Jared Kushner, Mr. Trump’s son-in-law and senior adviser, has been functioning as something of a shadow task force. That group is likely to continue working; among other issues, Mr. Kushner is said to be discussing a new role for someone to oversee development of therapeutic treatments.

Irrelevant response. Therefore I won't respond directly to it. What really matters is an obvious policy to shutdown travel was lambasted and the people suggesting the policy were called xenophobic. To expect these big brain government officials to then have the ability to analyze regulations and get rid of them swiftly during a emergency is just pure fantasy. And that fantasy is where you currently are when you start positioning leadership as the issue because "these regulations can be lifted during emergency". The reality is the government can't recognize the most basic changes to make during an emergency so you need systems that aren't as reliant on concentrated decision makers.

relax jordan peterson. this is a public health issue and a contagious one, it's not something like obesity that is more or less up to the individual

There is going to be many months before most people get the virus. During that time people can take steps as individuals to increase there chances when they get the virus. It's absolutely moronic to minimize the power of the individual.

apparently viruses do naturally mutate after going through so many hosts. Good thing is when they become more contagious they usually become less deadly to try and survive, which means not killing hosts before it can spread. If it lasts past a few years unlike SARS/MERS it could do it by mutating into a much less deadlier version of original COVID

There will never be enough, or they'll just deflect the blame onto other individuals. One reason cult devotees can't break themselves from their allegiance is because of the sunk cost fallacy. They have invested so much emotionally and psychologically for such a long time into the movement, cutting ties would be too psychologically damaging and emotionally demoralizing, especially since the cult has become a significant part of their identity. Breaking away is kind of like committing suicide in a sense. That's why it's so hard for people to forsake cults.

Why are you folks so afraid to address the NY situation honestly instead of going for the November agenda? It's not a good look for ya's.

Are you saying this is wrong:

2. No, the president cannot simply order state and local officials to change their policies

Here we have issues that fall under the headings of both federalism and separation of powers. Let’s start with federalism.

Most readers will appreciate this already, but it needs to be said: Our constitutional order has a federal structure, meaning that (a) federal powers are supreme, yes, but limited in scope and (b) the state governments are independent entities, not mere subordinate layers under and within the federal government (that is, the federal-state relationship is not similar to the way that counties and cities are subordinate layers under the state governments).

What follows from this? The federal government cannot commandeer the machinery of the state governments (or, by extension, of local governments). That is, the federal government cannot coerce the states into taking actions to suit federal policy preference. See, e.g., New York v. United States and Printz v. United States. And so, the federal government cannot compel state and local officials to promulgate different rules on social distancing and the like.

The Trump administration’s quarantine and travel ban in response to the Wuhan coronavirus could undercut international efforts to fight the outbreak by antagonizing Chinese leaders, as well as stigmatizing people of Asian descent, according to a growing chorus of public health experts and lawmakers.

The World Health Organization’s top official on Tuesday repeated concern that moves that interfere with transportation and trade could harm efforts to address the crisis, though he didn't directly name the United States. Meanwhile, unions representing flight attendants, nurses and teachers criticized the administration on Tuesday for not being forthcoming about what kind of screening and treatment individuals will undergo, and some members of Congress say they're concerned the efforts could stoke racial discrimination.

"In stark contrast, officials at the U.S. Food and Drug Administration (FDA) and the Centers for Disease Control and Prevention (CDC) stymied private and academic development of diagnostic tests. Much to the contrary, the CDC required that public health officials use only a diagnostic test designed by the agency. That test—released on February 5—turned out to be contaminated by a reagent that made it impossible for outside labs to tell if the virus was present in a sample or not. The CDC's insistence on top-down centralized testing meant there were no available alternatives, which greatly slowed down disease detection just as the infection rate was accelerating.

This massive bureaucratic failure is a big part of why a larger proportion of Americans than of South Koreans will suffer and die from the viral illness."

Some look at this failure and blame Trump for not being all knowing to remove regulations that prevent the market from solving problems.

And so, the federal government cannot compel state and local officials to promulgate different rules on social distancing and the like.

You've glossed over the numerous times in the past I've said Di Blasio has fucked up the response -- and -- even where I said he was godawful in the fucking post you're quoting -- all to push a narrative. There's no point in quoting me if you're not even going to bother responding to what I've said. Again, posters besides me have repeatedly "addressed" the NY situation -- why can't you address the Trump situation?

Your own post responds to your half-assed attempt to raise the federal issue. Also, commandeering is irrelevant when the USFG could use its interstate commerce power and/or use commerce clause power to condition funds on the states doing what they say.

But that's got nothing to do with the question you want nothing to do with: What does Di Blasio being godawful have to do with Trump?

vy65
05-05-2020, 11:46 PM
This last observation raises yet another point: Professor Dorf’s bottom line might be correct—the federal government has broad powers here to impose a national lockdown—but the Commerce Clause power needn’t and shouldn’t be the only authority to look at or rely on. Today’s coronavirus is from all indications a natural phenomenon, but what if another super-virus—the next one—is introduced in America intentionally as a form of biological warfare? Recent headlines about the U.S. military sheltering in place remind us all that military preparedness might depend in the twenty-first century on creating—even by mandate—herd immunity, just as other forms of military preparedness throughout American history have required compulsion (e.g., selective service conscription).

DMC gonna run away from this shit like he always does. He read an article once about anti-commandeering doctrines, so apparently now he's a consitutional scholar.

vy65
05-05-2020, 11:48 PM
The federal government derives its authority for isolation and quarantine from the Commerce Clause of the U.S. Constitution.

Under section 361 of the Public Health Service Act (42 U.S. Code § 264), the U.S. Secretary of Health and Human Services is authorized to take measures to prevent the entry and spread of communicable diseases from foreign countries into the United States and between states.

The authority for carrying out these functions on a daily basis has been delegated to the Centers for Disease Control and Prevention (CDC).

The "Life, Liberty & Levin" host explained that the Commerce Clause of the Constitution gives Congress the power to "regulate commerce ... among the several States" and added that the New Deal era saw Supreme Court rulings that further strengthened the federal executive's authority over the states.

"The debate about federalism was a fake debate and I've given this a lot of thought," Levin said. "This has nothing to do with federalism. The president has more power to order governors, if he chooses, to open up their economies than people think.

With New Hot Spots Emerging, No Sign of a Respite

While cities like New York have seen a hopeful drop in cases, upticks in other major cities and smaller communities have offset those decreases.

Yet across America, those signs of progress obscure a darker reality.

The country is still in the firm grip of a pandemic with little hope of release.

For every indication of improvement in controlling the virus, new outbreaks have emerged elsewhere, leaving

the nation stuck in a steady, unrelenting march of deaths and infections.
As states continue to lift restrictions (https://www.nytimes.com/interactive/2020/us/states-reopen-map-coronavirus.html) meant to stop the virus, impatient Americans are freely returning to shopping, lingering in restaurants and gathering in parks.

Regular new flare-ups and super-spreader events are expected to be close behind.
Any notion that the coronavirus threat is fading away appears to be magical thinking,

at odds with what the latest numbers show (https://www.nytimes.com/interactive/2020/us/coronavirus-us-cases.html).

Nothing, really. It is merely his schtick: never playing defense. He will ignore your points, then flip it and simply attack. It gets very boring after a while.

You don't need a Twitter account to read tweets on Twitter. If you click on the tweet(don't click on the link box within the tweet) it should open up another tab with the tweet I linked. Click on the tweet from that tab and it you'll see the 10 chain tweet "thread" from that individual.

That must be something new they added as of late. Before you needed an account to even view trending topics. Now you can go on twitter and see everything that's trending without being logged in. That should have been an option from the beginning.

The jail numbers are crazy, though. I wonder if they got a bad batch of tests?

Not really. Public Education still exist and Health care once upon a time wasn't as bad as it is now.

If we go by this logic, lets privatize public education too which is actually the case in some cities around the world since its no biggie we'll benefit in the short term anyway..

I've seen this happen in Canada.

Here they sold the telecomunication company that was publicly owned and privatized the services.

And while it offered better services to smaller municiplaities due to investment, The prices have increased to as much 70%.

A typical phone plan a year and half ago that was for 30$ is now 65$

I guess its fine because now the 10% of people who use to struggle with 10mpbs can now have 50mpbs internet.

Nothing good comes out of excessive privatization specially in services that should be public.

Because POTUS has the power to check retards at the local level of government.

Why does Di Blasio being a godawful leader make Trump a good one?

Who is in control of New York where 25000 people have died from the virus?

:lol. I'm seeing this a lot from Conservatard twitter. Um, the most densely populated states in colder weather regions are typically Blue states. What seem to be the key factors that contribute to spread? Population density and colder weather.

Agreed. But you’ve got to admit the biased media coverage of Cuomo compared to say DeSantis has been laughable. One forced Covid patients into skilled nursing homes while the other worked to protect his vulnerable population. One was hailed as a hero.

But you have to admit Trump did a shitty job. Just admit it, cultist.

Yeah, telling people the virus is under control DESPITE the CDC fuckups on Feb. 5th (Trump was still shilling the stock market 3 weeks later) isn't a shitty job. And he was even BACKING UP the CDC as doing "a great job" on February 25th. Then he says on Feb. 26th, the next day, that cases will soon be down to zero. You know what a great "leader" does in the situation? Tells the fuckin' truth to the people, something like, "This very could well be a serious situation that will progress to an epidemic. I suggest the American people try to stay home as much as possible, wash their hands, and practice some social distancing until more information comes to light." Anyone who isn't a cult member should realize in hindsight that Trump's comments and downplaying were 100 percent motivated by trying to protect the stock market and economy in an election year, since those are the only things he can really campaign on. Without a strong economy and market, he basically loses all of the "hold their noses and vote for him" voters.

"Maybe he got the wrong information from his 'experts'" :cry? If you believe that, I got a moon made out of cheese to sell you.

Both governors did restrict nursing home visitations. To be fair about the Cuomo policy of not restricting nursing homes from accepting Covid patients, nursing homes and ALF are also rehab centers. If an older patient who recovered from a nasty bout with Covid hasn't anywhere else to go (i.e. they can go somewhere where friends and family can take care of them), I think Cuomo's hands would be tied in this situation. Where else are you supposed to send a recovered patient still in bad shape if there isn't anyone else to take them?

DMC's rebuttal here is that the president isn't responsible for everything. And maybe so, to that I ask, "Why the fuck do we even need a president anyway?" What purpose do they really serve aside from diplomatic photo ops and a something for the R and D teams to fight over? The whole fuckin' point of "states rights" was basically to make a single figurehead powerless. They even need congress to declare war. "Presidents" are obsolete. The founders actually figured that out, too, since they entire point of decentralizing power was avoid the type of monarchy the revolution fought to free the colonials from.

Maybe the R and D teams would get along much better and the states would be more united if the US got rid of the President concept. States rights all the way. The US is too culturally and politically diverse for a single person to "represent" all of them.

Intel shared among U.S. allies contradicts claim coronavirus spread because of lab accident

Intelligence shared between the U.S., United Kingdom, Canada, Australia, and New Zealand indicates that

it's "highly unlikely" the COVID-19 coronavirus originated in a Wuhan, China, laboratory

intelligence points to the coronavirus outbreak coming from a market in Wuhan, and it's "highly likely it was naturally occurring and that the human infection was from natural human and animal interaction."

"clearly the market is where it exploded from," but it's not clear how the virus got there. This official noted that each Five Eyes country does keep some intelligence to themselves, and

the U.S. might not be sharing everything it knows about the coronavirus.

Pompeo has claimed there is "enormous evidence" the coronavirus spread as a result of a lab accident, :lol LIE

backing up earlier comments made by President Trump. :lol LIE

there is no evidence the virus was man-made or genetically modified.

Trash and his mafiya scapegoating China and WHO while refusing to discuss his negligent manslaughter,

except to say he was pre-occupied (not his word, of course) because of the Dems investigations of Russia, impeachment, Ukraine.

I’m not talking about recovered patients, I’m talking about active cases being forced on them.

“No resident shall be denied re-admission or admission to the NH solely based on a confirmed or suspected diagnosis of COVID-19. NHs are prohibited from requiring a hospitalized resident who is determined medically stable to be tested for COVID-19 prior to admission or readmission.”

And you totally skipped over the difference in media coverage :lol

"Recovered" doesn't the virus isn't out of your body. Just means they were discharged after surviving the worst of it. I found this article that is critical of Cuomo, and it says, "

The Committee to Reduce Infection Deaths told New York Gov. Andrew Cuomo to reverse a policy that forces nursing homes to accept new residents infected with the coronavirus who have been discharged from hospitals but are still recovering.

https://www.libertyheadlines.com/cuomo-dooms-seniors-coronavirus/

That's why I ask, "Where are they supposed to go?" I assume they were discharged and not kept in the hospital to recover, as in free of the virus, since the hospital needed the bed.

I don't watch much MSM, but Cuomo doesn't deserve any hero label. I would say his response was better than DeSantis, who lucked out that the warm weather/UV light and pop density theories were (probably) true. He issued a stay-at-home order pretty damn late.

Seriously doubt them being able to go get haircuts and dine out would limit the R0. End of the day, these people would've still been cooped up in the same place for 12-16 hours per day. Staying at home likely prevented these infectious clusters from infecting even more people.

we're still looking at daily deaths of 2k with NY barely contributing to more than 10% of that. no good...

i mean good for NY, and glad it seems to be slowing there, but "no good" in the sense that the national picture isn't rosy
