Kansas initially shut down churches but the Court overturned the executive order citing it as discriminatory.
Pretty much the same reason bar owners are suing Texas over the order to shut bars down.

In other words, they can be shut down due to emergency situations like this but the government has to make sure all businesses/organizations of similar nature are also shut down.

But the constitutional religious aspect differentiates them from bars. That's why they are afraid to do it.

as long as you aren't specifically discriminating against religion, i dont think it would be an issue. so if you are banning all indoor public gatherings with more than x people, then you cant really argue that the law is discriminating against religion. there's a landmark case from oregon that goes into that. peyote was an illegal drug but people of some specific religion said peyote use was a ritual, and so the law was anti-religion. SCOTUS said that isnt the case

now perhaps if you could prove that the specific way that they banned public gatherings was meant to target religion... ie we are banning all public gatherings held in buildings with ceilings this high and with painted glass windows (or something less ridiculous than that), then you'd have a better case

texas didnt hesitate on constitutional grounds, but on pandering rounds. imo.

Speaking for myself we are an essential business that works all over the city and south texas trying to navigate through this shit. We dont need dummies denying science getting us infected without even knowing where it came from.

For all intents and purposes, bars are shut down. They can still sell to go for people who don't care about paying bar prices for booze.

It's fairly arbitrary. If less than 51% of your sales (preCOVID) was booze, you can stay open. If not, no dice. Regardless of whether you've changed your business model during COVID.

Lots of good places to eat are shut down because they did good bar sales from midnight to 2am. Mostly local, independently owned. Meanwhile, Applebee's is open.

I was referring to the idea that we shut x down until it's "over". Shut down just means it's longer to get to the optimistic scenario of only 500k deaths to go. Destination remains the same.

It's not the Abbot test according their website, it's a 15 minute rapid test.

"The COVID-19 rapid test is manufactured by Quidel, the first manufacturer to receive Emergency Use Authorization (EUA) from the U.S. Food and Drug Administration (FDA) on May 8 for a rapid antigen test. Named Sofia® 2 SARS Antigen FIA, the rapid point-of-care test uses a fluorescent immunoassay analyzer for the rapid detection of SARS-CoV-2 in a nasal or nasopharyngeal specimen."
The Quidel test still has a high rate of false negatives and a negative, which constitutes the majority of results, still requires confirmation by a PCR test. Again Texas Medi Clinic had available a better test and swithed to in house testing for financial reasons rather than for the benefit if patients

That said, to my defense, I only mentioned pandemics. And we had plenty of those with all sorts of viruses/bacteria:

Cholera, Influenza, Typhus, Smallpox, Measles, Tuberculosis, Leprosy, Malaria, Yellow fever, AIDS, etc.

So, if this one isn't "over" at some point, it would certainly be a first.

ECMO (Extracorporeal membrane oxygenation), is a therapy that adds oxygen to one's blood and pumps it through their body.

"They're so sick that if they don't get put on, if they don't get the support, they are going to die," DellaVolpe explained.

The problem is, DellaVolpe explained that he only had three beds available in the unit of the hospital that provides ECMO......"

I think that's the first time I've seen a doctor say ventilators are really bad to use on covid patientsI think it's been a last resort for some time now. That's why demand for ventilators wasn't sustained.

Texas Landlords Are Filing Hundreds of Illegal Evictions

As courts reopen in Harris County, tenants may be removed from their homes as COVID-19 cases skyrocket, despite CARES Act protections that guarantee shelter.

In late April, the landlord at 2929 Dunvale Apartments—a garden-style apartment complex in Midwest Houston with one-bedroom apartments starting at $700 a month—filed to evict six tenants.

A month later, seven tenants at Concord at Little York, a three-story complex tucked behind I-45 (https://www.texasobserver.org/more-highways-more-problems/) in North Houston, were hit with eviction filings.

Between May 26 and June 17, the property manager at Inwood Grove, a tree-studded property in northwest Houston, filed to evict 17 households.

All of these cases appear to be in violation of the Coronavirus Aid, Relief, and Economic Security

(CARES) Act, which prohibits landlords from filing for eviction at properties that benefit from federal subsidies until July 25.

of the 3,652 evictions filed in Harris County between March 27 and June 22, at least 368 of those—about 10 percent—appear to be filed in violation of the CARES Act.

the eviction moratorium covered 12.3 million of the 43.8 million rental units in the United States—

in May, the Texas Supreme Court acknowledged (https://www.statesman.com/news/20200515/texas-supreme-court-ends--coronavirus-protections-against-evictions-debt-collections) that a third of Texas renters could be covered.

“All you need is one voucher tenant in a complex to make everyone [who lives there] eligible for CARES Act protection.”

Large corporate landlords have also moved to evict tenants in clear violation of CARES Act protections,

“These are not small mom-and-pop landlords, these are gigantic—in some cases multi-billion-dollar—companies that have decided for some reason that the federal law doesn’t apply to them,”

“The law is clear that it prohibits not just actual eviction,

removing someone from their home,

but also the threat of eviction,”

Even if a case is dismissed, eviction filings often remain on a tenant’s record, making it

significantly harder to find housing in the future.

“That is one of the big injuries that this can cause for people—if you’ve been sued for eviction,

even if the case was dismissed, that can often have really dramatic effects on your ability to rent somewhere else,”

“A lot of housing providers would just automatically deny anybody who’s been sued for eviction, no matter what the circumstances are,”

judges aren’t empowered to investigate whether or not a property is covered by the CARES Act.

“If someone completes an affidavit and no one challenges it, we sort of have to take it,”

Probably a mix of both. We have seen this thing go after all sorts of things outside the respiratory system.

... and in the end, the root cause is still the virus. Absent the disease, those people would be alive. We are on track to see what happens when you overwhelm the healthcare system, the worst case scenario, I wrote about months ago when teh AHA released their estimates.

They will be packing groceries and doing things that will take them into contact with older folks.

My daughter is 15 and says the hallways in middle and high school are so congested you have to squeeze by people just to get down a hallway. How are they supposed to social distance in the hallway even with half the student body on campus?

I would like for my daughter to be in school, especially for her AP classes, especially Japanese as she can't get experience speaking with someone else very good over Zoom, but it just seems like it will not happen.

Thats not how herd immunity works. Herd immunity means the stronger protect the weaker by building immunity (usually through vaccine. The actual term herd immunity was created when discussing vacvines)

We dont have a vaccine therefore herd immunity cannot exist.

On top of it there is no proof that a human build immunity to COVID after the 1st infection.

That’s bizarre. Texas Med Center is reporting Htown’s positivity rate to be nearly a third of that at 11%. I thought Houston was the hardest hit in Texas?

Why do you think the herd immunity strategy is wise? Why not, I don't know, reduce the odds of getting and spreading the virus through different measures until more proven treatments and a vaccine arrive? I expect the former to be here by the Fall, maybe earlier.

We also have ZERO clue how this virus affects people long term. It's more than just a respiratory virus. It also causes clotting and neurological damage.

Why would you expect a vaccine in the fall? That is only the absolute best case scenario -- eg the Oxford vaccine which had already gotten safety testing and just needs effectiveness testing, which is going on right now. Everyone else has to do both safety and effectiveness and those both take a lot of time. And this could very be like all the other coronaviruses we have never been able to get a vaccine for. Hell we still don't have a vaccine for HIV nearly forty years after identifying it as the cause of AIDS and that shit has killed between 25-42 million. I wouldn't be so confident in a vaccine and definitely not this summer.

I’ve been reading up on the vaccines since I’ve abandoned all hope that the public and the government can do shit to stop the spread. There’s the AstraZeneca vaccine you mentioned and also Moderna’s RNA treatment that will start phase 3 trials this month. I think Pfizer and some other European and Chinese vaccines will start phase 3 soon thereafter.

I’m pretty incredulous that a vaccine with some level of effectiveness (e.g., over 50%) could be ready by October. But a lot of articles reference cautious optimism by the medical community so I dunno.
