Arizona’s top election official and attorney general are asking a judge to force Maricopa County Recorder Justin Heap to reinstate the voting rights of 25 people who were falsely flagged as noncitizens by a database created by the Trump administration.

The lawsuit, filed by Attorney General Kris Mayes and Secretary of State Adrian Fontes, comes the day before the deadline for voters to request an early ballot. Voters have until Oct. 23 to request an early ballot.

James O'Keefe inadvertently drew attention to how hard it is to commit voter fraud in a blue state and drew identity theft and unlawful voting charges for his trouble


The Hennepin County Attorney's Office is charging James O'Keefe and Cam Higby with felonies for unlawful voting and ID theft for filming themselves misrepresenting their identities to election judges during the Minnesota primary as voters who were registered in the precinct.

Prosecutor Mary Moriarty said they were alerted by the Sec of State office that James O'Keefe and others were trying to undermine the state's vouching system. Moriarty said vouching accounts for just .6 percent of the ballots cast in the state.

Videos posted by O'Keefe show them wearing burkas outside precincts during the primary. There is a clear remedy available.

The United States can prosecute individuals according to Section 611, as it has historically and recently done. California also has established procedures to cancel the voter registrations of any individuals proven ineligible. The Executive’s requested relief, however, would wreak havoc and disrupt the election that is already underway, create a chilling effect on election workers and voters alike, and discount the votes of United States citizens. The Executive Branch cannot replace the remedy Congress carefully enacted with its own unlawful and unconstitutional solution instead.

Eroded trust in our democracy is irreparable. Once a vote is segregated, lasting harm has occurred. If the Executive can discount votes and threaten an ongoing election due to unproven allegations, then our democracy is in danger.

This Court declines to be a party to such process.

Washington’s top election official is calling on federal authorities to provide more evidence that the state’s voter rolls include hundreds of noncitizens, as a preliminary investigation reveals U.S. citizens are listed.

The state’s top federal prosecutors on Monday claimed Washington’s voter rolls included 405 ineligible noncitizens (https://washingtonstatestandard.com/2026/10/26/feds-allege-over-400-noncitizens-vote-in-wa-hobbs-disputes-data/) who had voted upward of 1,500 times in elections dating back decades. They called on Secretary of State Steve Hobbs to set aside their votes until they could be confirmed as rightful voters, but Hobbs countered that the information they provided contains “several glaring deficiencies,” including duplicate entries and the inclusion of unregistered voters.

“Without individualized proof of ineligibility, it would be both irresponsible and illegal for election officials to decline to process a registered voter’s ballot,” wrote Hobbs, a Democrat. “If you have individualized proof, I invite you to provide it so election officials can take appropriate steps that are consistent with federal and state law.”



Hobbs claimed the list received from federal authorities included people who aren’t currently registered to vote or whose registrations are inactive. And many are U.S. citizens, a similar finding to other states that have faced similar accusations from the Trump administration. A spokesperson for Hobbs said it’s too soon to say how many exactly are citizens.

Hobbs also said the list of alleged noncitizen voters presented to the state contained no information sources or evidence supporting the claims of fraud.

“Given the Department of Justice’s recent acts of election interference in California, Alaska, and now in Washington, it would be particularly inappropriate for Washington to simply assume the Department’s unsupported allegations here are credible,” Hobbs wrote.

Boasberg demands information about federal election interference


A federal judge on Thursday ordered the Trump administration to provide a list of states it targeted with demands that state and local officials change how they will administer the midterm election, including that they set aside specific ballots for extra scrutiny.


The order from Chief Judge James E. Boasberg in Federal District Court in Washington could provide new transparency into the Trump administration’s efforts to pressure local officials ahead of next week’s election.


It came in a lawsuit brought by a broad coalition of Democratic politicians and party organizations that is seeking a court order prohibiting the Trump administration from interfering in election administration.

At a hearing, Judge Boasberg said he planned to decide whether to block the Trump administration’s efforts by Nov. 3.


But he said that information he asked the administration to produce by noon on Friday would help him determine the extent of the federal government’s efforts and whether he had reason to intervene.


Judge Boasberg asked the Justice Department to produce any communication with state or local election officials that directed them to remove registered voters from state rolls, to refuse to issue ballots to specific registered voters, or to set aside “or otherwise not count and tabulate” votes cast by specific individuals.
