Were that true, then the states wherein such limits were placed would have seen lower costs, such as Texas. That hasn't happened anywhere it has been tried, strongly suggesting that the effect is not material.
I can also say that doing such thing would tend to let dangerous quacks keep practicing.
Part of my stint as an auditor was of a medical malpractice insurer, and part of that work was reading the case files for claims. Some of what I read still makes me shudder. I will spare you the graphic details.
Limit doctor liability at your own risk, quite literally.
Looks like you have some good experience in this area so I'll take your word for it. All I have is anecdotal experience s from my father who used to be a doctor. He'd always come home and talk about the rising cost of health care and the unnecessary procedures they had to do out of "an abundance of caution."
Of course he also thought he could cure Tim Duncan's plantar fasciitis by making him wear cowboy boots instead of the chanclas he'd always see him wearing. So maybe I should have taken everything he said with a grain of salt.

I don't doubt that defensive medicine has something to do with cost increases. What I understand though, it that it isn't as much of a cost driver as some assume. It is waaay too huge of a segment of the economy to oversimplify that way.
That said, there has to be SOME explanation as to why we spend so much more on health care than other countries.

Practical equality of opportunity for all citizens, when we achieve it, will have two great results. First, every man will have a fair chance to make of himself all that in him lies; to reach the highest point to which his capacities, unassisted by special privilege of his own and unhampered by the special privilege of others, can carry him, and to get for himself and his family substantially what he has earned. Second, equality of opportunity means that the commonwealth will get from every citizen the highest service of which he is capable. No man who carries the burden of the special privileges of another can give to the commonwealth that service to which it is fairly entitled.
I stand for the square deal. But when I say that I am for the square deal, I mean not merely that I stand for fair play under the present rules of the games, but that I stand for having those rules changed so as to work for a more substantial equality of opportunity and of reward for equally good service. One word of warning, which, I think, is hardly necessary in Kansas. When I say I want a square deal for the poor man, I do not mean that I want a square deal for the man who remains poor because he has not got the energy to work for himself. If a man who has had a chance will not make good, then he has got to quit. And you men of the Grand Army, you want justice for the brave man who fought, and punishment for the coward who shirked his work. Is not that so?
Now, this means that our government, national and State, must be freed from the sinister influence or control of special interests. Exactly as the special interests of cotton and slavery threatened our political integrity before the Civil War, so now the great special business interests too often control and corrupt the men and methods of government for their own profit. We must drive the special interests out of politics. That is one of our tasks to-day. Every special interest is entitled to justice - full, fair, and complete - and, now, mind you, if there were any attempt by mob-violence to plunder and work harm to the special interest, whatever it may be, and I most dislike and the wealthy man, whomsoever he may be, for whom I have the greatest contempt, I would fight for him, and you would if you were worth your salt. He should have justice. For every special interest is entitled to justice, but not one is entitled to a vote in Congress, to a voice on the bench, or to representation in any public office. The Constitution guarantees protections to property, and we must make that promise good But it does not give the right of suffrage to any corporation. The true friend of property, the true conservative, is he who insists that property shall be the servant and not the master of the commonwealth; who insists that the creature of man's making shall be the servant and not the master of the man who made it. The citizens of the United States must effectively control the mighty commercial forces which they have themselves called into being.
There can be no effective control of corporations while their political activity remains. To put an end to it will be neither a short nor an easy task, but it can be done.
Winehole23
03-12-2019, 09:22 AM
We must have complete and effective publicity of corporate affairs, so that people may know beyond peradventure whether the corporations obey the law and whether their management entitles them to the confidence of the public. It is necessary that laws should be passed to prohibit the use of corporate funds directly or indirectly for political purposes; it is still more necessary that such laws should be thoroughly enforced. Corporate expenditures for political purposes, and especially such expenditures by public-service corporations, have supplied one of the principal sources of corruption in our political affairs.
It has become entirely clear that we must have government supervision of the capitalization, not only of public-service corporations, including, particularly, railways, but of all corporations doing an interstate business. I do not wish to see the nation forced into the ownership of the railways if it can possibly be avoided, and the only alternative is thoroughgoing and effective regulation, which shall be based on a full knowledge of all the facts, including a physical valuation of property. This physical valuation is not needed, or, at least, is very rarely needed, for fixing rates; but it is needed as the basis of honest capitalization.
We have come to recognize that franchises should never be granted except for a limited time, and never without proper provision for compensation to the public. It is my personal belief that the same kind and degree of control and supervision which should be exercised over public-service corporations should be extended also to combinations which control necessaries of life, such as meat, oil, and coal, or which deal in them on an important scale.

The absence of effective State, and, especially, national, restraint upon unfair money-getting has tended to create a small class of enormously wealthy and economically powerful men, whose chief object is to hold and increase their power. The prime need is to change the conditions which enable these men to accumulate power which is not for the general welfare that they should hold or exercise. We grudge no man a fortune which represents his own power and sagacity, when exercised with entire regard to the welfare of his fellows. Again, comrades over there, take the lesson from your own experience. Not only did you not grudge, but you gloried in the promotion of the great generals who gained their promotion by leading the army to victory. So it is with us. We grudge no man a fortune in civil life if it is honorably obtained and well used. It is not even enough that it should have gained without doing damage to the community. We should permit it to be gained only so long as the gaining represents benefit to the community. This, I know, implies a policy of a far more active governmental interference with social and economic conditions in this country than we have yet had, but I think we have got to face the fact that such an increase in governmental control is now necessary.

The people of the United States suffer from periodical financial panics to a degree substantially unknown among the other nations which approach us in financial strength. There is no reason why we should suffer what they escape. It is of profound importance that our financial system should be promptly investigated, and so thoroughly and effectively revised as to make it certain that hereafter our currency will no longer fail at critical times to meet our needs.

Of conservation I shall speak more at length elsewhere. Conservation means development as much as it does protection. I recognize the right and duty of this generation to develop and use the natural resources of our land; but I do not recognize the right to waste them, or to rob, by wasteful use, the generations that come after us. I ask nothing of the nation except that it so behave as each farmer here behaves with reference to his own children. That farmer is a poor creature who skins the land and leaves it worthless to his children. The farmer is a good farmer who, having enabled the land to support himself and to provide for the education of his children leaves it to them a little better than he found it himself. I believe the same thing of a nation.
Moreover, I believe that the natural resources must be used for the benefit of all our people, and not monopolized for the benefit of the few, and here again is another case in which I am accused of taking a revolutionary attitude. People forget now that one hundred years ago there were public men of good character who advocated the nation selling its public lands in great quantities, so that the nation could get the most money out of it, and giving it to the men who could cultivate it for their own uses. We took the proper democratic ground that the land should be granted in small sections to the men who were actually to till it and live on it. Now, with the water-power with the forests, with the mines, we are brought face to face with the fact that there are many people who will go with us in conserving the resources only if they are to be allowed to exploit them for their benefit. That is one of the fundamental reasons why the special interest should be driven out of politics. Of all the questions which can come before this nation, short of the actual preservation of its existence in a great war, there is none which compares in importance with the great central task of leaving this land even a better land for our descendants than it is for us, and training them into a better race to inhabit the land and pass it on. Conservation is a great moral issue for it involves the patriotic duty of insuring the safety and continuance of the nation. Let me add that the health and vitality of our people are at least as well worth conserving as their forests, waters, lands, and minerals, and in this great work the national government must bear a most important part.

AFL-CIO: Green New Deal Will ‘Cause Immediate Harm to Millions’
“We welcome the call for labor rights and dialogue with labor, but the Green New Deal resolution is far too short on specific solutions that speak to the jobs of our members and the critical sections of our economy,” reads the letter, which was signed by ten national labor unions on the AFL-CIO’s energy committee. “We will not accept proposals that could cause immediate harm to millions of our members and their families. We will not stand by and allow threats to our members’ jobs and their families’ standard of living go [sic] unanswered.”

You won’t believe the new accusations of who’s behind Alexandria Ocasio-Cortez and who’s pulling the strings America.
According to the YouTube show Mr. Reagan, there are multiple people pulling the strings, but the person really running the show is Saikat Chakrabarti, a former Bernie Sanders operative.
Chakrabarti is the co founder of the Justice Democrats. But wait until you hear who’s actually behind the Justice Democrats. It will blow your mind and scare the hell out of you.
1h5iv6sECGU
Saikat was her campaign manager, but he doesn’t have the charisma to run for office himself. He’s got some terrifying political influences and is suspected of committing some serious campaign finances.
But wait, there’s more. The person who hired Siakat Chakrabarti to run the Justice Democrats is none other than Cenk Uygur of the Young Turks.
The Justice Democrats were heavily promoted on the Young Turks programs, and Cenk has been saying for quite some time as this video shows that they have to “take over the Democratic party.”
Cenk says we have to “board the Democratic ship and take it over.”
This is the most bombshell video to date on who’s pulling the strings on the likes of not only Alexandria Ocasio-Cortez, but Ilhan Omar, Rashida Tlaib, and others that the group helped get elected.
This should scare the hell out of each and every red blooded American who values life, liberty, and the pursuit of happiness. Watch the video, share the video and this article, and get the word out America.

Some of her core ideas might unrealistic, but by no means radical (no, she doesn't want to ban air-travel, hamburgers, impose one-child policies, etc, etc). Her tax proposal (which isn't an official proposal, it was something she suggested in an interview), again, is not out of line with the tax structure we had from post-New Deal to pre-Reagan. I don't see how universal healthcare is a radical idea when every developed country on Earth implements a single-payer system with success. Yes, the Green New Deal shoots for the moon, but the fact is we do need to start addressing anthropocentric climate change sooner than later.

Her "positions" are here
https://www.justicedemocrats.com
Let's unpack:
- Green New Deal
I agree that her proposal is unrealistically optimistic, and most likely will never be introduced into law. That doesn't mean anthropocentric climate change isn't a real problem that, as I've stated in prior discussions with you about the topic, needs to be addressed sooner rather than later, per the consensus of the scientific community. Maybe conservatives can offer counter proposals rather than fear monger about banned air travel and cheeseburger confiscation.
- Secure a living wage and tie it to inflation
Bad how? Minimum and living wage has not kept pace with inflation, while wealth growth among the top earners has outpaced inflation.
http://sc.cnbcfm.com/applications/cnbc.com/resources/files/2016/07/19/min-wage-inflation.PNG
http://www.mybudget360.com/wp-content/uploads/2014/08/income-growth-by-quintile.png
As I've said before. Supply-side economics had a 40 year trial. It did not "trickle down." Time to think up something new.
- Enact a federal jobs guarantee.
A little over-optimistic, but could be feasible. We already have some form of a "federal jobs guarantee" in the American military, which is usually an option for those from low income backgrounds or those lacking a higher education who can't find a well paying job in the conventional private sector. But instead of wasting trillions on wars, silly fighter planes, and 600 bases around the world, none of which benefit Americans, we cut defense spending in half. Then we put that difference toward creating more domestic federal jobs that are centered on actually benefitting Americans rather than using that money to devise more ways to kill goat herders.
- Rebuild our crumbling infrastructure.
This was a key selling point for Lord Trump during his campaign, promising to build infrastructure that is "second to none." Don't see any downsides here, except "concern" that it might bite into our defense spending budget (which continues to get near-trillion dollar bumps, while we have yet to see one dollar spent on infrastructure overhaul).
- Block bad trade deals.
Also a key selling point during Lord Trump's campaign.
- End tax loopholes.
No reasonable person would be against this.
- End necessary wars and nation building.
No reasonable person would be against this.
- Medicare for all.
I went into detail in prior posts how this can easily work (also, we can look at the successful implementation of this in other countries as proof of concept).
- Free public colleges and trade schools.
Other countries employ this with success.
I'll cut it short, but I see nothing "radical" in any of the subsequent proposals, even abolishing ICE, which is just more government bloat (we already enough law enforcement agencies in the country).
Sound to me like the core objection to Cortez's platform is same as it ever was from those on the right: "More taxes! Y-Y-You m-m-mean I have to be a little bit more selfless so that my fellow Americans who weren't as fortunate as me can live a more flourishing life!? Fuck that. I need that extra 10K per year that will have no measurable effect on my standard of living since I want a new fishing boat! I earned it! I don't disagree, just that this scandal has exposed that people with shitty foundations, shitty education, shitty morals, and shitty family structures (the family structures of the wealthy are often dysfunctional) can cheat their way to success through money and connections, at the expense of those who played by the rules. I'm not saying your average upper-middle class American (~150K-250K median family income) didn't earn what they have, just when you start getting into the multimillionaire class, my bullshit detector goes way, way up when someone says they "bootstrapped" themselves to that level through hard, smart, and ethical work. Call me cynical, but I have more reason to believe the cynical position over fairy tale Horatio Alger myths.

For them, it's really more about being able to add Yale, Harvard, Princeton grad to their resume, which unfortunately gets the attention of potential employers more than graduating from "lesser universities." The way they can bullshit their way to a degree is by taking easier courses, buying or paying people to do term papers (https://slate.com/human-interest/2001/12/how-to-buy-a-good-college-term-paper-online.html), and cheating on exams. These types will no doubt be a part of a frat/sorority, and then subsequently use that network of "brothers and sisters" in the real world to secure some job position. Sure, they most likely will now have to prove competence in the real world when real profits are stake, but these people aren't totally dumb, and can likely meet the bare minimum standards of performance to keep their position.

As I said in my length reply to Darren, the objection to politicians like AOC, Warren, Sanders etc from the right always boils down to antipathy toward increased taxes (which politicians like AOC don't even want to raise/raise by a significant amount on people of Darren's class). As I concluded in that post:
Sounds to me like the core objection to Cortez's platform is same as it ever was from those on the right: "More taxes! Why irritates me is not necessarily the selfishness of this mentality, it's that conservatives won't/can't admit that their resistance to higher taxation is out of narrow self-interest rather than "what's best for America." They can just say it. "Yeah. It's my money, and I want as much of that money as possible to go toward my personal interests. I don't really care about the food insecurity of people in Detroit. I have my own shit to worry about."
And I honestly wouldn't think less of them for that position. Wealth is a finite resource you can potentially lose at any time due to unforeseen circumstances, so I can understand the "what if?" anxiety in this regard. Just don't try to bullshit and say that you making an extra 15K per year through a tax break helps the working poor in Detroit. It doesn't. Nor does giving Bezos a few extra billion. As I've shown numerous times, the data has proved trickle-down to be a fraud.

Self interest is usually the only argument for lower taxation that holds up on objective scrutiny. Like similar debates over guns, the conservative position on taxation typically gets bogged down in hypotheticals and philosophical arguments that have no historical precedent. At best. At worst, you find yourself debating people who don't even understand the basics of tax brackets.
So I agree, better to just say, "I want to keep my income," then we can talk about how we pay for all of the stuff we need.

No. Every other developed country in the world has a simple majority election process. And no, the Electoral College wasn't designed to give smaller states "more representation." It was designed as a fail safe in case the collective public lost its mind and elected a person completely unfit for office, like a bloodthirsty dictator.

Isn't the electoral college actually the radical solution in this case, since it's the outlier to what every other country implements? Why does simple majority "trouble" you? "Cuz dem libruhhhl coastal states will have all the power!" Then conservatives need to campaign harder to convince liberals in those states their policies are good. Other arguments I anticipate are: "But libruuuls keep allowing in immigrants who always vote for them!" 66% of Hispanics aren't affiliated with the Democratic party, and 30 percent voted for Trump.

Side note: Hate the hagiography we sometimes have toward politicians) will opt for whatever choice best ensures their political survival. that's not "why" abolishing the electoral college makes sense. that's just evidence that going with a popular vote can work just fine, and evidence that it's not a radical concept.
the "why" is because a popular vote makes more sense. a citizen's vote shouldn't count any more or less based on where they reside. right now, a vote in ohio is significantly more important than a vote from mississippi. why is that fair?

The so-called "Constitutional" anti-democratic EC was designed/intended to disenfranchise voters who were feared/detested by the FFs and who had to be stopped (by the EC) from electing a candidate the FF white male oligarchy wouldn't like.
If the EC had rather elected two Dem presidents over popular-vote-winning Repug candidates, then all y'all Fox viewers would be screaming to kill the EC.
EC ain't going nowhere, since killing it would take a Constitutional amendment that would be voted down by red/slave states.
