Dear Mr. Raffensperger,

The Coffee County Board of Elections and Registration cannot certify the electronic recount numbers given its inability to repeatably duplicate creditable election results. Any system, financial, voting, or otherwise, that is not repeatable nor dependable should not be used. To demand certification of patently inaccurate results neither serves the objective of the electoral system nor satisfies the legal obligation to certify the electronic recount.

I am enclosing a spread sheet which illuminates that the electronic recount lacks credibility. NO local election board has the ability to reconcile the anomalies reflected in the attached. Accordingly, the Coffee County Board of Elections and Registration have voted to certify the votes cast in the election night report. The election night numbers are reflected in the official certification of results submitted by our office.

They could probably also mention that the relatively recent virtual dissolution of the VRA opened the door to this, and dangle that in front of them again. Don't think this SCOTUS would reinstate, but I doubt it's a topic those states want to even risk.

There's really no legal path forward here that I can see. This is more grifting the rubes.

The real problem is that it puts the high court in the uncomfortable position to end this shitshow, possibly causing institutional damage to it. So at this point, I assume there's a lot of thinking on how to avoid that.

I thought the way the PA appeal was resolved was a clear message, but apparently it was not received.

Relief sought doesn't have to be that. They could also request the SCOTUS to review electoral laws and procedures. The VRA would be a precedent for that.

I'm just curious how do the justices feel about getting the high court hijacked for a dog and pony show. There really are no questions of law here, despite what the plaintiffs claim.

It's well established State legislatures voted to vest election officials with powers to carry the election. A lot of electoral laws in these states have been litigated already, some in front of this very court.

The notion that different state's legislatures select different methods to conduct elections is as old as the Republic itself, and if that should invalidate elections, then pretty much all elections since the start of the republic are invalid. This is not a serious legal argument.

And lastly, if the concern is with a particular law on a particular state, most all of these laws have been enacted well before the election, and there was ample time to litigate them. Heck, some have been and these plaintiff states never joined those timely lawsuits, which is a textbook case of laches.

As far as the allegations of fraud, the Trump team itself, via their absolutely horrible legal campaign post election, have provided the defendant states with plenty of legal documentation to firmly dispel that notion.

Like I said, I suspect the high court is looking for a graceful exit off this shitshow.

So from what I’ve read and heard so far regarding the Texas lawsuit...

-most legal experts do not only find the lawsuit a long shot, but a laughable one
-the Supreme Court does have original jurisdiction over disputes between two or more states
-that original jurisdiction historically has been used for border disputes, enforcement of contracts, or incidents where one state infringes on another, for example, like natural gas from one state crossing the border and affecting the citizens or businesses of another
-the Supreme Court has been reluctant to hear or rule on other types of cases between states
-it’s a curious thing for one state to challenge the voting laws of another, since that’s how it’s been since basically 1789. Constitution sets broad parameters on voting. The states have always set the more detailed aspects of voting, including how citizens of each state vote, how votes are counted, and how they select the electors
-if Texas alleges that the defendant states unlawfully changed voting rules using the pandemic as an excuse to affect the outcome of the election, then the Texas attorney general should have included the state of Texas as a defendant as well because they also made last minute changes under the guise of adjustments due to the pandemic, including extending early voting by a week and closing and limiting accessibility of mail-in drop-off boxes

The lawsuit should be thrown out. But I will say this. It’s 2020. And if the Supreme Court actually decides to hear the lawsuit, it would not be the craziest thing that happened this year. And if that does happen, for me, it will just signal the Apocalypse. And what will it matter anyway? It will be the fucking end of the world.

-most legal experts do not only find the lawsuit a long shot, but a laughable one
-the Supreme Court does have original jurisdiction over disputes between two or more states
-that original jurisdiction historically has been used for border disputes, enforcement of contracts, or incidents where one state infringes on another, for example, like natural gas from one state crossing the border and affecting the citizens or businesses of another
-the Supreme Court has been reluctant to hear or rule on other types of cases between states
-it’s a curious thing for one state to challenge the voting laws of another, since that’s how it’s been since basically 1789. Constitution sets broad parameters on voting. The states have always set the more detailed aspects of voting, including how citizens of each state votes, how votes are counted, and how they select the electors
-if Texas alleges that the defendant states unlawfully changed voting rules using the pandemic as an excuse to affect the outcome of the election, then the Texas attorney general should have including the state of Texas as a defendant as well because they also made last minute changes under the guise of adjustments due to the pandemic, including extending early voting by a week and closing and limiting accessibility of mail-in drop-off boxes

The lawsuit should be thrown out. But I will say this. It’s 2020. And if the Supreme Court actually decides to hear the lawsuit, it would not be the craziest thing that happened this year. And if that does happen, for me, it will just signal the Apocalypse. And what will it matter anyway? It will be the fucking end of the world.

Eastman's motion does not offer any specific evidence of any fraud taking place.

Instead, it argues that new ways of voting during the pandemic could have resulted in fraud.

"The constitutional issue is not whether voters committed fraud but whether state officials violated the law by systematically loosening the measures for ballot integrity so that fraud becomes undetectable," it said.

Experts have repeatedly said there is no evidence that mail-in voting systems lead to widespread voter fraud, and many states have had mail-in voting for decades - meaning the new systems rolled out because of the coronavirus pandemic were mostly an expansion of existing voting methods, rather than a new system.

The motion goes on to argue that evidence of fraud may not even be possible to find because the fraud could have been so successful as to be undetectable.

"The unlawful actions of election officials effectively destroy the evidence by which the fraud may be detected," it said.

The motion also argues it is not actually necessary for the Trump campaign to prove fraud took place.

Steve Vladeck, a professor at the University of Texas School of Law, wrote in an NBC News op-ed article that Paxton's lawsuit did not provide evidence that specific instances of voter fraud had taken place.

Instead, Vladeck said, the filing argues against the states' changes to voting rules, even though other states made similar changes.

"Texas is arguing that coronavirus-related changes to election rules in each state violate the federal Constitution, never mind that most states (including Texas) made such changes this cycle," he wrote, describing the filing as a "Hail Mary attempt."
