FBI shuts down Nevada voter fraud investigation


The FBI has closed a politically charged voter fraud inquiry sought by Nevada's top federal prosecutor, after finding only 38 non-citizens may have voted in the 2020 presidential election, sources with direct knowledge of the probe told CBS News.


The FBI ended the inquiry in late January, after Sigal Chattah (https://www.cbsnews.com/news/judge-trump-nevada-prosecutor-not-validly-serving/), the first assistant U.S. attorney in Nevada, had ordered the bureau in July to open a 2020 election fraud probe that she claimed could help flip a key congressional seat in Republicans' favor. At that time, she provided the FBI with a thumb drive of data compiled by the Republican Party that she claimed would show that non-citizens had voted in the 2020 election and that people on Indian reservations were accepting cash for ballots, the sources previously said.


But an FBI review of Nevada voter roll data, compared against Department of Homeland Security citizenship data, only identified 38 possible non-citizen voters. In addition, FBI agents told Chattah's office that the statute of limitations to pursue any possible case had also expired, which made bringing a case untenable, according to sources familiar with the case.

Tanya often calls the house “home”—at least five times, according to our review—and shows many milestones of family life there. She also lists her location as the District of Columbia on Facebook and enrolls in family crafts and lessons in the area, according to her social media posts. Perhaps most damningly, Posobiec listed a Maryland address—the same one he and his wife show in social media posts—more than a dozen times in his 2024 political contributions, according to Federal Election Commission filings.

CNN (https://www.cnn.com/2026/08/31/politics/homeland-security-voter-fraud-investigations) reported Monday that, starting Tuesday, the Department of Homeland Security’s investigative arm, Homeland Security Investigations (HSI), will be surging personnel and resources to tracking down the chimerical foe of noncitizen voting.


HSI is the same investigative entity behind many of the abuses I described in yesterday’s newsletter (https://talkingpointsmemo.com/the-brief/more-of-dhs-surprising-surveillance-tactics-revealed), including shocking, conspiratorial and sometimes buffoonish efforts to spy on activists and journalists in the Twin Cities area following the federal occupation of the city last winter.


CNN’s story was based on federal guidance its reporters reviewed. According to the report, HSI is launching a “coordinated criminal voter fraud surge initiative to pursue investigative leads, conduct field interviews, and support timely prosecutorial review.” It will target states including Washington, Wisconsin, Missouri, Georgia, California, Pennsylvania, Nevada, New York and Connecticut, and will last through “mid-October,” CNN reported. The California Post, a Golden State offshoot of the New York Post, confirmed (https://nypost.com/2026/08/31/us-news/feds-launch-voter-fraud-investigation-surge-in-california-other-states/) aspects of CNN’s reporting.

Because noncitizen voting is so vanishingly rare in modern American history, and has not impacted the outcome of any of the elections on which Republicans fixate, it’s unclear what the end game is here. The claim of widespread noncitizen voting largely serves as a pretextual predicate for Trump-era Republicans to attempt to clamp down on voting in ways that may hurt Democrats.

 The Brennan Center’s seminal report on this issue, The Truth About Voter Fraud, found that mostreported incidents of voter fraud are actually traceable to other sources, such as clerical errors or bad data matching practices. The report reviewed elections that had been meticulously studied forvoter fraud, and found incident rates between 0.0003 percent and 0.0025 percent. Given this tinyincident rate for voter impersonation fraud, it is more likely, the report noted, that an American“will be struck by lightning than that he will impersonate another voter at the polls.”

Even this tinynumber is likely inflated, as the study’s author counted not just prosecutions or convictions, butany and all credible claims.

 Two studies done at Arizona State University, one in 2012 and another in 2016, found similarlynegligible rates of impersonation fraud. The project found 10 cases of voter impersonation fraud nationwide from 2000-2012. The follow-up study, which looked for fraud specifically in stateswhere politicians have argued that fraud is a pernicious problem, found zero successful prosecutions for impersonation fraud in five states from 2012-2016.

Courts Agree: Fraud by Voters at the Polls is Nearly Non-Existent

 The Fifth Circuit, in an opinion finding that Texas’s strict photo ID law is racially discriminatory,noted that there were “only two convictions for in-person voter impersonation fraud out of 20 million votes cast in the decade” before Texas passed its law.3

 In its opinion striking down North Carolina’s omnibus restrictive election law —which included avoter ID requirement — as purposefully racially discriminatory, the Fourth Circuit noted that thestate “failed to identify even a single individual who has ever been charged with committing inperson voter fraud in North Carolina.”

 A federal trial court in Wisconsin reviewing that state’s strict photo ID law found “that impersonation fraud — the type of fraud that voter ID is designed to prevent — is extremely rare” and “a truly isolated phenomenon that has not posed a significant threat to the integrity of Wisconsin’s elections.”

 Even the Supreme Court, in its opinion in Crawford upholding Indiana’s voter ID law, noted thatthe record in the case “contains no evidence of any [in-person voter impersonation] fraud actually occurring in Indiana at any time in its history.” Two of the jurists who weighed in on that case at the time — Republican-appointed former Supreme Court Justice John Paul Stevens and conservative appellate court Judge Richard Posner — have since announced they regret their votes in favor of the law, with Judge Posner noting that strict photo ID laws are “now widely regarded as a means of voter suppression rather than of fraud prevention.”

Just weeks before the pivotal midterm elections, Texas election officials have discovered that an unknown number of voter registration applications have not been processed due to an error by the Texas Department of Public Safety.


DPS failed to send the applications, which were submitted by voters through its online driver’s license portal, to county voter registrars for processing, according to an email sent to county officials and provided to Votebeat. The state confirmed to Votebeat that it would begin delivering the unsent registrations to county officials overnight.


State officials said the affected transactions produced incomplete voter registration records, which prevented them from being transmitted to county registrars. Officials have not said what information was missing, what caused the records to be incomplete, how many voters were affected, or exactly when the problem began.


The DPS portal is a major voter registration channel in Texas. From 2020 through 2024, about 6 million Texans used it to register to vote, according to testimony DPS officials provided to state lawmakers in 2025. Texas has more than 18 million registered voters.

Scheduled for sentencing on Oct. 19, she faces a maximum of eight years and seven months in prison, though given her lack of a criminal record, that severe a punishment is unlikely. We don’t believe a lengthy prison sentence is appropriate — taxpayers have wasted enough money on Gaea Powell — but she should get substantial jail time after forcing this case to go to trial.

The Civil Rights Division has been dubbed the “crown jewel” of the Justice Department. President Dwight D. Eisenhower authorized the Division as part of the Civil Rights Act of 1957, and three months later, it was born. The Division was forged in the Civil Rights Movement in response to massive resistance against racial integration. The Supreme Court’s landmark decision in Brown v. Board of Education, 344 U.S. 1 (1952), and our Nation’s new voting laws gave the Division its first missions. Even in its infancy, the Division stood at the forefront of the federal government’s efforts to protect Americans’ right to vote. And since then, generations of Civil Rights Division attorneys and staff have worked to protect that right—a sacred right that gives our citizenry a say in its government and secures all other individual rights against government interference.

Against that backdrop, this case is anomalous. The Plaintiffs, a voting-rights organization and four individual voters, allege that the Civil Rights Division has set out on a mission antithetical to its purpose and history: to remove voters from voter rolls across the country, including United States citizens. They challenge a policy adopted by the current Civil Rights Division seeking unprecedented influence over states’ longstanding authorities to register eligible voters and maintain their voter rolls. Under the policy, the Plaintiffs say, the Division is demanding voter registration lists from all states, comparing those lists against a citizenship-status database plagued with inaccuracies, and urging states to remove voters who the Division deems ineligible. This policy, the Plaintiffs contend, has left untold numbers of disenfranchised voters in its wake and inflicted injuries to the Plaintiffs’ privacy and informational rights to boot.

The Defendants, the Department of Justice (DOJ) and the Attorney General, insist that DOJ has the statutory authority to adopt this policy. But their claimed sources of authority raise eyebrows. The Defendants claim that statutes aimed at expanding the Civil Rights Division’s tools to protect the right to vote—the Civil Rights Act of 1960, the National Voter Registration Act, and the Help America Vote Act—give the Division the authority to demand that states remove United States citizens from their rolls. In furtherance of this position, the Defendants make other startling arguments. They suggest that every American citizen who registers to vote is the subject of a voter fraud investigation underway in the Civil Rights Division simply because they registered to vote. And the Defendants downplay the risk of voter disenfranchisement—despite knowingly relying on an inaccurate database to check voter eligibility. Behind all the window dressing, the challenged policy represents the federal government’s attempt to decide who gets to vote. But Congress has left that authority where our Constitution has always placed it: with the states.

DOJ cannot run roughshod over longstanding laws that were carefully crafted to protect the rights of the American people. The Civil Rights Division’s policy is unlawful in several respects. First, the Defendants’ claimed authorities—Civil Rights Act of 1960, the National Voter Registration Act, and the Help America Vote Act—do not authorize the policy. Second, the policy is arbitrary and capricious under the Administrative Procedure Act. Third, the policy violates both substantive and procedural protections in the Privacy Act, a statute designed to ban federal data banks and preserve the American tradition of limited, transparent government. And fourth, the policy violates limits imposed by the Paperwork Reduction Act.

The Court therefore sets aside and vacates the challenged policy under the Administrative Procedure Act. Today’s decision does not prevent the federal government from taking lawful steps to support states’ efforts to maintain accurate voter rolls. Neither does it prevent states from maintaining their own voter rolls. And to state the obvious, the Court’s decision does not pave the way for ineligible voters to vote in our elections. Rather, the Court vacates a policy that has removed United States citizens from the voter rolls in their home states and risks disenfranchising many more—a policy that flies in the face of duly enacted laws designed to protect Americans. When the federal government defies federal laws, our system of checks and balances permits individuals to turn to federal courts for recourse. And if they prevail, courts are duty-bound to step in under the Constitution.

SSA has long recognized that its citizenship data contains certain inaccuracies. See Hill Decl. Ex. 17 at 216 (SSA-AR-44); Hill Decl. Ex. 18 at 237 (SSA-AR-0103). For one, SSA “did not begin to consistently maintain citizenship information until 1981,” and therefore “does not have citizenship information for all individuals who have been issued an SSN.” Hill Decl. Ex. 19 at 245. Moreover, because SSA merely captures an individual’s citizenship “at the time of their interaction with SSA”—that is, when they apply for a Social Security number—SSA does not update its records to reflect changes to an individual’s immigration status “unless the individual is receiving Social Security payments.” Id. In other words, if an individual received a Social Security number while a noncitizen—as the law permits, see 42 U.S.C. § 405(c)(2)(B)(i)(I)—and that individual later became a U.S. citizen through naturalization or acquired citizenship, SSA records would likely misclassify her as a noncitizen. This data error is far from abstract. A 2006 SSA audit found that 7% of the non-U.S. citizen records in SSA’s database—totaling approximately 3.3 million people—misidentified U.S. citizens as noncitizens.

Texas DPS failed to process ~500,000 voter registration renewals, as required by law

In 2016, Texas voters and voting rights groups sued the state over its lack of online voter registration. They argued it was a violation of the National Voter Registration Act that voters could not register online while updating their address, driver’s license, or state ID through DPS. A federal judge ruled in their favor in 2018, but an appeals court overturned the ruling in 2019 because the plaintiffs lacked standing.


Voters and voting rights groups sued again in 2020. This time, a federal judge ordered Texas to offer voters the option to register to vote through DPS’ online portal when updating their driver’s license or state ID. In 2021, the state settled the lawsuit, agreeing to permanently maintain the process.


Now, the new lawsuit argues that the recent failures of voter registration systems run by DPS and the Texas Secretary of State’s Office have prevented the state from meeting that obligation.

DOJ sends an illegal voter ultimatum to California


The U.S. Department of Justice has threatened California with possible legal action over what it says are noncitizens believed to have received mail ballots for next month’s midterm elections.


A letter sent Tuesday to Secretary of State Shirley Weber from Trent McCotter, the acting deputy U.S. attorney general, says the department has provided officials in Los Angeles County with a password-protected thumb drive with a list of names the federal government believes are likely noncitizens who were sent ballots to participate in the Nov. 3 election.


Los Angeles County Registrar-Recorder/County Clerk Dean C. Logan confirmed Wednesday that he received such a package on Tuesday afternoon.

Fifteen thousand affected records were sent to counties, said Alicia Pierce, the spokesperson for the Texas Secretary of State’s Office, but not all counties were impacted.


According to the Texas Association of County Election Officials, Bexar County election officials on Thursday received 3,000 records to process, Travis County received 1,100, Williamson County received 700, and Hays County received 400.
