A Physician in South Texas on an Unnerving Encounter with an Eight-Year-Old Boy in Immigration Detention

“I kneeled down in front of the recliner, and this kid just threw himself into my arms and didn’t let go,” Alicia Hart, an emergency physician in South Texas, said. “He cried and I cried.”

Alicia Hart has worked as an emergency physician in South Texas for ten years, and has seen a stream of migrant children from Guatemala and Honduras come to the U.S. fleeing gang violence.

The number of young children in detention facilities rose sharply. “The population I’ve been starting to see is younger, and it scares me,” Hart said.

“These are little people, little babies. And they are ill-equipped to fend for themselves. They’re so totally traumatized. They don’t cry like normal kids. They don’t interact like normal kids.”

Last week, on a day when Hart was on duty, the charge nurse called her over to examine a child who needed clearance for psychiatric treatment. He was eight years old, and he sat hunched in a recliner chair next to the nurses’ station.

Four men, who had brought him from an unidentified holding facility for migrant children, hovered around him.

The guardians didn’t step more than two feet away from the kid. One of the four was an armed police officer. I thought,

Does it take an army of adult men to take care of one elementary schooler?

I walked over to the boy, crouched down, and asked him, in Spanish, ‘How do you feel?’ ‘Sad,’ he said.

“The boy had been in custody for over a month.

One of his guardians told me that he had been ‘acting out’ and threatening to harm himself, by jumping from his bed.

This man told me,

‘I’m his clinician,’ but he was definitely not a doctor.

I don’t know if he’s a social worker, a medical assistant, a housekeeper. I have no clue.

But he obviously had been granted some sort of authority in regard to assessing children and determining what their needs are.

He wouldn’t provide basic background.

I couldn’t find out any information because he would say, ‘I’m not at liberty to tell you that’ and ‘You don’t need to know that,’

even though a lot of my questions were relevant to taking care of the child. I was asking things like ‘Where are his parents?’

“I asked the clinician, ‘When is this child going to be reunited with his parents?’ He was evasive. First it was ‘Oh, well, we don’t know.’ And then it was

‘Well, he won’t be reunited with his parents unless he behaves.’

The lack of compassion was scary, and it didn’t seem like there was really a plan.

While I held him, I heard the men standing behind me muttering that I was ‘rewarding his bad behavior.’

For 50 years the Protocol has governed the treatment of refugees and asylum seekers by every President until Donald Trump.

Article 1 defines refugee in a basic way

A person who owing to a well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion, is outside the country of his nationality and is unable or, owing to such fear, is unwilling to avail himself of the protection of that country; or who, not having a nationality and being outside the country of his former habitual residence as a result of such events, is unable or, owing to such fear, is unwilling to return to it.


Article 31 (https://www.ohchr.org/EN/ProfessionalInterest/Pages/StatusOfRefugees.aspx) is quite long and I encourage you to read it. While it says refugee the rules also cover asylum seekers and covers who qualifies and their basic treatment. The only real dis-qualifier is being guilty of a serious crime or being engaged in nefarious acts.

Article 33 (https://www.law.cornell.edu/uscode/text/8/1158) covers asylum seekers and again is quite detailed not only concerning the rights of the refugee/asylum seekers and how they are to be handled.


The main dos and don’ts outlining the responsibility fo the signatories regarding asylum seekers referred to as Aliens.


Aliens only have to be on US soil, they are not required to come thru a port of entry.
Aliens cannot be charged with the crime of illegal entry.
Aliens have one year to apply for asylum
Aliens must provide proof of substantial danger requiring asylum
Family units must be kept together and adjudicated as a single application
Aliens must be granted access to legal counsel and the courts
Aliens may be finger printed and photographed for identification
Aliens have the right to appeal court decisions within 30 days
If asylum denied the alien can not be returned to country they fled a neutral safe third country must be found.
The asylum process should take no more than 180 days after alien is positively identified and the filing for asylum
There can be no bias in determining asylum Any laws passed regarding refugees and asylum seekers must be in compliance with this agreement.

Requiring unaccompanied minors to go through deportation alone is not a new practice.

But in the wake of the Trump administration’s controversial family separation policy, more young children — including toddlers — are being affected than in the past.

The 2,000-plus children will likely need to deal with court proceedings even as they grapple with the ongoing trauma of being taken from their parents.

“We were representing a 3-year-old in court recently who had been separated from the parents. And

Mirian had her identification, her son’s birth certificate, which listed her as his mother, his hospital birth record and his vaccination records.

It was three months before they were reunited.

Administration officials have said repeatedly that asylum seekers who don’t want to be separated from their children should present themselves at a port of entry. Doing so is the legal way to ask for asylum,

court filings describe numerous cases in recent months in which families were separated after presenting themselves at a port of entry to ask for asylum.

This happened even when

asylum seekers carried records, such as birth certificates or hospital documents, listing them as the parents of their children,

according to interviews and court records.

But despite having sponsors willing to provide housing in the United States, the federal government has continued to hold them instead of granting them parole.

“Today’s decision will have an enormous impact on asylum seekers, who pose no risk, and are currently languishing in detention.

It is a rejection of the Trump administration’s blanket policy of denying parole to those seeking protection in this country,” said Human Rights First Legal Director Hardy Vieux.

Are Democrats Up to the Task of Combating Trump’s Wanton Cruelty?

While the administration forces families to pay a fortune to take custody of detained minors, party leaders tone-police their lefty colleagues and seem unready for the battle ahead.

forced to pay for their young relatives’ travel to their new homes.

These mostly low-wage workers, some of them undocumented themselves, are

having to come up with thousands of dollars to get the children they’ve agreed to take in.

As it happens, there is a federal regulation that asks families to pay this fee. But, facing a crisis of minors at the border, the Obama administration waived it.

It turns out the Trump administration actually likes some regulations: the ones that are cruel to the vulnerable.

So it is enforcing this one—even though it may cost the government more money, by delaying the transfer of kids to their families.

“The human cost incurred aside, the financial cost for the government is significant,” the head of refugee resettlement under the Obama administration told the Times. “One day of care could cover transportation costs.”

Take that in: The humanitarian choice is also the fiscally responsible one.

The Trump administration is choosing to spend extra money

to be extra-punishing to these already traumatized children and their families.

the U.S. Immigration and Customs Enforcement (ICE) is now getting a military makeover

it’s important to note that

ICE is being grown, increased, resupplied and militarized as never before

, as if Trump wants to ramp up for to some terrible new conflict, or the next Civil War.


“Sounds like they’re getting ready for war,”

a retired ICE agent, Rob Uribe Álvarez, told The Young Turks.

ICE is, according to The Young Turks

“quietly training its deportation officers in the use of weapons more familiar to the U.S. military than to domestic law enforcement, federal records show.”

Once just a border agent, today ICE can be found on highways miles from the border checking identities, at airports or be serving at one of the mushrooming numbers of mass detention centers that already hold not 2,000 but close to 10,000 children taken from their parents or accompanying adult.


“The agency’s Enforcement and Removal Officers are being trained in the use of

M4 assault rifles,

chemical agents,

stun grenades, and

flashbangs,

according to federal procurement records reviewed by TYT.”


“The M4 assault rifle is used extensively by the armed forces and has been the primary service weapon for the U.S. Marine Corps.”

ICE recently signed a $15 million dollar contract with Colt to provide 8,000 more guns and maintain the weapons.

Today,

ICE has 5,000 M4 rifles in service and

with the 8,000 more M4’s, under federal procurement procedures,

they will have 13,000 of the powerful weapons that cost almost $1,000 each.

“Most immigration violations are not a violation of federal law, they’re just misdemeanors.”

Turning those officers into soldiers in the war on terrorism, crime and whatever else gets budget appropriations passed, makes them much scarier, fearsome figures,

“We’ve seen how militarized gear can sometimes give people the feeling like there’s an occupying force –

as opposed to a force that’s part of the community that’s protecting them and serving them.”

The president added that such gear

“can alienate and intimidate residents and make them feel scared.”

An “occupying force” that instills fear in the local citizenry sounds like

a formula for an authoritarian regime that would tell us how they needed to protect us by taking away our constitutional rights –

The 7-year-old, identified in the declaration as “M.”, “asked me why I had not picked him up yet,” Serrano wrote. “The social worker told me that [he] is depressed and asked me for words of encouragement to cheer him up.”
