They are pushing a theory that makes a mockery of America’s constitutional design.

Four justices —

Samuel Alito, Neil Gorsuch, Brett Kavanaugh, and Clarence Thomas —

have resuscitated a half-baked theory three justices espoused in Bush v. Gore

to let Republicans trash ballots after Election Day.

Last week, in an opinion blocking an extended ballot deadline in Wisconsin,

Kavanaugh highlighted (https://www.supremecourt.gov/opinions/20pdf/20a66_new_m6io.pdf) this minority rationale from Bush v. Gore —

the first such reference to that infamous decision since 2000.

The "text of the Constitution requires federal courts to ensure that state courts do not rewrite state election laws,” Kavanaugh argued.

Rehnquist had “persuasively explained” this two decades ago in his concurrence, Kavanaugh claimed, and the court had “unanimously” affirmed it in Bush v. Palm Beach County Canvassing Board, an antecedent to Bush v. Gore.

But that’s fake history. Rehnquist spoke for just three justices.

And in its unanimous Palm Beach ruling, the court pointedly declined (https://supreme.justia.com/cases/federal/us/531/70/#tab-opinion-1960857) to resolve whether it had the authority to set aside a state court decision regarding state electoral law.

And it clashes with the checks and balances that animate our federal system.

State legislators could scrap elections entirely, if they like. Article II of the Constitution gives them unlimited power.

Supreme Court throws out First Amendment ruling against Black Lives Matter activist DeRay Mckesson

WASHINGTON – The Black Lives Matter movement got a favorable ruling Monday from the Supreme Court.

The justices tossed out a federal appeals court decision that allowed a Black Lives Matter protest organizer to be sued by a police officer injured by an unknown assailant.

The 2016 incident in Baton Rouge, La., followed the shooting death of Alton Sterling by a white police officer, which triggered weeks of protests across the U.S.

The officer, identified as John Doe, was struck in the face by a rock. He sued DeRay Mckesson, a Black Lives Matter activist, on the theory that he “knew or should have known … that violence would result.”

The officer, who suffered injuries to his brain, jaw and teeth, also sued Black Lives Matter. That was tossed out on the theory that BLM is a social movement and cannot be sued.

McKesson rose to prominence as an activist in the BLM movement during protests in Ferguson, Mo., following the August 2014 shooting death of Black teen Michael Brown by a white police officer.

The American Civil Liberties Union took up Mckesson's cause after the U.S. Court of Appeals for the 5th Circuit, based in New Orleans, reversed a district judge's ruling and ruled the lawsuit could go forward.

The Supreme Court, in an unsigned opinion, said that appeals court should not have reached its ruling, based on free speech rights, without a clear understanding of Louisiana law. They sent the case back for further review.

"The Fifth Circuit should not have ventured into so uncertain an area of tort law — one laden with value judgments and fraught with implications for First Amendment rights — without first seeking guidance on potentially controlling Louisiana law from the Louisiana Supreme Court," the justices said.

Associate Justice Clarence Thomas dissented from the ruling. New Associate Justice Amy Coney Barrett did not participate in the case.

There are still approximately 35,000 outstanding mail-in ballots in Allegheny County, Pennsylvania,

but results could start coming in today, CNN's Brian Todd reports from an elections warehouse in Pittsburgh.

"Some of those were postmarked before Election Day, some were postmarked on Election Day. They're arriving and they didn't start counting until after Election Day," Todd reports.

Inside the election warehouse in Pittsburgh, Todd described the vote counting process.

"These are the people doing the most critical work. They're called the return board," he explained.

"They're counting ballots right now. Right now, the ballots that we're told they're counting are from military members overseas ... who have registered to vote in this county. Earlier, they went through damaged ballots," Todd said.

He added that the return board members had counted about 3,000 damaged ballots of the 35,000 outstanding ballots. "We're told they have about 3,500 military and overseas ballots that they're going through," Todd also noted.

There are an additional 29,000 other ballots that need to be counted as well, which are being segregated because they had the "wrong information put on them when they were mailed out. That was corrected," Todd said.

"They were re-mailed out and then people mailed them back, but because of that issue, by court order, they've got to be counted starting at 5 p.m. ET today," Todd explained.

Todd explained that there is an observer watching the voting process from behind.

"Very transparent process," Todd said,

noting that there are cameras mounted in the room and monitors showing the voting process.
