Seems like that would open the door to other litigation against these folks, meaning "incorporated" doesn't mean anything any longer, since you can be criminally charged for corporate decisions. I could see individual crimes like embezzlement, but hiring for the corporation? Stiffer financial penalties would be good, not criminal penalties though. I cannot imagine someone being in jail for giving someone employment.

Just off the top of my head, I’ve been the signer on applications filled out for healthcare facilities the company I work at owns to receive Medicaid reimbursement, and even though I was always signing on behalf of an LLC, I was subject to criminal penalty if I put anything on the application I knew to be untrue. I agree that you can’t create criminal liability for simple incompetence, but I don’t think creating it in the limited situations where there’s clear intent to break laws would make it easier to pierce the corporate veil in unrelated civil matters.

I’m a notary (from before I got to hire people to do the work) and there’s no training or anything, you fill out a form and answer a few questions. Even if you got training, you’re typically just checking a drivers license vs. an I-9 where your checking sone combination of a drivers license, social security card, passport, permanent resident ID, etc.

I don’t even think the problem is people making errors checking I-9s, that kind of just happens and isn’t worth criminal penalty. What needs to be addressed are employers who actively and knowingly l hire illegals to cut costs and low bid the compe ion on pricing, which is where intent comes in and why you should be able to carve that out as a criminal liability from corporate separateness laws.
