Because being classified or not has some regulatory implications, and things government can do in that case. It's actually a very critical distinction.
You want to apply public utility legal standards to a company that's not a public utility, that's why it's important that you become familiar with that classification.
That will also answer why they're not being regulated as a public utility, and pretty much make your argument moot.
