So far, so grifty. If you guessed that Gates was negotiating to avoid jail time and finally tapped out when Mueller dropped those indictments yesterday, you’re probably right. But let’s step back and take a guess at what’s going on behind the scenes here.

On February 1, Gates’s lawyers moved to withdraw from the case, citing irreconcilable differences. They entered their motion about 10 minutes after Gates had his “Queen for a Day” with the FBI. That’s the proffer interview, where a witness lays all his cards on the table and says to the prosecutor, “What will you give me for this?”

Now in normal circumstances, a witness can’t be prosecuted for what he says during the proffer. But he can lose that immunity if he lies. WHICH HE DID. Meaning that whatever he said during that interview might be used to prosecute him.

And in normal circumstances, lawyers aren’t allowed to pull out in the middle of a case. But if, say, you know your client lied to the FBI, you have an ethical obligation to withdraw. And you have to balance that obligation with attorney-client privilege. Thus, the “noisy withdrawal,” where the attorney is allowed to breach the privilege and tell the judge in chambers that she needs to be excused from the case because her client has been less than wholly truthful.

Back in October, a grand jury indictment charged Manafort and his business associate Rick Gates with a variety of crimes, including conspiring “to defraud the United States.” On Thursday, special counsel Robert Mueller filed a new indictment against the pair, substantially expanding the charges. As one former federal prosecutor told the Washington Post, Manafort and Gates’ methods appear to have been “extensive and bold and greedy with a capital ‘G,’ but … not all that sophisticated.”

One new detail from the indictment, however, points to just how unsophisticated Manafort seems to have been. Here’s the relevant passage from the indictment. I’ve bolded the most important bits:


Manafort and Gates made numerous false and fraudulent representations to secure the loans. For example, Manafort provided the bank with doctored [profit and loss statements] for [Davis Manafort Inc.] for both 2015 and 2016, overstating its income by millions of dollars. The doctored 2015 DMI P&L submitted to Lender D was the same false statement previously submitted to Lender C, which overstated DMI’s income by more than $4 million. The doctored 2016 DMI P&L was inflated by Manafort by more than $3.5 million. Feb. 3, 2017: A Russian tech mogul named in the Steele “dossier” files defamation lawsuits against BuzzFeed in the U.S. and Christopher Steele in the U.K. over the dossier’s claims he interfered in U.S. elections.

Feb. 8, 2017: Jeff Sessions becomes Attorney General and Dana Boente moves to Deputy Attorney General.

March 20, 2017: FBI Director Comey tells House Intelligence Committee he has “no information that supports” the President’s tweets about “alleged wiretapping directed at him by the prior administration. “We have looked carefully inside the FBI,” Comey says. “(T)he answer is the same for the Department of Justice and all its components.”

FBI Director Comey tells Congress there is “salacious and unverified” material in the Fusion GPS dossier used by FBI, in part, to obtain Carter Page wiretap. (Under FBI “Woods Procedures,” only facts carefully verified by the FBI are allowed to be presented to court to obtain wiretaps.)

March 22, 2017: Chairman of House Intelligence Committee Devin Nunes (R-Calif.) publicly announces he’s seen evidence of Trump associates being “incidentally” surveilled by Obama intel officials; and their names being “unmasked” and illegally leaked. Nunes briefs President Trump and holds a news conference. He’s criticized for doing so. An ethics investigation is opened into his actions but later clears him of wrongdoing.

May 3, 2017: FBI Director Comey testifies he’s “mildly nauseous” at the idea he might have affected election with the 11th hour Clinton email notifications to Congress.

Here Are 4 Facts From Democratic Memo That Destroy Trump’s FBI Conspiracy


1). The FBI supplied information to the Foreign Intelligence Surveillance Court that Russia might be colluding with Trump campaign associates. DOJ provided the Court with a comprehensive explanation of Russia’s election interference including evidence that Russia courted another Trump foreign policy advisor, George Papadopoulos, and that Russian agents previewed their dissemination of information damaging to Hillary Clinton. Russian assistance would, as we would learn in the Papadopoulos plea, take the form of the anonymous disclosure of thousands of Hillary Clinton and DNC emails.

3). The FBI did disclose that those who employed Christopher Steele were likely motivated to discredit Trump’s presidential campaign.

The Bureau used proper masking procedures so as not to reveal the identities of U.S. persons not subject to the FISA, but

made clear that the likely purpose was opposition research.

4). Contrary to the Majority’s assertions, the

FBI and DOJ did not use a Yahoo News article to corroborate Steele;

it was referenced alongside another article and a letter Page wrote to then FBI Director James Comey to inform the court of Page’s public denials.

Twitter using 45 million election-related tweets

generated by 5.7 million users in a one-month period ahead of the election;

researchers delved into what information was spread by trolls, who spread it, and how many times those tweets were shared.
