There are competing theories whether the Democrats winning both seats is a good thing for Biden or not. Obviously, if Republicans control the Senate, Biden won’t feel the same heat from the far left to push their agenda because he can simply blame the Senate. If Dems control the Senate, Biden will feel a lot of pressure from progressives to be much more proactive turning their agenda and ideology into actual policy. And he’ll have a hell of a time balancing Democratic wants.
For me personally, if Republicans maintains control of the Senate and essentially neuter Biden, it won’t be the worst thing ever. And yeah, this is just for me personally. But the election wasn’t about what Biden could do to change things or what great things he could accomplish. The election was about getting that psychopath out of office. A neutered Biden who does nothing except get the pandemic in order is perfectly fine by me. Just no more Trump. That’s all that mattered to me as a voter.

Biden was virtually a Republican for most of his career. He has fostered relationships with many of these people over the years. I think he has 6-12 months in office before the Democrats have him replaced. I'd expect some bipartisan issues to get passed as the temperature lowers over the next 6 months. Do you outlaw the Republican Party? Make Reps who signed a bad amicus brief swear an pledge not to discredit or undermine elections in the future? It's not easy to see how to stop fascism from taking power without resembling it in certain ways.

Their legislative clout would be akin in some ways to the Reconstruction Congress, but legislatively it could be screwed up either SCOTUS or Joe Manchin. And I don't see how any Constitutional Amendments could be passed without an analogous purge of disloyal Republicans in the various states.
All this would look exactly like tyranny to Republicans, but tyranny is exactly what many of them are calling for now.
This strikes me a particularly dangerous juncture for democracy in the US. The malady and the cure both appear to be very bad.

I don't think signing an amicus brief legally speaking amounts to insurrection or treason, but it aimed at something similar. The more pertinent question for me is practical, not philosophical. How does democracy protect itself from an anti-democratic political party, without wrecking democracy?
Just wait 'til the next election is a naive slogan, given twenty years of Republican gerrymandering, voter suppression and the Electoral College -- plus Trump's brazen attempt to steal this election in court, which was supported by 90%+ of the GOP.

FUN FACTS:
In 1876, Congress could not agree on whether or not to count the electoral votes.
The Democrat controlled House refused to allow even the envelopes to open.
The Republicans alleged electoral fraud, while the Democrats claimed that no such fraud had occurred.
Congress missed ALL THE DEADLINES it was required to meet.
Adding up the state certifications resulted in the following totals:
(R) Rutherford B. Hayes = 165 electoral votes
(D) Samuel J. Tilden = 184 electoral votes
Disputed = 20 electoral votes
A candidate needed 185 electoral votes to win.
The 20 disputed electoral votes came from 4 states.
Because the Democrats refused to admit fraud had taken place, a solution was crafted:
The Electoral Commission Act (19 Stat. 227) was signed into law by President Ulysses S. Grant.
The Electoral Commission consisted of 5 House Democrats, 5 Senate Republicans, and 5 Supreme Court justices.
It would deal with the 20 disputed electoral votes.
The Electoral Commission awarded all 20 electoral votes to (R) Rutherford B. Hayes.
The Democrats THREATENED to filibuster the results, so an informal, awful, and unprecedented deal called "The Compromise of 1877" was made:
In return for the Democrats ACCEPTING Rutherford B. Hayes as POTUS, reconstruction would be ended and all federal troops would be withdrawn from the South.
For the Democrats, electoral fraud paid off.
They took control of the South for a century, and continued robbing black Americans of their full rights as citizens.
The Election of 1876 was not resolved until 2 DAYS before Inauguration Day.
