A federal judge on Wednesday said he has found probable cause to hold President Donald Trump’s administration in criminal contempt of court for violating his orders to turn around planes carrying deportees to El Salvador.
U.S. District Judge James E. Boasberg warned he could refer the matter for prosecution if the administration does not “purge” its contempt. Boasberg said the administration could do so by returning to U.S. custody those who were sent to the El Salvador prison in violation of his order so that they “might avail themselves of their right to challenge their removability.”

Bukele was elected in 2021, winning on a platform that promised to (once again) “crack down” on gang violence. But his party, Nuevas Ideas, did so with the support of a critical group: Yep, MS-13. Prior to the election, Bukele and his party negotiated with the gang to bring back the “truce,” which would include (according to the federal indictment) “financial benefits, control of territory, the ability to run the gang from prison, and the early release of gang members.” MS-13 also wanted assurance that they wouldn’t be extradited to the U.S., where they would face more punitive measures. (Having studied the drug cartels in Colombia, this was reminiscent of Pablo Escobar’s mantra, “Mejor una tumba en Colombia, que una carcel in los Estados Unidos” – which means, “Better a grave in Colombia than a jail cell in the United States.”) The same day he took office, Bukele removed the Attorney General and five members of the Supreme Court who had been working with the U.S. to take real action against MS-13. He also released a major MS-13 leader whom the U.S. was seeking for extradition from prison.
In exchange, MS-13 “agreed to reduce the number of public murders in El Salvador, which politically benefitted the government, by creating the perception that the government was reducing the murder rate.” Indeed, Bukele’s popularity is the result of his so-called “Territorial Control Plan (https://www.vox.com/world-politics/2023/3/5/23621004/el-salvador-prison-bukele-ms13-barrio-18),” which involved building his supermax prison and his plan of mass incarceration – a plan which he credits for the drop in violence since he took office. Of course, the citizens of El Salvador aren’t privy to the secret negotiations Bukele made with MS-13 – details that were going to be made public when the U.S. government’s case against the MS-13 defendants went to trial. Which may explain why the Trump administration quietly dropped these charges last week and put the charged MS-13 members on the third plane bound for El Salvador (and which included Abrego Garcia). Among the defendants was one of the highest-ranking leaders of MS-13, Cesar Humberto Lopez-Larios, who was arrested last June (https://www.justice.gov/usao-edny/pr/fugitive-high-ranking-ms-13-leader-arrested-terrorism-charges)and added to the earlier indictment (and who almost certainly will not face real punishment in El Salvador). In short, both Trump and Bukele appear to be complicit in a plan to allow MS-13 to operate in El Salvador on its own terms, in exchange for making it look like both are “cracking down” on the gang in their respective countries. Of course, the fact that MS-13 will continue to operate in cahoots with the El Salvadoran government means that citizens of that country who are victims of the gang will continue fleeing to the United States, undercutting the Trump administration’s claim that it is trying to end the “invasion” of asylum seekers. Then again, Trump needs a steady influx of people to continue trying to cross the border in order to keep claiming the “national emergency” he is using to expand his authority. So it’s a win-win propaganda operation.

The other reason is that the deal as written simply undercuts the Trump administration’s legal claim that it can’t do anything to secure Abrego Garcia’s return. The AP has quoted internal memos from El Salvador’s Ministry of Foreign Affairs, which states that the country will “house these individuals for one (1) year, pending the United States’ decision on their long term disposition.” Meaning that the U.S., not El Salvador, is in control of what happens to the people sent there – undercutting recent claims (https://www.usatoday.com/story/news/politics/2025/04/12/trump-administration-abrego-garcia-el-salvador-prison/83064663007/)made in court by the Justice Department that they are being held under the “domestic, sovereign authority” of El Salvador.

Andry Jose Hernandez Romero — the gay Venezuelan makeup artist the DHS shipped off to an El Salvador prison — was declared a gang member by the extremely dubious assertions of a Milwaukee, Wisconsin ex-cop who was such a terrible cop, he’s now reduced to working for private prison company, CoreCivic (https://www.jsonline.com/story/news/investigations/2025/04/10/fired-milwaukee-cops-report-helped-send-gay-stylist-to-el-salvador/83023882007/), which hired him only four months after he resigned rather than be fired by the PD.
A disgraced former Milwaukee cop with credibility issues (https://www.jsonline.com/story/news/investigations/2025/03/04/milwaukee-countys-police-officers-brady-list-is-inconsistent-incomplete-prosecutors/78390712007/) helped seal the fate of a gay Venezuelan makeup artist sent to El Salvador’s notorious prison, according to documents reviewed by USA TODAY.
A report approved by the police-officer-turned-prison-contractor claimed the Venezuelan man was a member of the notorious Tren de Aragua gang.
But the credibility of Charles Cross, Jr., who signed the report, was so bad, prosecutors flagged him on a list of police who had been accused of lying, breaking the law or acting in a way that erodes their credibility to testify in Milwaukee County.
Former officer Cross was fired from the Milwaukee PD in 2012 for crashing his car into his own home while intoxicated. At the time, Cross was also being investigated for overtime fraud and had already racked up enough misconduct charges that Milwaukee County prosecutors placed him on the “Brady List” — a list of all law enforcement officers the prosecutor’s office felt presented serious credibility issues.
That string of events ended Cross’s law enforcement career, but he’s managed to find a way to keep fucking people’s lives up while working within the confines of the private sector.
Today, Cross, 62, is one of the private prison contractors helping to identify Venezuelan migrants as members of the criminal outfit Tren de Aragua (https://www.jsonline.com/story/news/politics/2025/03/18/what-is-tren-de-aragua/82520940007/) – a designation that’s landing them in a Salvadoran prison without due process.
Entrusting private contractors – and not federal agents – to determine whether migrants are members of a criminal gang adds a new level of apprehension, migrant advocates and a former ICE official said.
The documents obtained by the Milwaukee Journal Sentinel show Cross made this determination. Whether or not he acted alone is still unknown. The DHS refuses to answer questions about this case, as does CoreCivic. The only other name on the report that turned Andry Romero into a gang member is Arturo Torres, another employee of CoreCivic.

A co-worker of mine (who is a judge), traveled by train from Montana to North Dakota for work this week. The train made a stop in Havre, MT, where ICE agents—armed and dressed in full military-style tactical gear—boarded the train.
They walked the full length of the train and questioned every single passenger about their citizenship status. According to the conductor, who has worked nearly 40 years on that route, this was a first. In all his decades of service, federal agents have never boarded his train like this.
This is not a hypothetical. This is not a scene from a dystopian film. This happened this week to my colleague, on U.S. soil, to U.S. citizens, legal residents, and foreign tourists here on holiday, without a warrant, without probable cause—based solely on geography.
Under current law ICE has expanded authority to operate within 100 miles of any border. But HOW that authority is being interpreted and exercised has chilling implications for civil liberties, freedom of movement, and equal protection under the law.
This isn’t about politics—it’s about the erosion of rights we’ve taken for granted, and the slow normalization of military-style policing tactics in everyday spaces. Even if technically permissible, these actions reflect a disturbing shift in the balance between civil liberties and governmental authority. The normalization of militarized immigration enforcement in public spaces, without individualized suspicion, risks setting dangerous precedents that erode the freedoms we are sworn to uphold.
This is not about ideology—it is about the integrity of our legal system. I am compelled to speak up because there is no justification for circumventing the very rights and principles that define our democracy.
The question is not whether you “have something to hide.” The question is how much unchecked authority we’re willing to allow before we can no longer call this a free society.

Last month, Clay Jackson was at the gas station just up the street from his home in a Dallas suburb when one of the attendants asked if he might provide some legal advice to an immigrant family.“There’s a guy in there who just shoots the shit with you when you come in to pay,” Jackson says. “He’d heard that I had previously given some pro bono legal help to a family who owned a barbecue restaurant. He said there was family in the area where the dad had been caught up in one of the ICE workplace raids and they’re really freaking out. The parents were undocumented, while one of the kids is DACA and the other is a U.S. citizen.”
The man asked Jackson if he would be willing to “just talk to them and make sure they know their rights and where they can some help. I said absolutely. I’m not an immigration lawyer, but they were scared to reach out to anyone, so I said I’d go there and try to just give them the basics.”
Later that afternoon, March 4, Jackson visited the family in their home. “It was a little difficult to communicate because everything had to be translated through the 10-year-old kid.” He met with them for less than an hour and told them their rights if they’re detained by ICE. “I said I’d help find them pro bono counsel who specialized in immigration.”
“A couple days later, on March 6, I was working from home at around 11:30 when I got a notice that my VPN had gone down,” he says. “I didn’t think much about it. It can cut out from time to time. About 10 minutes later, I got a knock at the door.”
Two men were outside Jackson’s door, dressed in slacks and polos. They were not wearing badges.
“I first thought they were going to try to sell me something. But as soon as I opened the door they said, ‘Are you Clayton Jackson?’ I think I shook my head or said ‘yeah,’ and then I heard, ‘We have information that you are obstructing an ongoing immigration investigation.’”
Jackson says alarms went off in his head. “My first instinct was to want to know what this was about. That it must be a misunderstanding. So I started to tell them about how I’ve been involved in some pro bono work. Then this voice in my head kicked in and just said, you need to shut the fuck up — don’t say anything.”
The officers never identified themselves. They did ask if they could come inside.
“I said absolutely not,” Jackson says. “I asked for their names and badge numbers. They said they didn’t have to provide that information at this time. So I told them I’d be calling my lawyer and I shut the door behind me.”
Jackson says his mind started racing. “I needed to know who they were, what agency they were with. Then I remembered that I have the Ring camera. Maybe I could watch the video of the incident and figure out who they were from that.”
There was no video. “That’s when I learned why my VPN had gone down. It wasn’t the VPN. Someone had shut off my Wifi.”

This attorney mentioned that he’d recently had some work done on his home, and had gotten to know one of the contractors. The contractor was undocumented, and feared he may be deported. In the 20-some years he’d been in the U.S., this contractor had done well for himself — he owned his contracting business, his home, and some property. He asked if the attorney could help him transfer the business and title to his home and property to his son, who is a U.S. citizen. The attorney and his wife — who is also a lawyer — agreed to help.
“As my wife and I started filling out the paperwork, we realized that we might be doing this sort of work for other people over the next few years, so she suggested we bring up one of the old desktops from the basement, so whatever immigration work we were doing would be on a separate computer.”
The attorney’s college-aged son had taken an interest in all of this.
“My son asked if what we were doing was illegal. I told him it was all perfectly legal. Then he asked me a question I really couldn’t answer: Why did we feel like we had to take these steps to hide legal work that was perfectly legal? And all I could think to say was that this is the kind of country we live in now.”

On March 28, the court ordered (https://storage.courtlistener.com/recap/gov.uscourts.mad.282404/gov.uscourts.mad.282404.34.0.pdf)the defendants in the case – the Department of Homeland Security including ICE and the Department of Justice – not to deport any individual with a final removal order “UNLESS and UNTIL Defendants provide that individual, and their respective immigration counsel, if any, with written notice of the third country to where they may be removed, and UNTIL Defendants provide a meaningful opportunity for that individual to submit an application for CAT [Convention Against Torture] protection to the immigration court” (capitalization emphasis in original).
The government now says it did remove these individuals to El Salvador after the court’s order! The government’s excuse: The removal to El Salvador was carried out by the Department of Defense (DOD) rather than DHS/ICE, and the former is not a named defendant in the case. And what the accompanying ICE official’s affidavit makes clear is that the DHS was directly involved in their removal. That’s because DHS had custody of several of the individuals after the court’s order, and then transferred them to DOD after the court’s order. Indeed, DHS apparently transferred some individuals to the DOD base in Guantanamo. The base served as a very temporary holding place until their transportation by DOD to El Salvador a few days later. Tucson immigration attorney Jesse Evans-Schroeder told the Star she has “very little faith” in the type of sworn statement cited here, which are “typically riddled with inaccuracies or expected/desired responses, rather than true responses.”
Also, signatories of these statements don’t always know what they’re signing, Evans-Schroeder wrote in a Monday email.
CBP now uses a “little signature tablet for the affiant to sign which is *not* connected to any screen on which you can see what the officer wrote,” she said. “The CBP guidance literally says that this is very handy for them, because they can make ‘corrections’ to the statements without having to go back and get a new signature.”
Due to the uncertainty of what happened, DHS should conduct an investigation of the incident, said Aaron Reichlin-Melnick, senior fellow with the American Immigration Council, a research and analysis nonprofit that advocates for immigrant rights.
"DHS would normally carry out an investigation of any arrest of a U.S. citizen and determine the full facts of the matter before commenting publicly," he said. "Unfortunately, that does not appear to have happened here."

He had his due process back in 2019 before an immigration judge and an immigration appeals court that denied him and he was designated by both to be an MS13 gang member and a threat to the community and ordered deported. He was held for 6 months while they tried to find a country to deport him to and when there wasn't a country that would take him in the statute required he be released from detention. Abrego Garcia, along with three others, were detained by Maryland local police on March 28, 2019. One detective immediately recognized one of the four as an MS-13 member — “Bimbo” — known to him from previous contacts. That individual had been encountered multiple times by the “Prince Georges County Gang Unit MS-13 Intelligence Squad.” The MS-13 problem is so bad they have an entire Gang Unit with its own Intelligence Squad dedicated to identifying and investigating MS-13 members. “Bimbo” has an extensive criminal record with multiple convictions.
A second individual – not confirmed as an MS-13 member – had tattoos indicative of Hispanic gang membership. Eyes, ears, and mouths covered by skulls which are meant to emphasize “see no evil, hear no evil, speak no evil” and communicate the need to stay silent. A past proven and reliable source of information identified this second person as an MS-13 member with the gang name of “Maniaco.” This individual also had a calf tattoo known to represent high level MS-13 members.
Abrego Garcia was wearing a Chicago Bulls hat – images of a bull’s head with horns is indicative of an MS-13 member in good standing. The same source of information identified Abrego Garcia as an MS-13 member with the gang name “Chele”
Of interest, however, is that the fourth individual was not known to the police or the source of information as an MS-13 member. If, as has been suggested, this source of information was not reliable and had fabricated the information about Abrego Garcia being a member of MS-13, why did he not fabricate information about the 4th individual who, according to the report, was released at the scene.
All of those details come from the Maryland local police who encountered the four men.
Abergo Garcia freely admitted to being a Salvadoran citizen in the United States illegally, and he was turned over to the custody by ICE -- there is an ICE Form I-213 dated March 28, 2019, completed the same evening by two ICE agents. On March 29 he was given a Notice to Appear at a Removal Hearing, and was detained in custody by DHS pending that hearing. The I-213 states it was the Prince Georges County Police Gang Unit who first encountered the four when they were “detained in connection with a murder investigation.” This wasn’t a random police contact – it was the Gang Unit contacting known gang members. It doesn’t say they were suspects in a murder, only that they were detained in connection with an investigation. The I-213 says in multiple locations that Abrego Garcia is an MS-13 member – based on the information given to ICE by the local police Gang Unit dedicated to MS-13.
Abrego Garcia was denied bond after a hearing on April 24, 2019. In the written Memorandum dated May 22, 2019, documenting the denial of the motion, the Immigration Judge stated:
“[T]he determination that the Respondent is a gang member appears to be trustworthy and is supported by other evidence in the record, namely, information contained in the Gang Field Interview Sheet…. [T]he fact that a “past, proven, and reliable source of information” verified [Abrego Garcia’s] gang membership, rank, and gang name is sufficient to support that the Respondent is a gang member….”
The “determination” was made by the Maryland police and adopted by ICE. These are not casual decisions made by the flip of a coin. Accurately identifying gang affiliations is a paramount concern when it comes to arrest/detention/ incarceration. Having members of rival and hostile gangs housed together is an invitation to widespread violence. So accurately determining gang affiliation is the reason why police have gang unit “Intelligence Squads.” To dismiss this determination — as Judge Xinis does in almost comical fashion in her April 6 Opinion for this poor “Maryland Man” — only exposes ignorance as to how and why these determinations are made.
The Board of Immigration Appeals, in a written decision December 19, 2019, adopted and affirmed the Immigration Judge’s decision denying bond to Abrego Garcia on the basis of his status as an MS-13 member.
“[Abrego-Garcia] argues that the Immigration Judge clearly erred in determining that is a verified member of MS-13 because there is no reliable evidence in the record to support such a finding…. We adopt and affirm the Immigration Judge’s danger ruling…. [T]he immigration judge appropriately considered allegations of gang affiliation against the respondent in determining that he has not demonstrated that he is not a danger to property or persons.”
“Gang affiliation” is not a “crime.” So the claim that Abrego Garcia has never been charged with a crime where his gang affiliation was “proven” in court is meaningless. I suspect the Immigration Judge who made the initial FACTUAL FINDING, and the Board of Appeals panel who affirmed that “FACTUAL FINDING” have reviewed far more MS-13 determinations made in this fashion than has Judge Xinis from the district court bench.

One detective immediately recognized one of the four as an MS-13 member — “Bimbo” — known to him from previous contacts. That individual had been encountered multiple times by the “Prince Georges County Gang Unit MS-13 Intelligence Squad.” The MS-13 problem is so bad they have an entire Gang Unit with its own Intelligence Squad dedicated to identifying and investigating MS-13 members. “Bimbo” has an extensive criminal record with multiple convictions.
A second individual – not confirmed as an MS-13 member – had tattoos indicative of Hispanic gang membership. Eyes, ears, and mouths covered by skulls which are meant to emphasize “see no evil, hear no evil, speak no evil” and communicate the need to stay silent. A past proven and reliable source of information identified this second person as an MS-13 member with the gang name of “Maniaco.” This individual also had a calf tattoo known to represent high level MS-13 members.
Abrego Garcia was wearing a Chicago Bulls hat – images of a bull’s head with horns is indicative of an MS-13 member in good standing. The same source of information identified Abrego Garcia as an MS-13 member with the gang name “Chele”
Of interest, however, is that the fourth individual was not known to the police or the source of information as an MS-13 member. If, as has been suggested, this source of information was not reliable and had fabricated the information about Abrego Garcia being a member of MS-13, why did he not fabricate information about the 4th individual who, according to the report, was released at the scene.
All of those details come from the Maryland local police who encountered the four men.
Abergo Garcia freely admitted to being a Salvadoran citizen in the United States illegally, and he was turned over to the custody by ICE -- there is an ICE Form I-213 dated March 28, 2019, completed the same evening by two ICE agents. On March 29 he was given a Notice to Appear at a Removal Hearing, and was detained in custody by DHS pending that hearing. The I-213 states it was the Prince Georges County Police Gang Unit who first encountered the four when they were “detained in connection with a murder investigation.” This wasn’t a random police contact – it was the Gang Unit contacting known gang members. It doesn’t say they were suspects in a murder, only that they were detained in connection with an investigation. The I-213 says in multiple locations that Abrego Garcia is an MS-13 member – based on the information given to ICE by the local police Gang Unit dedicated to MS-13.
Abrego Garcia was denied bond after a hearing on April 24, 2019. In the written Memorandum dated May 22, 2019, documenting the denial of the motion, the Immigration Judge stated:
“[T]he determination that the Respondent is a gang member appears to be trustworthy and is supported by other evidence in the record, namely, information contained in the Gang Field Interview Sheet…. [T]he fact that a “past, proven, and reliable source of information” verified [Abrego Garcia’s] gang membership, rank, and gang name is sufficient to support that the Respondent is a gang member….”
The “determination” was made by the Maryland police and adopted by ICE. These are not casual decisions made by the flip of a coin. Accurately identifying gang affiliations is a paramount concern when it comes to arrest/detention/ incarceration. Having members of rival and hostile gangs housed together is an invitation to widespread violence. So accurately determining gang affiliation is the reason why police have gang unit “Intelligence Squads.” To dismiss this determination — as Judge Xinis does in almost comical fashion in her April 6 Opinion for this poor “Maryland Man” — only exposes ignorance as to how and why these determinations are made.
The Board of Immigration Appeals, in a written decision December 19, 2019, adopted and affirmed the Immigration Judge’s decision denying bond to Abrego Garcia on the basis of his status as an MS-13 member.
“[Abrego-Garcia] argues that the Immigration Judge clearly erred in determining that is a verified member of MS-13 because there is no reliable evidence in the record to support such a finding…. We adopt and affirm the Immigration Judge’s danger ruling…. [T]he immigration judge appropriately considered allegations of gang affiliation against the respondent in determining that he has not demonstrated that he is not a danger to property or persons.”
“Gang affiliation” is not a “crime.” So the claim that Abrego Garcia has never been charged with a crime where his gang affiliation was “proven” in court is meaningless. I suspect the Immigration Judge who made the initial FACTUAL FINDING, and the Board of Appeals panel who affirmed that “FACTUAL FINDING” have reviewed far more MS-13 determinations made in this fashion than has Judge Xinis from the district court bench.
