Explain in your own words what is going to happen and what will be litigated.

The only one with seemingly any shot in hell is PA due to Justice Alito's action to separate voting after 8PM on election to votes before and after. The SC delayed action on this matter before the election. Alito's action was mix it has votes put in a separate area but still counted. Apparently it has something to do with the state legislative body and the courts disagreed on when votes could be received or counted. However, Biden will still get 270 unless another state somehow comes into play so would be very likely irrelevant.

I have faith you in, Andy. Come to the most sensible position of Rational Progressivism-Mainstreet Libertarianism, my invention. What's our tenets?

Rational progressivism.

- Anti-war
- Pro-choice
- Pro-LBGT rights
- Ellis Island Model for Immigration (which has provably worked)
- Pro environment (what does this mean? I mean I do my part by recycling and healthy eating, but it should be a personal choice. I'm NOT for extra penalties on civilians for, for example, using extra energy because they set their AC to 68 degrees in a hot Texas summer or drove their car too much because they had to commute to work).
- Sensible gun regulation. Higher minimum age. Tiered licensing procedure. (What age are you talking about? This still doesn't address the illegal guns shipped up from Latin America)
- ANTI-Cancel culture and suffocating political correctness.

Rational progressivism has no interest in exploring the socio-cultural impact of tenuous concepts like "microaggressions" and "patriarchal power dynamics" because they are total bullshit.

Mainstreet Libertarianism

- Is pro deregulation and tax cuts for "mainstreet small businesses" if said deregulation doesn't have any social and environmental consequences. Example. Pete's Barbershop shouldn't have to wade through a labyrinth of bullshit regulatory red tape that is simply imposed to trigger fines to fill city and county coffers. And a tax cut for Pete's barbershop will actually create an additional job.
- Is pro regulation for big corporate entities. Big Oil, Big Tech, Big Pharma all need to be watched like a fuckin' hawk. (Agree on most of these, but I don't want "big oil" to be regulated to the point where gas goes back into the >$3 per gallon range where it was for most of Obama's tenure)
- Is pro taxing the shit out Big Corporate and the billionaire class. Trickle down economics is a proven lie. When Big Corporate gets a tax cut, they simply leverage that into stock buybacks or hoarding capital. Individuals in the billionaire and multimillionaire class aren't taxed enough relative to the millionaire and under class. A person making 400K pays the same amount of Federal Taxes as Jeff Bezos. (Not sure what your "multimillionaire" cutoff amount is, but I do agree on the Bezos of the world cheating their taxes is a big problem)
- Is pro universal health care. Has provably worked in every other country in the world. Stories like your mom's doctor excessively charging for surgeries (because of the symbiotic relationship between health insurance providers and healthcare providers: Doctor overcharges, health insurance raises premiums, more profits for all) would be a thing of the past.

Feel free to print and pass this out to grow the movement.
So I can agree on about 75-80% of the items you listed, tbh.

Bezos and Big Tech are the biggest problem of our time. They cheat their taxes and rake in the billions, perhaps trillions at this point, and don't pass any of the proceeds along to actual consumers or employees, but rather "organizations" and leftist PACs, charities of their choice, etc. The people should choose which charities to donate to, not corporations. I am in the 400K-ish range and don't like when Kamala in the debates targeted me by saying she'd raise taxes on someone making that little -- it's really not a very high number in today's inflated economy. 1 Million I could get behind, but not 400K. And I definitely shouldn't be paying more taxes than Jeff Bezos or Zuckerberg.

Also, no tariffs. The main thing to protect is the "little guy", i.e., the American consumer. Tariffs do nobody any good because they cause inflation by raising the prices of something like a basic Sterilite container from Walmart made in Taiwan or Malaysia from like $7.99 to $13.99. That is unacceptable. We must FIGHT inflation and raise interest rates.

Also, it's good you didn't mention anything about raising the federal minimum wage to some astronomical number like $15.00, which I am vehemently against, and anyone who understands the difference between urban vs. rural should be as well. Price floors are TERRIBLE for an economy, and failing Economics 101. Bob's BBQ pit in Podunk Village, Kansas should NOT be forced to pay employees $15.00 an hour when the average rent is $300 per month and the average 3 bed/2 bath house costs $40,000.

I am okay with a local minimum wage of $15.00 in a few very high COLA locations like San Fran, Seattle, NYC, Boston, Center City Philadelphia, etc... but that must be kept to a local level, not state or federal.

Republicans would have to find a way to slim the margins in California & the northeast - they'd become the party of Larry Hogan/Charlie Baker. It would drastically swing what the political conversation in the country is.

Here are the GOP and Trump campaign’s allegations of election irregularities. So far, none has been proved.

Pennsylvania

As absentee ballots helped Biden overtake Trump in Pennsylvania last week, Republicans sought to stop Philadelphia officials from counting them. Their argument: GOP observers had been barred from the rooms where the votes were being counted.

The problem: That wasn’t true.

Republican observers were there, after all. Trump had “a nonzero number of people in the room,” one of his attorneys conceded in federal court Thursday evening.

“I’m sorry, then what’s your problem?” asked U.S. District Judge Paul S. Diamond, who denied the request to halt the count.

Trump’s team saw a few small victories in the state, though none seems likely to come close to affecting the race’s outcome. The campaign won an order to move observers closer to the counting machines in Philadelphia.

And it succeeded in getting Supreme Court Justice Samuel A. Alito Jr. to issue an order that election officials must separate ballots that arrived after Election Day but before Friday evening — a step that counties have already taken. Under an earlier ruling by the state Supreme Court, election officials may tally those ballots, which are a tiny fraction of the overall vote, but state officials have ordered them to be kept segregated in case of further legal challenges.

Elsewhere in Pennsylvania, Republicans sued to stop local election officials from releasing the names of voters whose absentee ballots had been rejected for errors such as a lack of signature. Local counties release the names so voters can fix the flaws in their ballots.

These suits have not succeeded, either.

In Northampton County, Pa., for instance, a judge wrote that the local GOP needed to prove why it would be injured if voters had a chance to correct their ballots. “As a result, its request for an injunction must fail,” wrote Judge Michael J. Koury Jr.

On Saturday, Trump’s lawyer Rudolph W. Giuliani said that the campaign was preparing to file another lawsuit Monday, alleging wrongdoing on a grand scale in Pennsylvania. “Many cases are going to be filed — some big, some small. This is going to be eventually a big case,” Giuliani said.

Michigan

In Michigan, Biden trailed on election night — but then, as in other Midwestern states, surged back to overtake Trump as thousands of absentee ballots were counted. In two lawsuits, Republicans alleged that there was impropriety in those ballot counts.

They lost, both times. And for the same reason: Republicans could not provide evidence of wrongdoing.

In one case, Republicans said GOP election observers in Detroit were being excluded when city officials fixed, or “cured,” ballots that their machines couldn’t read. In these cases — which might be caused by a stray mark or a coffee stain — officials can make a duplicate ballot, with the same votes, and run that one instead.

Republicans said they had “information and belief” that this curing process had been done repeatedly without a GOP official there to observe it. They asked a judge to delay certifying Detroit’s results. The judge said no. He said the GOP’s evidence of misconduct was “mere speculation.”

“The City of Detroit should not be harmed when there is no evidence to support accusations of voter fraud,” Judge Timothy P. Kenny wrote.

In another suit, Trump’s presidential campaign asked a judge to stop all processing of absentee ballots in Michigan.

In that case, a Republican election observer said she’d been given a sticky note by an unnamed poll worker, alleging that late-arriving ballots were being counted improperly. But she couldn’t provide the poll worker’s name or any other proof.

A judge rejected that, saying that the GOP’s evidence was inadmissible as hearsay. The judge also said that — because Trump’s campaign had waited until late afternoon on Wednesday to file — its suit was moot.

“By the time this action was filed, the votes had largely been counted, and the counting is now complete,” Judge Cynthia Diane Stephens wrote Friday.

Meanwhile, Republican National Committee Chairwoman Ronna McDaniel raised another series of claims during a news conference Friday in Bloomfield Hills, Mich., alleging that election workers in Detroit were told to backdate certain ballots. Detroit officials denied the accusation.

McDaniel acknowledged that her allegations had not been fully vetted and said the information had been shared with federal prosecutors. A Justice Department official said the information McDaniel provided has been referred to the FBI. It was unclear what, if any, action the agency planned to take. An FBI spokeswoman in Detroit referred a reporter to the U.S. attorney’s office, which declined to comment.

McDaniel also asserted that 2,000 Republican ballots in Rochester Hills, Mich., had been “given to Democrats . . . due to a clerical error.”

Tina Barton, the GOP city clerk of Rochester Hills, said in a video posted on Twitter that McDaniel was referring to an “isolated mistake that was quickly rectified” and called her allegation “categorically false.”

“As a Republican, I am disturbed that this is intentionally being mischaracterized to undermine the election process,” she said in the video.

Georgia

In Georgia, Trump’s campaign filed a lawsuit the day after the election, focused narrowly on absentee ballots in Chatham County, home to Savannah. The campaign asked that any absentee ballots arriving after polls closed on Tuesday be set aside.

For most voters, Georgia requires ballots to arrive before the end of Election Day, though there’s an exception for military voters and overseas voters.

The Trump campaign cited an affidavit from a poll worker who said he thought he might have seen late-arriving ballots improperly mingled with ones cast on time. Even if that was true, it was not an election-changing problem: The allegation dealt with a small number of ballots in a single county.

Georgia Democrats filed two affidavits from other poll workers who said they observed no such intermingling. A Georgia judge dismissed Trump’s suit in one day, writing that there was “no evidence” the county elections board had failed to comply with the law.

Arizona

In Arizona, the Trump campaign and the Republican National Committee filed suit in state court Saturday alleging that some voters were told by poll workers to push a button on a tabulating machine to cast their ballot, even after machine tabulators had detected an “overvote” — that is, the machine detected the possibility that the person had voted for two candidates.

Under state rules, they said, voters are supposed to be allowed to cancel such ballots and try again because sometimes stray ink marks or smudges can cause the tabulator to improperly assess an “overvote.” The campaign asked a judge to order a manual review of such ballots and to bar the certification of the Arizona vote until it is complete.

Trump supporters spent much of the week alleging that the tabulators were thrown off by the use of Sharpie pens and therefore disqualified large numbers of votes. State officials have insisted Sharpie pens are in fact the best writing instrument to use with the machines because of their fast-dry ink, and they do not cause problems.

Voters who filed an earlier suit alleging Sharpie-caused ballot issues have dropped that one and are intervening in the new case filed by the Trump campaign, according to lawyer Alexander Kolodin. Arizona Secretary of State Katie Hobbs (D) said the new suit was a “repackaging” of that matter and merely an attempt to delay the count.

Nevada

In Nevada, two days after the election, a group of Trump allies claimed that thousands of people had voted illegally in Clark County, home to Las Vegas.

“That is unacceptable, and it’s giving legal people a sense that the system is corrupt,” said Richard Grenell, Trump’s former acting director of national intelligence.

Neither the Trump campaign nor the GOP were named plaintiffs in the federal lawsuit that was eventually filed by Republicans, which presented no evidence that thousands of people had voted improperly.

By then, the allegation had been whittled down drastically. Instead of 10,000 cases, Trump’s allies presented one: a woman named Jill Stokke, who said she was denied the right to vote in person because her mail ballot had been stolen and filled out by someone else.

But, in fact, Stokke’s story was more complicated. Election officials said they had indeed received a mail ballot from her — but the signature matched her own. They had offered her a chance to cancel that mail ballot and vote again if she would sign an affidavit saying the mail ballot had been stolen. She did not.

The Trump allies wanted U.S. District Judge Andrew Gordon to order a ban on the use of a machine for verifying signatures, a move that would have slowed down an already slow count. He did not. Instead, Gordon told the plaintiffs to return to court if they found more evidence to back their claims.

Beyond that lawsuit, GOP officials also alleged that more than 3,000 people voted in Nevada despite not living in the state.

Lawyers for the Trump campaign sent a letter Thursday to U.S. Attorney General William P. Barr alleging “criminal voter fraud in the State of Nevada” and claiming to have identified 3,062 people who voted improperly. They enclosed a list of addresses of voters who they said had moved out of state, information they said came from cross-checking voter data with the National Change of Address database.

At a news conference Sunday before a crowd of cheering supporters in Las Vegas, Trump campaign officials went further, claiming that as many as 9,000 nonresidents wrongly voted and that the Clark County elections system was riddled with other fraud, without offering credible evidence.

Groans and gasps could be heard from the crowd as campaign officials accused Democratic officials in Clark County of disenfranchising Republican voters. “Stop the steal,” the crowd chanted.

Local election officials have stressed that Nevada law allows some people to vote while living out of state: students, military personnel and military spouses.

“You don’t have to live here in order to be eligible to vote here,” Joe Gloria, the Clark County registrar of voters, told reporters last week.

The addresses of Amy Rose and her husband, an Air Force service member, are on the Trump campaign’s list of out-of-state voters. Rose and her husband currently live in Davis, Calif., where she works for a veterans support organization and her husband is pursuing a doctorate, doing Air Force-funded research in aerospace engineering.

“It’s really appalling to be used as pawns” to undermine confidence in the election results, Rose said. “We both take our duties as citizens seriously. It was quite shocking to see our integrity challenged without any basis in fact.”

In a statement, the Nevada GOP said it has “no intention of invalidating any legal voter.”

A Justice Department official said the department was “looking into” the allegations but declined to provide more detail.

WASHINGTON — In a pair of decisions welcomed by Democrats, the Supreme Court on Wednesday let election officials in two key battleground states, Pennsylvania and North Carolina, accept absentee ballots for several days after Election Day.

In the Pennsylvania case, the court refused a plea from Republicans in the state that it decide before Election Day whether election officials can continue receiving absentee ballots for three days after Nov. 3.

In the North Carolina case, the court let stand lower court rulings that allowed the state’s board of elections to extend the deadline to nine days after Election Day, up from the three days called for by the state legislature.

The court’s brief orders in the two cases were unsigned. The Pennsylvania order appeared to be unanimous, while the North Carolina one was issued over three noted dissents.

Justice Amy Coney Barrett, who joined the court on Tuesday, did not take part in either case. A court spokeswoman said Justice Barrett had not participated “because of the need for a prompt resolution” and “because she has not had time to fully review the parties’ filings.”

The Pennsylvania and North Carolina cases were the latest examples of the complications that Covid-19 has presented to officials preparing for next week’s election and facing a record-setting number of absentee and mail-in ballots cast by voters eager to avoid voting in person during a pandemic.

Democrats have consistently pushed for more lenient rules when it comes to mail-in ballots and how and when they are counted. Republicans have resisted such changes, with many of them arguing that the relaxed rules could open the process to abuse and fraud.

There were no noted dissents in the Pennsylvania case, though three justices said the court might return to it after Election Day. In the North Carolina case, the same three members of the court — Justices Clarence Thomas, Samuel A. Alito Jr. and Neil M. Gorsuch — said they would have granted requests from Republican lawmakers and the Trump campaign to block lower court rulings allowing the longer deadline.

The two cases involved broadly similar issues. In Pennsylvania, the question was whether the state’s Supreme Court could override voting rules set by the state legislature. In North Carolina, the question was whether state election officials had the power to alter such voting rules.

The Pennsylvania case left open the possibility of later action by the court.

“I reluctantly conclude that there is simply not enough time at this late date to decide the question before the election,” Justice Alito wrote.

“Although the court denies the motion to expedite” the petition seeking review, he wrote, the petition “remains before us, and if it is granted, the case can then be decided under a shortened schedule.”

The court’s refusal to move more quickly came a little more than a week after it deadlocked, 4 to 4, on an emergency application in the case. The Pennsylvania Republican Party had asked the justices to temporarily block a ruling from the Pennsylvania Supreme Court that allowed election officials to count some mailed ballots received up to three days after Election Day.

The state court said the extra time was needed because of the coronavirus pandemic and delays in mail service.

State Republicans, apparently hoping that the arrival of Justice Barrett would alter the judicial calculus, returned to the Supreme Court on Friday asking it to hear an ordinary appeal from the state court’s ruling, which is not unusual, but to compress a process that usually takes months into a few days, which certainly is.

In his statement, Justice Alito criticized his court’s treatment of the case, which he said had “needlessly created conditions that could lead to serious postelection problems.”

“The Supreme Court of Pennsylvania has issued a decree that squarely alters an important statutory provision enacted by the Pennsylvania legislature pursuant to its authority under the Constitution of the United States to make rules governing the conduct of elections for federal office,” he wrote.

That echoed a concurring opinion issued on Monday by Justice Brett M. Kavanaugh in a voting case from Wisconsin. Justice Kavanaugh also said that state legislatures, rather than state courts, have the last word in setting state election procedures.

Writing on Wednesday, Justice Alito said he regretted that the election would be “conducted under a cloud.”

“It would be highly desirable to issue a ruling on the constitutionality of the State Supreme Court’s decision before the election,” he wrote. “That question has national importance, and there is a strong likelihood that the State Supreme Court decision violates the federal Constitution.”

“The provisions of the federal Constitution conferring on state legislatures, not state courts, the authority to make rules governing federal elections would be meaningless,” he wrote, “if a state court could override the rules adopted by the legislature simply by claiming that a state constitutional provision gave the courts the authority to make whatever rules it thought appropriate for the conduct of a fair election.”

Earlier on Wednesday, Pennsylvania officials told the court that they had instructed county election officials to segregate ballots arriving after 8 p.m. on Election Day through 5 p.m. three days later. That could potentially allow a later ruling from the court to determine whether they were ultimately counted.

In its motion seeking expedited consideration of the case, lawyers for the Republican Party wrote that the court’s ordinary briefing schedules “would not allow the case to be considered and decided before the results of the general election must be finalized.”

The motion noted that four justices had already indicated where they stood when the court deadlocked on Oct. 19. Justices Thomas, Alito, Gorsuch and Kavanaugh said they would have granted a stay blocking the Pennsylvania Supreme Court’s decision. On the other side were Chief Justice John G. Roberts Jr. and the court’s three-member liberal wing: Justices Stephen G. Breyer, Sonia Sotomayor and Elena Kagan.

Neither side gave reasons, and the split suggested that Justice Barrett could play a decisive role if the court eventually heard the case.

Responding to the motion seeking expedited treatment of the Republicans’ appeal, the Pennsylvania Democratic Party called the request “rash and unseemly.”

“Even on the extraordinarily hurried schedule” proposed by the Republicans, the response said, “a ruling from this court could not realistically issue until the eve of the election.”

“By then,” it added, “it will be too late for many Pennsylvania voters who have relied on the existing rules to adjust to any change in the rules that this court might impose.”

The state court ordered a three-day extension for ballots clearly mailed on or before Election Day and for those with missing or illegible postmarks “unless a preponderance of the evidence demonstrates that it was mailed after Election Day.”

The U.S. Supreme Court has not hesitated to block orders from federal judges that sought to alter state rules for conducting elections. Rulings from state courts present more difficult questions because the Supreme Court generally defers to them in cases concerning interpretations of state law, and the Constitution empowers state legislatures to set the times, places and manner of congressional elections.

In an earlier brief, Republicans argued that “the Constitution reserves a special role for state legislatures in federal elections,” one that cannot be overridden by state courts. The brief relied heavily on the Supreme Court’s decision in the cases culminating in Bush v. Gore, the 2000 ruling that handed the presidency to George W. Bush.

“By extending the deadline by judicial fiat and establishing a presumption of timeliness that will allow voters to cast or mail ballots after Election Day,” the brief said, “the Pennsylvania Supreme Court has impermissibly altered both the ‘time’ and ‘manner’ established by the General Assembly” for conducting elections.

In response, Josh Shapiro, Pennsylvania’s attorney general, a Democrat, said a provision of the State Constitution protecting “free and equal elections” allowed the Pennsylvania Supreme Court to extend the deadline.

The North Carolina case concerned a state law that allowed absentee ballots to be received up to three days after Election Day. But the state’s board of elections, drawing on its power to address natural disasters, had agreed to nine days as part of a settlement of a lawsuit in state court.

All five members of the board agreed to the settlement, including two Republicans who later resigned, saying they had been “gulled into providing their assent.”

Republican lawmakers, the Republican National Committee and the Trump campaign challenged the settlement in federal court, saying the board had exceeded its power. By a 12-to-3 vote, the United States Court of Appeals for the Fourth Circuit ruled against them. All three of President Trump’s appointees to the court voted with the majority.

“All ballots must still be mailed on or before Election Day,” Judge James A. Wynn Jr. wrote. “The change is simply an extension from three to nine days after Election Day for a timely ballot to be received and counted. That is all.”

In dissent, Judges J. Harvie Wilkinson and G. Steven Agee, joined by Judge Paul V. Niemeyer, said the majority’s ruling had endorsed a pernicious trend.

“It takes no special genius to know what this insidious formula is producing,” they wrote. “Our country is now plagued by a proliferation of pre-election litigation that creates confusion and turmoil and that threatens to undermine public confidence in the federal courts, state agencies and the elections themselves.”

In the Supreme Court, the Trump campaign urged the justices to intercede.

“This case involves an extraordinary attempt by an unelected state board of elections to rewrite the unambiguous terms of a statute enacted in June by a bipartisan state legislature to set time, place, and manner requirements for absentee voting in response to the Covid-19 pandemic,” the brief said.

The board responded that it had the statutory authority to act. A state law gave it emergency powers to be used when elections are disrupted by natural disasters.

“In the past three years alone, the board has twice extended the absentee-ballot receipt deadline after hurricanes hit the state’s coast,” its brief said. “No one challenged those extensions.”

Justice Thomas said he would have granted the stay sought by the Republicans, but he gave no reasons.

Justice Gorsuch, joined by Justice Alito, criticized “the board’s constitutional overreach.”

Its actions, Justice Gorsuch wrote, “do damage to faith in the written Constitution as law, to the power of the people to oversee their own government, and to the authority of legislatures.”

“Such last-minute changes by largely unaccountable bodies, too,” he wrote, “invite confusion, risk altering election outcomes, and in the process threaten voter confidence in the results.”

Similarly, in North Carolina, Kavanaugh joined Roberts + the three liberals on the same issue re: ballots arriving after election day. COVID Barrett is definitely going to be as much of a right wing hack as Thomas and Alito, and while I had hopes for Gorsuch his interpretation of the constitution on election law issues is ridiculous, so Kavanaugh is likely the deciding vote on these issues.

Once Thom Tillis pivoted his campaign strategy to cast himself as a "Check on a Biden presidency" I was worried this would happen. The polls were wrong at a high level but they showed Greenfield and Cunningham tanking in the final 2-3 weeks before the election, so the warning signs were there.

The biggest gaffe of this election for Democrats in the senate was hate-spending on races they had no shot in. The $200 million spent in KY & SC could have been deployed in more winnable states and/or house races / state legislature races. The Kansas race wasn't a huge money pit but once Kobach lost the primary it should have been obvious how unwinnable that race was. They should have been more honest with themselves about races that were actually winnable.

Ultimately though this goes back to the Democrats having a messaging issue. The fact so many people believed the Republicans needed to have a senate majority in order to "keep Biden in check" cost Democrats a lot of votes.
