washingtonexaminer.com reports: House Democrats tried but failed Friday to block spending on President Trump's proposed border wall under the annual defense bill.

Rep. Michelle Lujan Grisham, D-N.M., pressed for a House floor vote that would have added a prohibition on any Pentagon spending to build the wall. She did so at the end of debate on the National Defense Authorization Act, and her move was a protest against the House GOP decision to strip language out of that bill that would have prevented the NDAA from authorizing work on the border wall.

"The only way this body can guarantee that Trump cannot use Department of Defense funds to construct the border wall is to put that prohibition in the bill explicitly," Grisham said on the floor.

But Republicans thwarted the move, and Rep. Mac Thornberry, R-Texas, received a standing ovation for his opposition speech that said the House needs to quickly approve the fiscal 2018 defense authorization bill. The NDAA was passed by the chamber moments later, in a vote that saw most Democrats support it.

Twitter Inc.’s executive chairman said the social-media platform shouldn’t ban President Donald Trump, pushing back against complaints from users who say some of his tweets amount to cyberbullying and violate the company’s terms of service.

“It’s good to have him talk on Twitter,” Omid Kordestani said in an interview at Sun Valley, the Idaho resort town that hosts an annual confab of technology and media moguls and political luminaries. This year the crowd includes Ivanka Trump and Jared Kushner, who arrived Wednesday and are scheduled to leave Friday.

Trump, who frequently uses Twitter to broadcast his thoughts in 140 characters, has drawn criticism for many of his tweets, including a recent video depicting him beating up a wrestling opponent with the CNN logo superimposed on his victim’s head. A series of tweets disparaging the personal appearance and intellect of TV host Mika Brzezinski also fueled complaints. Twitter’s rules allow the company to suspend accounts for violent threats, gender-based attacks and other forms of abuse and harassment.

Representative Keith Ellison, a Minnesota Democrat, and Seth Abramson, a University of New Hampshire professor and frequent Trump critic, are among those who have called for the president to be taken off Twitter.

Trump also uses Twitter for other purposes, including recaps of his discussions with other world leaders, his takes on current events and praise or disdain for companies. The president has 33.7 million followers, up from around 24 million at the time of his inauguration.

Twitter, under pressure after posting its first quarterly revenue decline since going public in 2013, has found that accounts like Trump’s are a potential source of growth. Average monthly users increased 6 percent to 328 million in the first quarter from a year earlier, in part because of “new and resurrected users following more news and political accounts,” especially in the U.S., the company said in April.

Anthony Noto, the company’s chief operating officer, has said that since people go to Twitter to see what’s happening, it’s easier for the social media company to deliver on its mission if influential people like Trump start discussions there.

Attorney General Jeff Sessions has asked the U.S. Supreme Court for clarification on its ruling, after U.S. District Judge Derrick Watson modified his original order in an attempt to subvert the ban.

Attorney General Jeff Sessions went directly to the Supreme Court on Friday, asking for clarification of its June 26 travel ban decision and an immediate stay of U.S. District Judge Derrick Watson’s July 13 ruling that modified his original injunction that stopped Executive Order 13780, which placed a temporary ban on all refugees and a temporary travel ban on residents of six Middle Eastern countries.

That original injunction was largely overturned in the Court’s June 26 decision. Watson’s July 13 ruling significantly scaled back President Trump’s Supreme Court victory.

Late Friday, Acting Solicitor General Ken Wall filed a motion at the Supreme Court asking for the justices to clarify who qualifies as a close family member. If the Court is unwilling to go there, Wall alternatively asked the Court at minimum to stay Watson’s ruling while the U.S. Department of Justice (DOJ) appeals his latest decision.

“The district court’s interpretation of this Court’s June 26, 2017, stay ruling distorts this Court’s decision and upends the equitable balance this Court struck,” the DOJ said in its motion, citing two particular errors in Watson’s decision.

First, “The district court’s categorical holding that the Order may not be applied to any refugee applicant as to whom the Department of State has obtained a contractual commitment from a resettlement agency — which includes every refugee permitted to enter the United States — effectively eviscerates this Court’s ruling partially staying the injunction as to Sections 6(a) and 6(b),” the DOJ argued.

Second, “the district court’s sweeping interpretation of ‘close familial relationship’ to encompass a wide range of distant relatives — including cousins, uncles, and siblings-in-law — effectively eliminates the ‘close’ requirement and has no basis in this Court’s ruling or the INA,” the DOJ continued.

Sessions also played it safe by appealing Watson’s July 13 ruling modifying his injunction.

“Out of an abundance of caution, to ensure that there is no impediment to this Court’s prompt resolution of this issue, the government has also filed today a notice of appeal of the district court’s decision modifying its injunction,” the motion stated.

By going directly to the Supreme Court for clarification, Sessions outmaneuvered both Watson, the federal judge in Hawaii, and the Ninth Circuit Court of Appeals, which had given Watson a “roadmap” for his July 13 decision when it ruled earlier this month against his previous decision that requested clarification from the Supreme Court.

Now, Attorney General Sessions is asking the Supreme Court for that clarification.

Sessions’ move surprised most legal observers, who expected him to first appeal Watson’s July 13 decision to the Ninth Circuit, which would probably have affirmed Watson, and then appealed that decision to the Supreme Court.

Instead, Sessions is asking the Supreme Court to do what the Ninth Circuit ruled Judge Watson could not ask the Supreme Court to do: Clarify its decision.

“Nearly three weeks ago, this Court issued its per curiam decision partially staying the injunctions” issued by Judge Watson stopping the implementation of Executive Order 13780, the Department of Justice’s motion began.

These are big drops among two classes of swing voters in swing counties in swing states.

NBC soft-pedals its conclusion, saying, “Bottom line: Even in places that he won in 2016, he’s taken a hit when it comes to his approval ratings.”

If these polls are anywhere near correct, it shows

Trump is still ahead in reliably red counties—reliably red in that a majority voted for a Republican presidential candidate in 2012.

However, a majority of voters in crossover counties, who previously supported Obama, have abandoned Trump. (Only 44 percent approve.)

The counties polled were in 16 states: Colorado, Florida, Georgia, Indiana, Iowa, Maine, Michigan, Minnesota, Missouri, Nevada, New Hampshire, North Carolina, Ohio, Pennsylvania, Virginia and Wisconsin.

USPS broke law in allowing workers to boost Clinton campaign, watchdog says


The United States Postal Service violated federal law by letting employees do union-funded work for Hillary Clinton's campaign and other Democratic candidates while on leave from the agency, according to an Office of Special Counsel report obtained by Fox News.

The OSC determined the USPS "engaged in systemic violations" of the Hatch Act, a federal law that limits certain political activities of federal employees. While employees are allowed to do some political work on leave, the report said the Postal Service showed a "bias" favoring the union's 2016 campaign operation.

The investigation was launched months ago after Senate Committee on Homeland Security and Governmental Affairs Chairman Ron Johnson, R-Wis., brought constituent complaints to the OSC in October. The constituent, identified as a USPS employee, was concerned the Postal Service “incurred unnecessary overtime costs” and “improperly coordinated” with the National Association of Letter Carriers (NALC) when it released members for several weeks of “union official” leave without pay to participate in campaign work.

“The Labor 2016 program sought to ‘elect Hillary Clinton and pro-worker candidates across the country,’” the report said, citing campaign work like door-to-door canvassing, phone banks and other get-out-the-vote efforts.

HILLARY CLINTON SIDED WITH RUSSIA AS BILL MADE $$ IN MOSCOW

According to the report, roughly 97 NALC members requested the leave without pay to participate. The NALC, which endorsed Clinton last June, compensated those USPS workers using the Letter Carrier Political Fund, the union’s PAC.

Officials at multiple levels apparently were involved.

According to OSC Acting Special Counsel Adam Miles, the NALC provided lists of letter carriers to participate in campaign activity to a senior headquarters USPS labor relations official, who then emailed the lists to other USPS officials across the country. According to Miles, the local officials “interpreted the communications as directives” from USPS headquarters to release the carriers on union official leave without pay.

According to the report, local supervisors raised concerns about the impact this would have on postal operations and initially objected to releasing them, but USPS managers instructed local supervisors to let the workers participate.

“We concluded that the USPS practice of facilitating and directing carrier releases for the union’s political activity resulted in an institutional bias in favor of NALC’s endorsed political candidates, which the Hatch Act prohibits,” Miles said in prepared testimony before the Senate Homeland Security Committee, which is set to hold a hearing Wednesday on the matter.

But USPS Postmaster General Megan Brennan said that “senior postal leadership did not in any way guide union leadership in selecting the candidates for whom NALC employees could campaign” and that USPS “did not approve or choose candidates for the unions to support” or “ask the union to advocate for political candidates on behalf of the Postal Service.”

“I also note that our postal unions do not speak for the Postal Service, and the Postal Service does not speak for our unions,” Brennan wrote in her prepared testimony, insisting USPS did not seek to assist the NALC’s “favored candidates.” “This especially applies in a political context, but it is inherent in any collective bargaining relationship.”

Brennan said that the practice to grant leave without pay for NALC political activity has been in place for approximately 20 years, but that all violations of the Hatch Act were “unintentional.”

“We will change our practice in consultation with the OSC and based upon OSC’s guidance. This will ensure that we do not put our people in harm's way and they do not unintentionally run afoul of the Hatch Act,” Brennan said. “As we have previously communicated to both this committee and to the OSC, and as the OSC has acknowledged, the Postal Service has always been ready, willing and able to end or modify our practice as appropriate, consistent with OSC’s recommendation.”

HATCH ACT EXPLAINED: WHAT IS THE FEDERAL LAW?

The Hatch Act is a federal law that limits certain political activities of federal employees. The law’s purpose is to ensure federal programs are “administered in a nonpartisan fashion, to protect federal employees from political coercion in the workplace, and to ensure that federal employees are advanced based on merit and not based on political affiliation,” according to the OSC. The office is an independent federal agency that monitors compliance with that law and others.

Miles, in his prepared remarks, said the OSC investigation revealed the NALC-USPS practice is “long-standing, going back many election cycles, and perhaps started in the 1990s.”

“As a federal entity, the USPS must remain politically neutral,” Miles' testimony said. “In many localities, the Postal Service is a citizen’s primary point of contact with the federal government, reinforcing the need for strict adherence to the letter and the spirit of the Hatch Act.”

OSC recommended in the report that, going forward, USPS management should not require, direct or suggest local supervisors release union members to engage in political activity.

Miles added: “OSC has communicated these recommendations to USPS, and agency representatives appear ready to take the steps necessary to comply with the Hatch Act.”

Breitbart’s Boyle: Our Goal Is the ‘Elimination of the Entire Mainstream Media’
Matthew Boyle, Breitbart News’ Washington Political Editor, gave a speech entitled “Combating Fake News: Replacing Establishment Media” at the Heritage Foundation in Washington on Wednesday.


“The goal eventually is the full destruction and elimination of the entire mainstream media. We envision a day when CNN is no longer in business. We envision a day when the New York Times closes its doors. I think that day is possible,” he said in his speech to the Phyllis Schlafly Collegians Leadership Summit.

Boyle elaborated on Breitbart News’ record in uncovering falsehoods reported in the mainstream media. Breitbart’s fact-checking exposed a false CNN story in June claiming that President Trump’s associate Anthony Scaramucci—the founder of SkyBridge Capital and now an Export Import Bank official—was under investigation by the Treasury Department and Senate Intelligence Committee for alleged meetings with a Russian banking official. The supposed meetings never happened, and the Senate Intelligence Committee was not investigating Scaramucci. Furthermore, the Treasury Department—at the urging of Sen. Liz Warren (D-MA) and other Democrats at the beginning of the administration—had looked into the matter already and determined it to be entirely “without merit.”

After Breitbart verified through research that the CNN hit piece was entirely fraudulent, CNN retracted the piece, apologized to Scaramucci and three of its senior editorial staffers, including a Pulitzer Prize-winning editor and the head of CNN’s investigative unit, resigned over the scandal. CNN continues to not be transparent about the matter.

Beyond uncovering such lies from the media, Boyle underlined Breitbart’s commitment to covering stories overlooked by establishment media organizations. “A lot of the stories we do and a lot of the stories that we focus on are very, very strategically focused things,” Boyle said. “So, we like to go after stories that they ignore.”

According to Boyle, Breitbart News’ reporting on the Republican congressional primary between establishment-favorite, now former House Majority Leader Eric Cantor and now Rep. Dave Brat in 2014 found that: “If you were reading Breitbart, you weren’t surprised when you saw that David Brat won the election. The rest of the media was just shocked.”

A similar pattern of reporting overlooked aspects in the 2016 election, such as raw polling data, ensuring that no one at Breitbart News was surprised when Donald Trump won the presidency.

Boyle further argued that the failure of the mainstream media extended beyond a mere liberal bias. In his words:

The media is an industry in crisis that refuses to admit that it’s an industry in crisis. It’s almost like an alcoholic refusing to admit that they have a problem. They continue to go out there and make the same mistakes over and over again. It’s actually pretty easy, I could sit here all day and make a full time living on fact checking CNN. It gets boring after a while, but they make mistakes over and over again. Many of them, the same mistakes, and they refuse to correct them. Journalistic integrity is dead. There is no such thing anymore. So, everything is about weaponization of information. Both sides are fighting on the battlefield of ideas and you know CNN, the New York Times, the Washington Post, Politico, Associated Press, MSNBC, NBC, CBS, the whole alphabet soup they’ve all thrown in together with the institutional left.

He underlined that the chief distinction between Breitbart and its left-of-center competition was that Breitbart admitted to being conservative-oriented.

Our viewpoint at Breitbart has always been that we’d rather be open about our personal biases. We’re openly conservative. We don’t hide it. We’re very honest with our audience. We told people we all wanted Trump to win last year. If you’re open with your audience about that, I think you’re honest with your audience.

Boyle contrasted such transparency with outlets of the establishment media that see themselves as neutral and objective.

They claim to be objective. They claim that they don’t have a side. And many of them actually believe their own lies. So, a lot of these people are decent human beings who are working in a broken institution. Again, I know many of them.

Despite outlets like Breitbart fighting against “this behemoth of an industry that is all these different media organizations,” Boyle was quite confident in Breitbart’s ability to undermine the narrative of establishment media. The victory of Donald Trump, whose candidacy received a record-low number of media endorsements, proved such success according to Boyle.

We’re getting past these guys. There is a good contingent of the country, in fact, a majority, enough to win a presidential election, majorities in the house and senate in elections, that don’t believe the mainstream media. We’re winning this war and we’re outnumbered. So the more people that get involved, the more people that stand up and fight, the closer we are going to get to a total victory.

Anti-fascist leader Yvonne C. Felarca was arrested on charges of inciting and participating in a riot and assault likely to cause great bodily injury.

California authorities announced Wednesday that they arrested a prominent San Francisco Bay Area anti-fascist leader on charges stemming from a state Capitol brawl last year between white nationalist groups and counter-protesters.

Yvonne C. Felarca, 47, was arrested Tuesday in Los Angeles on charges of inciting and participating in a riot and assault likely to cause great bodily injury, the Sacramento County District Attorney’s Office said.

Yvette Felarca is the name used by the leader and spokeswoman for the group By Any Means Necessary, but public records show her given name is Yvonne Capistrano Felarca.

By Any Means Necessary has not returned repeated telephone messages from The Associated Press over two days.

A second counter-protester, Michael Williams, 56, was arrested Wednesday in Yolo County on charges of assault with a deadly weapon and participating in a riot.

They are the last of four arrests stemming from a June 2016 melee that erupted when more than 300 counter-protesters confronted about 30 members of the Traditionalist Worker Party. Prosecutors on Tuesday announced the arrests of a party supporter and another counter-protester.

Felarca attended the Capitol protest and gave television interviews after the melee. Following those interviews, Berkeley police last year investigated threats against Berkeley’s Martin Luther King Jr. Middle School where Felarca was a teacher. School officials could not be reached Wednesday.

She also has been prominent at several clashes in Berkeley involving the Occupy movement and more recently between supporters and opponents of President Donald Trump and conservative leaders.

Prosecutors said there are no more outstanding warrants from last year’s clash, although the California Highway Patrol had sought charges against 101 participants after an eight-month investigation. The district attorney’s office said many counter-protesters were masked, making it difficult to bring charges including against those involved in several stabbings and an assault on a Sacramento television station’s news crew.

Fourteen people had stab wounds, cuts and bruises, with two of the injured surviving critical stab wounds.
