vigilante violence in the south, they took detailed testimony from hundreds of black men and women attesting to klan terror.

DHS patrolling elementary school pickups for dangerous criminals, assaulting parents and neighbors protecting their kids
"Due to escalated federal agent action in S Minneapolis today, we are recommending to add more patrol support to pick-up times at the following schools...Bring your whistle & wear your hat. If you have a respirator or goggles bring them in a small backpack. We don't want to show up looking alarming for the kids but chemical weapons are being used widely in the area."

DHS patrolling hospitals in the Twin Cities
Health care workers in the Twin Cities report that U.S. Immigration and Customs Enforcement agents are entering hospitals with detained individuals, sometimes with warrants and sometimes without, and they are frequently present during patient care.
Their presence is terrifying medical staff and raising concerns about patient care, according to five nurses at HCMC hospital in Minneapolis who asked to remain anonymous for fear of losing their jobs.

June 9th, from the pages of The Onion
Responding to escalating clashes between civilian activists and militarized immigration authorities, Los Angeles Mayor Karen Bass publicly urged protesters Monday not to give the Trump administration any pretext for what they’re already doing and will keep doing no matter what. “Angelenos—don’t engage in violence and give the administration an excuse to inflict all the damage they have been inflicting carte blanche for months on end,” said Bass, adding that Trump and his team are just looking for a reason to respond with violence, as they would have done whether or not any of this happened. “Don’t fan the flame that has been fanned behind the scenes at the White House since day one of Trump’s term in office. You wouldn’t want them to start abducting people in broad daylight and deporting them, would you? No, so let’s not become scapegoats for the horrific violations of civil liberties that would have eventually landed at our doorstep regardless.” At press time, Bass warned that Trump was using the actions of protesters to justify sending in the National Guard that had been pre-deployed to the conflict days before it even began.https://theonion.com/protesters-urged-not-to-give-trump-administration-pretext-for-what-it-already-doing/
