Missouri Department of Health and Senior Services (DHSS). Robinson and her co-plaintiffs challenged health agencies' powers to issue restrictions to prevent the spread of disease, such as ordering quarantines. Attorney General Schmitt defended DHSS in the case and has refused to appeal its outcome.
Green ruled, essentially, that it was unconstitutional for the state to delegate disease prevention powers to unelected health officials.
"The authority that the DHSS regulations purport to grant to an administrative official to implement control measures and create and enforce orders is open-ended discretion—a catch-all to permit naked lawmaking by bureaucrats throughout Missouri," Green wrote in his judgment.
Specifically, Green ruled that regulations 19 CSR 20-20.040(2) G-I, 19 CSR 20-20.040(6), and 19 CSR 20-20.050(3) all violate the state's constitution (codes found here (https://cdn.arstechnica.net/wp-content/uploads/2021/12/19c20-20.pdf), highlighted in yellow). Collectively, those regulations charge local health authorities with the responsibility of establishing disease-control measures, investigating clusters or outbreaks of illness, and implementing appropriate control measures when necessary. Those control measures can include isolation, quarantine, disinfection, immunization, establishment closures, notification of people potentially exposed, and communication with the public over potential risks and prevention strategies. Regulation 19 CSR 20-20.050(3) specifically deals with quarantine and isolation powers and authorizes closures of schools and other public and private gathering places.
Green wrote in his judgment that local health officials should refrain from taking actions on communicable disease prevention "that require independent discretion in a manner inconsistent with this opinion."

Every 36 hours post known exposure to two infected co-workers, I home tested.
A week has passed, all my tests were negative and I'm symptom free. Same with my sweetie. Home sequestration over.

Burch had to wait that long to be seen by a primary care doctor. He said the doctor told him, “‘If things were different, I would tell you to go to the hospital and be diagnosed, have some tests run and see what’s going on with you.’ But he says, ‘As of today, Delta County hospital is clear full. There are no beds available.’”
The covid variant delta has overwhelmed the Colorado county of the same name. Hospitals on the Western Slope have been slammed for weeks, and the statewide picture is similarly grim. As of Monday, the state’s coronavirus website (https://covid19.colorado.gov/data) reported 1,294 patients hospitalized with covid-19. Half of the state’s hospitals said they anticipated a staffing shortage in mid-December; more than a third of them anticipated bed shortages in their intensive care units at the same time.
And behind those numbers, patients are feeling the impact.
Burch’s doctor told him he might have to wait hours in the emergency room, perhaps with people who have flu or covid symptoms. So Burch stayed home.

Burch’s situation is not uncommon this fall, as the state faces its second-worst covid surge for hospitalizations and deaths. Hospitals are under tremendous strain and that means delays and changes from normal care, as strapped providers do more with less.
“Hospitals across Colorado are in critical condition. We have been at 90%-plus capacity in our ICU and acute care beds for weeks now. And unfortunately, there doesn’t appear to be an end to that situation in the near future,” said Cara Welch, a spokesperson for the Colorado Hospital Association.
Diann Cullen, 72, a retiree in Broomfield, Colorado, was told by her doctor that her hernia surgery would have to be postponed for weeks. Her reaction: “Frustration, extreme frustration, actually anger, because I said a bad word. … He flat-out told me we can’t even do it because of too many covid patients.”

Delta wave in Bexar County the unvaxxed rate among those hospitalized for COVID was pretty consistently around 85% despite the county having a vaccination rate somewhere around 70% last time I checked. Well, at least free rapid testing is already being done everywhere in the US, you can get antigen tests done free at CVS, Walgreens, and others and have the results in a few hours. I took a free pcr at CVS about a week and a half ago and got results in I think a day and a half on that. I don't think I'd put capacity limits on restaurants now that we have vaccines. Non fast-food restaurants were hanging on by a thread before vaccinations became widely available and people could eat in dining rooms without fear of contracting a novel virus.

Stop spreading fake news, it takes two minutes to sign up for a test at their website and then you just show up around your scheduled time at the pharmacy drive through window. I have taken a test at CVS and one at Walgreens and they were both easy to sign up for and do.
