One hypothesis seems to be that because Homan's promise was worthless, no corrupt act was undertaken when he took the money. That would maybe have had to have been legally perfected in an official action traceable to the payment, for Homan to be held legally responsible. It only makes sense, the law has to clear a high bar to punish its targets.

Apparently the bar for MAGA has been pushed into the ground, there was no accountability of any kind for Homan.

In previous Republican administrations, careers were derailed by the mere rumor of official investigation. Holding Homan accountable for evident corruption -- by for example not appointing him to government -- seemingly wasn't even a question here.

A wildland firefighter who was arrested by immigration agents while fighting a wildfire in Washington state has been released from detention by U.S. Immigration and Customs Enforcement, his attorneys said Wednesday.

Rigoberto Hernandez Hernandez was freed Tuesday after nearly four weeks in detention at the Northwest ICE Processing Center in Tacoma, Washington. Hernandez is now back home in Oregon with his family, said Matt Adams, legal director with the Northwest Immigration Rights Project, which is representing him.

The group, along with attorneys at Oregon-based Innovation Law Lab, said that the arrest of Hernandez was illegal and violated due process. The groups’ petition for habeas corpus is still pending.

Adams said the government has dismissed its proceedings to remove Hernandez from the country.

“They’re acknowledging that there’s no justification for this arrest or this type of enforcement action targeting people who are on the front lines working to keep our community safe,” Adams said in an interview.

Attorneys for Hernandez filed the habeas corpus petition on Friday, and the government’s response was due at noon on Tuesday, Adams said. Rather than refuting the claims of due process violations, ICE released Hernandez around midday on Tuesday.

“I am glad that I am home, and I am excited to see my family,” Hernandez said in the statement issued by the legal groups. “I want to give my thanks to everyone — for their prayers, for the rallies, for sharing about what happened to me and the other firefighter. So many people stepped up to help, and now I want to help others just like they helped me.”

A 79-year-old Van Nuys car wash owner has filed a federal civil rights claim seeking $50 million after he says he was violently body slammed and pinned by federal agents during an immigration raid at his business on Sept. 9. The claim names the Department of Homeland Security, U.S. Customs and Border Protection, U.S. Border Patrol, and Immigration and Customs Enforcement as defendants.

Rafie Ollah Shouhed, a longtime Valley Car Wash owner, said he was inside his business at 7530 Van Nuys Blvd. when masked agents stormed the premises. Surveillance video reviewed by KTLA shows a federal agent shoving Shouhed to the ground inside a hallway.

Shouhed told KTLA he stepped outside to speak with the agents, offering proof that his employees were legally authorized to work, but was instead cursed at, pushed back, and body slammed onto the pavement. According to the civil rights claim, three agents then jumped on his back, with one forcing a knee onto his neck while others restrained his arms.

“They grabbed one of my guys, and I told them, hold on, some of these people have papers, they have the documentation here. And the only thing they said was, ‘You don’t F with ICE. We are here,’ and they threw me on the floor … and three of them, they jumped on me and they were sitting on me,” Shouhed told KTLA in a previous interview (https://ktla.com/news/local-news/van-nuys-car-wash-owner-raided-by-ice-speaks-out/).

Shouhed claims he told agents he had recently undergone heart surgery, had three stents, and could not breathe, but that his pleas were ignored.

He was handcuffed, transported to the Metropolitan Detention Center in Los Angeles, and held nearly 12 hours without medical attention, he alleges. Despite agents later acknowledging he was a U.S. citizen, Shouhed said he was denied phone calls to his family and released without charges.

After his release, Shouhed was treated at a local hospital for multiple broken ribs, elbow injuries, contusions, and post-concussive symptoms of a traumatic brain injury. He says he continues to suffer both physical and psychological effects.

Attorney V. James DeSimone, who filed the claim on Shouhed’s behalf, said in a statement that federal agents’ actions were “outrageous and unlawful” and violated both federal and California civil rights laws.

The $50 million claim alleges assault, battery, violation of the California Bane Act, deliberate indifference to a serious medical condition, intentional infliction of emotional distress, and other torts. It also claims that DHS, ICE, and CBP maintain policies that tolerate the use of excessive force.

He continued to say that they kept the bathrooms inside the cells where people were held.


“They’re, they’re animals anyway. That’s what I would tell my kids all the time,” said the agent, who said he worked in the “intelligence unit.”

While dozens of federal immigration agents took individuals into custody during a winding patrol through downtown Chicago on Sunday, a top U.S. Border Patrol official told WBEZ the agents were arresting people based on “how they look.”

Gregory Bovino, commander at large of the border force, even contrasted the people being arrested to a white WBEZ reporter, saying agents consider a person’s appearance before taking them into custody.

“You know, there’s many different factors that go into something like that,” Bovino said. “It would be agent experience, intelligence that indicates there’s illegal aliens in a particular place or location.”

“Then obviously the particular characteristics of an individual, how they look, how do they look compare to, say, you?” he said to the reporter, a tall, middle-aged man of Anglo descent.

Kenny Laynez-Ambrosio, 18, was born and raised in West Palm Beach, Fla., where he lives with his mother and two brothers.

He was on his way to work with his mother and two friends in May when troopers from the Florida Highway Patrol stopped them in their employer’s pickup truck for what the agency said was a “commercial motor vehicle inspection.” Initially, Mr. Laynez-Ambrosio was calm, he recalled in an interview. But the situation escalated as troopers learned that others in the car were undocumented and ordered everyone out.

When no one got out of the vehicle, the troopers began to pull the three men out. At one point a trooper fired a Taser at one of them.

Mr. Laynez-Ambrosio, recording on his phone, repeatedly told the officers, “I’m from here!”

“You’ve got no rights here. You’re illegal, brother,” a trooper is heard saying. They wrestled another owner, Javier Ramirez, 32, to the ground, holding him at gunpoint, and pushed Mr. Gavidia against a fence.

Asked about the men’s cases, D.H.S. has said that Mr. Gavidia interfered with their enforcement operations and that Mr. Ramirez assaulted officers. But Mr. Gavidia was never charged, and a charge against Mr. Ramirez was dropped. Security videos of the incident reviewed by The Times do not show Mr. Ramirez assaulting officers.

In several of the cases, D.H.S. officials told The Times that the citizens assaulted officers; prosecutors have not pursued charges in any of those incidents.

A man from Pasadena is speaking out and asking for help after his wife was detained by federal agents at the end of a scheduled green card hearing in downtown Los Angeles in early September.

Tucker May says that his wife, Barbara Gomes Marques, 38, was on her way to becoming a U.S. citizen when they headed to the Edward R. Roybal Federal Building almost two weeks ago. He says that at the end of her meeting for her green card, someone asked his wife to accompany them down a hallway to make a copy of her passport, which they thought was the next step in her gaining citizenship after they were married last year.

Now, he believes it was a trick to get the two separated before she was taken into custody by U.S. Customs and Border Protection agents.

"Going home without her that night was one of the hardest things I've ever had to do," May said. "She put so much effort into looking nice, because she was excited to take a step toward becoming an American, and I had to go home, and I had to put away the shoes that they took off her feet and gave to me in a plastic bag."

He says that Marques is a documentarian without a criminal record who came to the U.S. on a tourist visa seven years ago.
"They put her in hand shackles and in leg shackles, and around the waist as well, like she's some hardened criminal. She had tears streaming down her face, and she told me one of the ICE agents pulled out his cell phone, laughing, and took a selfie," May said.

CBS News Los Angeles has reached out to both ICE and the Department of Homeland Security for further information on the incident. May said that they told his wife she was arrested for missing a court date regarding her status in 2019, something he says they were completely unaware of.

Marcelo Gondim is an immigration attorney who is helping represent the couple. He says that Marques spent a week at the Adelanto ICE Facility in Adelanto, CA, before she was transported to a different detention center in Arizona. She is set for transport to Louisiana, which he believes is her last stop before deportation. He claims that this is a tactic now being used to convolute the process.

"They're trying to remove her as far away as they can from her counsel, from her family, so that kind of cuts on her ability to defend herself," Gondim said. "Knowing that she's married to a U.S. citizen, she has a legal way to become a permanent resident in a matter of months. If they just gave her a chance to find her paperwork."

Gondim said that they've filed an emergency application for a temporary restraining order to stop her from being moved to a new detention center or deported.

While they wait to hear back from a judge, May is desperately calling for help, something he says that even goes above bringing his wife back.

"I'm a man trying to get his wife back home, and we need someone with more power than I have to help," May said. The 22 people, who were arrested in the early days of President Donald Trump’s second term, were all released on bond and are no longer in custody. Cummings ordered ICE to reimburse all of their bond payments and to lift any imposed conditions of release.

Cummings also extended the settlement agreement to Feb. 2 and ordered ICE officials to make monthly reports with the names and identification numbers of all people arrested without a warrant. ICE will also produce an arrest report that justifies why the individual was arrested without a warrant. According to the ruling, ICE officials have until Oct. 22 to release warrantless arrest data going back to June.

Mark Fleming, associate director of litigation for the National Immigration Justice Center, said his organization has already identified more than 200 people whose arrests likely violated the consent decree.
