So exactly who is paying Michael Avenatti? And is he a lawyer, an opposition researcher, a journalist or a campaign operative?

He wants to make the discussion all about where Michael Cohen, President Trump’s personal attorney, got his money but, to have clean hands, Avenatti needs to come forward with exactly who is financing his operation, who his sources were for detailed banking information, and whether he really is an attorney solely representing Stormy Daniels or just using her as cover to wage a political operation.

From the beginning, this has been fishy. Daniels's previous lawyer advised her to stick to her agreements. In contrast, Avenatti OK'd her violating with impunity her nondisclosure agreement on “60 Minutes” despite a binding arbitration judgment against her. She has acknowledged on Twitter that she is not paying for her lawyer. So who is? And did he indemnify her against all multimillion-dollar penalties?

It took a long time and even a court battle to find out that the Clinton campaign and the Democratic National Committee paid for the Fusion GPS dossier, a fact that was disclosed only after the damage was done, as former British spy and the dossier’s compiler, Christopher Steele, had already created a vast echo chamber as though the material he was peddling had been verified in some way — which, of course, it never was. Now Avenatti is being allowed to repeat this same process, mixing truths with half-truths and evading accountability.

This week, Avenatti released to the media a report detailing consulting payments to Cohen, and much of it, despite a few errors, has been verified. AT&T, Novartis and a real estate firm acknowledge having hired the president’s personal attorney for insights on the incoming administration. Mueller appears to have investigated all of this months ago, and it is highly unlikely that the theory Avenatti is pounding away at — that Russians paid for Stormy Daniels — holds any water or Mueller would not have passed the investigation on to U.S. attorneys in New York. Russia, actually, is Mueller’s bailiwick.

Is there a team of people digging this up? Are they paying off sources? Is Fusion GPS involved? Are there political donors behind it that could make this campaign work? He can’t be both an attorney and then participate as an officer of the court in trafficking illegally obtained information.

Avenatti has been given a free, unfettered media perch on TV to spread his stuff without the networks forcing him to meet any disclosure requirements — saying that he is Stormy Daniels’s attorney when someone else entirely is paying for this operation is not true disclosure that allows the viewer to evaluate the source and potential conflicts. LOS ANGELES (AP) — A federal judge in California ordered a law firm linked to Stormy Daniels' attorney to pay $10 million on Tuesday to a lawyer who claimed that the firm had misstated its profits and that he was owed millions.The judgment came after Jason Frank, who used to work at Eagan Avenatti, alleged that that the law firm failed to pay a $4.85 million settlement he had reached in December. He said in court papers that the settlement was personally guaranteed by Michael Avenatti, who has garnered national attention as the attorney for Daniels, the porn actress who is suing President Donald Trump following an alleged 2006 affair.

Frank had worked at Avenatti's firm under an independent contractor agreement and was supposed to collect 25 percent of the firm's annual profits, along with 20 percent of fees his clients paid, according to court documents. He resigned in May 2016 after alleging that the firm didn't pay him millions of dollars that he was owed, misstated the firm's profits and wouldn't provide copies of tax returns and other financial documents.


After he resigned, Frank brought the case to a panel of arbitrators, who found that the firm "acted with malice, fraud, and oppression by hiding its revenue numbers," according to a copy of the arbitration report included in court documents.


In December, Frank settled with Avenatti's firm for a total of $4.85 million, which was supposed to include an initial $2 million payment and then a second payment for $2.85 million. The $2 million payment was supposed to be made by May 14, but Avenatti and his firm never paid, Frank said in court papers.

The settlement agreement included a clause that the firm couldn't oppose a request for a $10 million judgment if the settlement payments weren't made within three days of the due date. Frank did not immediately return a telephone message seeking comment on Tuesday.

Let me offer an alternative explanation of the affair and the payoff. It is still just a hypothesis, but, I would argue, it fits more comfortably with what we know about the various players than the reported version of events:Donald Trump, not Elliott Broidy, had an affair with Shera Bechard. Bechard hired Keith Davidson, who had negotiated both Playboy playmate Karen McDougal’s deal with the National Enquirer and Stormy Daniels’s NDA with Trump. Which is to say, it was a cover-up concealing a bribe. Indeed, it turns out that Broidy not only has a history of bribing public officials, but of bribing them in an uncannily similar fashion to the method which I hypothesize he employed in this case.

So, according to this hypothesis, when Cohen’s office was raided by federal prosecutors, they found documentation of what was actually a fabricated affair, concocted by Cohen and Davidson to create a justification for funneling Broidy’s money to Bechard, while creating a paper record designed to protect Trump from further exposure.
